AN ORDINANCE
APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS'
WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE
VARIOUS COSTS FOR THE IMPROVEMENTS OF THAT PORTION OF
THE FOLLOWING NAMED STREETS:
'. OSAGE STREET FROM CHIPPEWA TO MORGAN AVENUE
2. HIGHLAND AVENUE FROM OSAGE STREET TO PORT AVENUE
3. PORT AVENUE AND MORGAN STREET INTERSECTION;
AND THE FOLLOWING MISCELLANEOUS SIDEWALK IMPROVEMENTS:
1. MCMULLEN ROAD FROM NAVIGATION BOULEVARD TO WEST 050
SCHOOL
2. NAVIGATION BOULEVARD FROM MCMULLEN ROAD TO MOLINA
3. CLIFF MAUS FROM CULVER TO MCMULLEN ROAD;
AND DETERMINING AND FIXING THE PORTION OF SAID COSTS
TO BE PAID BY THE CITY OF CORPUS CHRISTI; DETERMINING
THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID
ABUTTING PROPERTY; ORDERING AND SETTING A HEARING TO
BE HELD ON FEBRUARY 26, 1g6g, TO GIVE NOTICE OF SAID
HEARING AS REQUIRED BY THE LAWS OF THE STATE OF TEXAS
AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND
DECLARING AN EMERGENCY.
WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
HERETOFORE ON THE 22ND DAY OF JANUARY, 1969, BY DULY ENACTED ORDINANCE
DETERMINED THE NECESSITY FOR AND ORDERED THE IMPROVEMENT OF THE PORTION OF
THE FOLLOWING NAMED STREETS:
1. OSAGE STREET FROM CHIPPEWA TO MORGAN AVENUE
2. HIGHLAND AVENUE FROM OSAGE STREET TO PORT AVENUE
3. PORT AVENUE AND MORGAN STREET INTERSECTION;
AND THE FOLLOWING MISCELLANEOUS SIDEWALK IMPROVEMENTS:
1. MCMULLEN ROAD FROM NAVIGATION BOULEVARD TO WEST
OSO SCHOOL
2. NAVIGATION BOULEVARD FROM MCMULLEN ROAD TO MOLINA
3. CLIFF MAUS FROM CULVER TO MCMULLEN ROAD;
A DULY EXECUTED NOTICE OF SAID ORDINANCE HAVING THEREAFTER BEEN FILED IN THE
NAME OF THE CITY WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS; AND
WHEREAS, THE SAID CITY COUNCIL HAS CAUSED THE DIRECTOR OF PUBLIC
WORKS TO PREPARE AND FILE ESTIMATES OF THE COSTS OF SUCH IMPROVEMENTS AND
ESTIMATES OF THE AMOUNT PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE
PROPERTY ABUTTING SAID STREET IMPROVEMENTS TO BE IMPROVED, AND THE READ AND
TRUE OWNERS THEREOF, AND SAID DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED
SAID ESTIMATES AND A STATEMENT OF OTHER MATTERS RELATING THERETO WITH SAID

CITY COUNCIL, AND THE SAME HAVING BEEN RECEIVED AND EXAMINED BY SAID CITY
COUNCILS AND
WHEREAS, IN ACCORDANCE WITH SAID STATEMENT OF ESTIMATES AND OTHER
MATTERS PREPARED AND FILED BY SAID DIRECTOR OF PUBLIC WORKS HEREIN APPROVED
BY SAID CITY COUNCIL, THE TOTAL ESTIMATED COST OF THE WHOLE IMPROVEMENT OF
THE AFORESAID STREETS, WITHIN THE LIMITS HEREINABOVE DEFINED, IS $16g,gD2.61.
THAT THE TOTAL ESTIMATED AMOUNT OF THE COST OF SAID IMPROVEMENTS TO THE FORE-
GOING STREET PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, IS $72,508.76; THE TOTAL ESTIMATED AMOUNT OF
THE COST OF SAID IMPROVEMENTS TO THE FOREGOING STREETS WITHIN THE LIMITS
ABOVE DEFINED PROPOSED TO BE PAID BY THE CITY OF CORPUS CHRISTI IS $97,393.85;
AND
WHEREAS, ACCORDING TO SAID WRITTEN STATEMENT OF SAID DIRECTOR OF
PUBLIC WORKS, THE NAMES OF THE APPARENT OWNERS OF SAID ABUTTING PROPERTY,
THE DESCRIPTION OF THEIR PROPERTY, THE NUMBER OF FRONT FEET OWNED BY EACH,
THE ASSESSMENT RATES IN SQUARE AND LINEAL FEET, THE AMOUNT PROPOSED TO BE
ASSESSED AGAINST EACH ABUTTING PROPERTY AND THE REAL AND TRUE OWNERS THERE-
OF AND OTHER MATTERS CONTAINED IN SAIC STATEMENT ARE AS FOLLOWS, TO -WIT:

3. Cliff Maus from Culver to McMullen Road
I. STREET IMPROVEMENTS, -This portion of the project consists of the construction
of several streets in the following manner:
A. The construction will consist generally of excavation to a depth and width
to permit the laying of standard 6" curb and gutter sections and installation
and paving as follows:
1. Osage Street - The base for this street will consist of 6" of compacted
subgrade, 9" of compacted caliche base, a prime coat, and 2" of Type
"D" asphaltic concrete surface for the width of 37' measured from the
back of curbs.
2. Highland Avenue - The base will consist of 6" of compacted subgrade, 9"
of compacted caliche base, a prime coat, and 2" of Type "D" asphaltic
concrete surface for the width of 45' measured from the back of curbs.
3. Port and Morgan Intersection - The work on this section consists of the
channelizat'ion of the intersection by constructing a median to provide
left turn movements and also the reconstruction of curbs and driveways
at the northeast corner and the transition of the existing pavement
along Port Avenue from Brannan to Segrest.
Also to be constructed along with the street improvements on the above
streets are reinforced concrete sidewalks; 5' zride where tied to the
back of the curb and 4' wide where next to the property line, and 4"
thick. Concrete driveways are also proposed as required by property
owner's requests, and also storm sewers as needed to drain the streets.
II. SIDM-JALK IMPROVL�iVTS -This portion of the project on Cliff Maus Drive, McMullen
Road, and Navigation Boulevard consists of the construction of 4' aide, 4" thick
concrete sidewalks along one side of the street with the necessary pipe crossings at
street intersections to provide access, and with some shell portions where impracti-
cal to construct concrete.
III. Assessment rates for the above project have been calculated by using the unit
prices taken from the low bid and applying these unit prices to the front footage of
the abutting property in accordance :r th the assessment policy as follows:
Osage Street, property zoned and used R -1 or R -2
Pavement, curb and gutter @ $5.88 p.l.f.
Property zoned or used other than R -1 or R -2
Pavement, curb and gutter @ $7.85 p.l.f.

SECTION 6. THE FACT THAT THE STREETS WITHIN THE LIMITS ABOVE
DEFINED ARE BADLY IN NEED AT THIS TIME OF PERMANENT STREET IMPROVEMENTS,
AND THE FURTHER FACT THAT THE PRESENT CONDITION OF SAID PORTIONS OF
SAID STREETS ARE DANGEROUS TO THE HEALTH AND PUBLIC WELFARE OF THE
INHABITANTS OF THE CITY OF CORPUS CHRISTI DUE TO THE CONDITIONS AND
INCREASE OF TRAFFIC ALONG SAID PORTION OF SAID STREETS CREATES A PUBLIC
EMERGENCY AND PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED
THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL
