HomeMy WebLinkAbout09273 ORD - 03/12/1969• 3/12/69:e AN ORDINANCE DECLARING ABANDONED A 20 -FOOT DEDICATED BUT UNIMPROVED ALLEYWAY, LYING BETWEEN BLOCKS 2 AND 3, ANDREWS SUB- DIVISION, EXTENDING IN A SOUTHWEST DIRECTION FROM ANDREWS DRIVE TO THE CROSSTOWN EXPRESSWAY (KNOWN AS LAWTON ALLEY), IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WITH THE PROVISIONS THAT THE EASEMENT HEREINAFTER DESCRIBED BE RESERVED FOR UTILITY LINES, AND THAT THE APPLICANT ASSUME THE COST OF RELOCATING OR REMOVING OF UTILITY LINES, IF ANY BE NECESSARY AS A RESULT OF SAID CLOSING; AND DECLARING AN EMERGENCY. WHEREAS, notice of the closing of the 20 -foot dedicated but un- improved alleyway lying between Blocks 2 and 3, Andrews Subdivision, extend- ing in a southwest direction from Andrews Drive to the Crosstown Expressway (known as Lawton Alley), in the City of Corpus Christi, Nueces County, Texas, has been given by publication and registered mail to the last known addresses of all owners abutting said alley and within 450 feet thereof, and thereafter, pursuant to said notice, which public hearing was held by the City Council of the City of Corpus Christi, Texas, on November 13, 1968, in accordance with the provisions of the City Charter; and WHEREAS, it has been determined that it will be to the advantage of the City to close the alley above described so that the same may be used by the abutting property owner for other purposes; conditioned, however, that the hereinafter described easement be reserved for utility lines, and conditioned further that the owner of the abutting property assume the cost of relocating or removing of utility lines, if any be necessary as a result of said closing: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby closed for public use that 20 -foot dedicated but unimproved alleyway lying between Blocks 2 and 3, Andrews Subdivision, extending in a southwest direction from Andrews Drive to the Crosstown Expressway (known as Lawton Alley), in the City of Corpus Christi, Nueces County, Texas; provoded, however, that the following easement be reserved for utility lines: 12 -1/2 foot utility easement on the entire West one -half of alley; and further, that the owner of the abutting property assume the cost of relocating or removing of utility lines, if any be neces- sary as a result of said closing. n SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the said portion of alley as out- lined above creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordi- nance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED THIS the 12th day of March, 1969.
