AN ORDINANCE
APPROPRIATING OUT OF NO. 202 WATER SYSTEM BOND FUND
THE SUM OF $13,676.50, OF WHICH AMOUNT $13,500.00 IS
FOR ACQUISITION OF PARCEL NO. 4, AND THE SUM -OF $176.50
IS FOR INCIDENTAL EXPENSES, APPLICABLE TO 0. N. STEVENS
MUD DRYING BED PROJECT; AUTHORIZING AND DIRECTING THE
CITY MANAGER TO EXECUTE BEAT ESTATE SALES CONTRACT FOR
AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE
OWNER OF THE AFORESAID PARCEL OR TRACT OF LAND, MARY R.
ELLIFF, A WIDOW; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CARPUS CHRISTI,
SECTION 1. There is hereby appropriated out of No. 220 Water
System Bond Fund, the sum of $13,676.50, of which amount $13,500.00 is for
acquisition of Parcel No. 4, and the sum of $176.50 is for incidental
expenses and related costs, applicable to 0. N. Stevens Mud Drying Bed
Project, said parcel being more fully described as follows, to -wit:
Being a portion of a 50.7 acre tract of land in the Gregorio
Farias Grant, Abstract No. 592, heretofore conveyed by R. E.
Fallin, et ux, to H. D. Countiss by deed dated August 6, 1929,
recorded in Volume 189, Page 136, Deed Records of Nueces County,
Texas, and being also a portion of a 6.776 acre tract as de-
scribed, and reserved to grantor, in deed from H. D. Countiss
to the City of Corpus Christi, Nueces County, Texas, which deed
appears of record in Volume 672, page 346, Deed Records of
Nueces County, Texas; the tract hereby conveyed being more
particularly described by metes and bounds as follows, to -wit:
Beginning at a point in the North right of way line of UpRiver
or Shell Road, being 30.0 feet from the centerline thereof,
measured at right angles thereto, which bears along said line
South 840 11' West a distance of 41.89 feet from the point of
intersection of said line with the Easterly boundary line of
said 50.7 acre tracit for the Southeast and beginning corner of
this tract;
Thence South 840 11' West along said North right of way line
of UpRiver or Shell Road a distance of 100 feet to a point for
the Southwest corner of this tract, the same being the Southeast
corner of a tract of land conveyed by H. D. Countiss and Sam
Countiss to G. R. Stubbs, et al, by deed dated April 30, 1956,
recorded in Volume 732, Page 579, Deed Records of Nueces County,
Texas;
Thence North 30 31' West along the East boundary line of the
said G. R. Stubbs, et al, tract a distance of 299.01 feet to a
point for the Northwest corner of this tract, same being the
Northeast corner of said G. R. Stubbs, et al, tract;
Thence North 840 11' East along the North boundary line of said
6.776 acre tract a distance of 100 feet to a point for the North-
east corner of this tract;
Thence South 30 31' East parallel to the West boundary line hereof,
a distance of 299.01 feet to the place of beginning; being the
same property sometimes known and referred to as Lot 16 of an
unrecorded subdivision of H. D. Countiss of a portion of said 50.7
acre tract and a portion of the adjoining 56.75 acre tract lying
immediately East thereof.

SECTION 2. The City Manager be, and he is hereby, authorized and
firected to execute real estate sales contract, for and on behalf of the City
of Corpus Christi, with the owner of the aforesaid parcel, Mary R. Elliff,
a widow.
SECTION 3. The necessity to appropriate the sums hereinabove
described and to authorize the purchase of the aforesaid parcel for the
0. N. Stevens Mud Drying Bed Project, creates a public emergency and impera-
tive public necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date of its intro-
duction and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such emergency
and necessity to exist, and having requested the suspension of the Charter
rule that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED, this the 12th day of March, 1969.

APPROPRIATED FOR ANY OTHER PURPOSE.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE2
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
