AN ORDINANCE
APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE
SUM OF $3,416.00, OF WHICH SUM $3,307.00 IS FOR THE
ACQUISITION OF PARCEL NO. 25 -B, AND $109.00 IS FOR
INCIDENTAL EXPENSES AND RELATED COSTS, ALL APPLICABLE
TO PROJECT NO. 220- 67 -97, OCEAN DRIVE - CRAIG TO
ALAMEDA JUNCTION; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNERS,
LORINE ESHLEMAN VOGT, WIFE OF WILLIAM VOGT, AND BENJAMIN
ESHLEMAN, JR.; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. There is hereby appropriated out of No. 220 Street
Bond Fund the sum of $3,416.00, of which sum $3,307.00 is for the acqui-
sition of Parcel No. 25 -B, and $109.00 is for incidental expenses and
related costs, all applicable to Project No. 220- 67 -97, Ocean Drive -
Craig to Alameda Junction, said parcel of land being described as follows:
TRACT NO. 1
A tract of land 40 feet in width and 212.87 feet in length
more fully described as being the southwest 40 feet of that certain tract
certain tract of land inherited by Lorine Eshleman Vogt from
Lorine Lewis, deceased, per certified copy of Probate recorded
in Volume 992, Page 558, Nueces County, Texas, Deed Records,
the southwest 30 feet of said 40 feet being in Ocean Drive
right of way.
TRACT NO. 2
A tract of land 40 feet in width and 102.04 feet in length
more fully described as being the southwest 40 fdet of that
certain tract of land conveyed to Lorine Eshleman Vogt by
Guaranty National Bank and Trust by deed dated November 29,
1967, of record in Volume 1252, Page 493, Nueces County,
Texas, Deed Records, the southwest 30 feet of said 40 feet
being in Ocean Drive right of way.
SECTION 2. That the City Manager be, and he is hereby, authorized
and directed to execute, for and on behalf of the City of Corpus Christi,
the aforesaid parcel of land, for the purposes herein designated, from the
owners, Lorine Eshleman Vogt, wife of William Vogt, and Benjamin Eshleman, Jr.
SECTION 3. The necessity to make the appropriation described
above and to authorize the City Manager to execute the necessary instruments
for acquisition of the above described parcel of land so that the project
described hereinabove may continue without delay creates a public emergency
and an imperative public necessity requiring the suspension of the Charter

rule that no ordinance or resolution shall be passed finally on the date
of its introduction and that such ordinance or resolution shall be read at
three several meetings of the City Council, and that the Mayor having
declared that such emergency and necessity exist, and having requested
that such Charter rule be suspended and that this ordinance be passed
finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,
this the 26th day of February, 1969.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SIOIJ OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT 15 INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
