HomeMy WebLinkAbout09276 ORD - 03/12/1969JKH:3 -12 -69 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A LEASE AGREEMENT WITH SIMON GROSSMAN, AS TRUSTEE FOR ED GROSSMAN, FOR THE LEASING OF A BUILDING AT 1020 AND 1022 LEOPARD STREET, IN THE CITY OF CORPUS CHRISTI, TEXAS, FOR A TERM OF THIRTY -ONE MONTHS, AT A RATE OF $175.00 PER MONTH, FOR USE AS OFFICE SPACE BY THE CITY OF CORPUS CHRISTI, A COPY OF WHICH LEASE AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS J' CHRISTI, TEXAS: I, I, SECTION 1• THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED 1 AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A LEASE AGREEMENT WITH SIMON GROSSMAN, AS TRUSTEE FOR ED GROSSMAN, FOR THE LEASING OF A BUILDING LOCATED AT 1020 AND 1022 LEOPARD STREET, IN THE CITY OF CORPUS CHRISTI, TEXAS, FOR A TERM OF THIRTY -ONE (31) MONTHS, AT A RATE OF $175.00 PER MONTH, FOR USE AS OFFICE SPACE BY THE CITY OF CORPUS CHRISTI, A COPY OF WHICH LEASE AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO IMMEDIATELY EXECUTE THE AFORESAID LEASE AGREEMENT SO THAT THE TERMS AND CONDITIONS SET FORTH THEREIN CAN BE T EFFECTED WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC 9� NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF MARCH, 1969. MARVIN TOWNSEND, HEREINAFTER REFERRED TO AS "LESSEE": WITNESSETH: IN CONSIDERATION OF THE MUTUAL COVENANTS HEREIN CONTAINED ON THE PART OF LESSOR AND LESSEE TO BE KEPT AND PERFORMED, LESSOR DOES HEREBY LEASE UNTO LESSEE A BUILDING A14D PREMISES LOCATED IN BLOCK 344, BLUFF PORTION OF THE CITY OF CORPUS CHRISTI, MORE PARTICULARLY DESCRIBED AS FOLLOWS: ALL OF THAT BUILDING, APPROXIMATELY 4O' X 75' IN SIZE, LOCATED AT 1020 AND 1022 LEOPARD STREET, LOCATED ON PORTIONS OF LOTS 11 AND 12, BLOCK 344, BLUFF PORTION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. IN ADDITION TO SAID BUILDING, THERE IS HEREBY LEASED To LESSEE THE PARKING AREA APPROXIMATELY 50' X 150' ON LOT 10 IN SAID BLOCK 344, BLUFF PORTION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SAVE AND EXCEPT SIX (6) PARKING SPACES ON THE SOUTHWEST PORTION OF SAID PARKING LOT PRESERVED FOR THE USE OF TENANTS AND EMPLOYEES OF THE DRUG STORE AND BARBER SHOP LOCATED ON LOTS 11 AND 12, BLOCK 344, BLUFF PORTION. THERE IS FURTHER LEASED TO THE LESSEE THE UNIMPROVED LOT, APPROXIMATELY 50' X 1501 IN SIZE, AND MORE PAR- TICULARLY DESCRIBED AS LOT 9, BLOCK 344, BLUFF PORTION OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WHICH SAID LOTS MAY BE USED BY THE CITY FOR PARKING. SAID PROPERTIES ARE LEASED UPON THE TERMS, CONDITIONS AND COVE- NANTS AS FOLLOWS: 1. THE TERM OF THE LEASE IS THIRTY -ONE (31) MONTHS, BEGINNING MARCH 15, 1969, FOR A TOTAL RENTAL OF FIVE THOUSAND FOUR HUNDRED TWENTY -FIVE AND N0/100 DOLLARS ($5,4425.00), PAYABLE EACH MONTH AT THE RATE OF ONE HUNDRED , 0� 0 no SEVENTY -FIVE DOLLARS (^$175) PER MONTH, THE FIRST PAYMENT TO BE MADE ON OR BEFORE MARCH 15, 1969, AND A LIKE PAYMENT TO BE DUE AND PAYABLE ON THE 15TH DAY OF EACH MONTH THEREAFTER FOR THE FULL TERM OF THIRTY -ONE (31) MONTHS, EACH PAYMENT BEING IN ADVANCE FOR THE ENSUING MONTH. 2.. LESSEE SHALL HAVE AND IS HEREBY GRANTED AN OPTION TO EXTEND SAID LEASE FOR A THREE -YEAR PERIOD AT A RENTAL OF ONE HUNDRED SEVENTY -FIVE DOLLARS ($175) PER MONTH, PAYABLE MONTHLY, IN ADVANCE. SAID OPTION MAY BE EXERCISED AT ANY TIME PRIOR TO THE LAST THREE (3) MONTHS OF THE TERM OF THIS LEASE BY WRITTEN NOTICE FROM LESSEE TO LESSOR, BY CERTIFIED MAIL, ADDRESSED TO LESSOR AT 1630 SOUTH BROWNLEE, CORPUS CHRISTI, TEXAS. 3. SAID BUILDING IS LEASED IN THE CONDITION AS THE SAME EXISTS, WITH THE PROVISION THAT LESSEE MAY MOVE THEREFROM AND DISPOSE OF ALL OR ANY PART OF THE COUNTERS NOW LOCATED IN SAID BUILDING, LESSOR HEREBY ABANDONING ANY INTEREST IN SAID COUNTERS. LESSOR SHALL BE RESPONSIBLE FOR THE MAINTE- NANCE AND REPAIR OF THE ROOF AND THE FOUR EXTERIOR WALLS. LESSEE SHALL BE RESPONSIBLE FOR THE MAINTENANCE AND REPAIR OF THE INTERIOR OF THE SAID BUILD- ING DURING THE TERM OF THE LEASE AND MAY INSTALL SUCH PARTITIONS OR OTHER IMPROVEMENTS AS LESSEE MAY DESIRE WITH THE RIGHT TO REMOVE THE SAME UPON THE TERMINATION 1 OF THIS LEASE OR ANY EXTENSION THEREOF. `F. THE PARKING AREA IN THE REAR OF THE BUILDING LOCATED ON LOT 10, BLOCK 34, BLUFF PORTION OF THE CITY OF CORPUS CHRISTI, IS IN NEED OF GRADING AND PLACING OF ADDITIONAL SHELL MATERIAL THEREON FOR THE PURPOSE OF IMPROVING THE DRAINAGE AND WEARING SURFACE, AND SAID IMPROVEMENTS SHALL BE MADE BY THE LESSOR PROMPTLY AFTER THE EXECUTION OF THIS LEASE. 5. LESSEE SHALL HAVE THE RIGHT TO INSTALL A COOLING AND /OR HEATING SYSTEM AT LESSEES EXPENSE AND SHALL HAVE THE RIGHT TO REMOVE ANY PART OF SAID SYSTEM, INCLUDING THE DUCTS, UPON VACATION OF THE PREMISES. 6. LESSEE SHALL BE RESPONSIBLE FOR ALL UTILITIES. 1• 7. AFTER THE GRADING AND PLACING OF SHELL ON SAID LOT 10, BLOCK 34, BLUFF PORTION, MAINTENANCE OF SAID PARKING LOT AND THE IMPROVEMENT AND MAINTENANCE OF THE PART OF THE PARKING LOT ON LOT 9, BLOCK 34, BLUFF PORTION, SHALL BE AT THE EXPENSE OF THE LESSEE. -2- • TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS CORPUS CHRISTI, CHRISTI, TEXAS / nC DAY OF �9 y FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
