HomeMy WebLinkAbout09301 ORD - 03/26/1969• 3/26/69 • AN ORDINANCE APPROPRIATING OUT OF NO. 202 WATER SYSTEM BOND FUND THE SUM OF $4,118.00, OF WHICH AMOUNT $4,000.00 IS FOR ACQUI- SITION OF PARCEL NO. 7, AND THE SUM OF $118.00 IS FOR INCIDENTAL EXPENSES, APPLICABLE TO 0. N. STEVENS MUD DRYING BED PROJECT; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNER OF THE AFORESAID PARCEL OR TRACT OF LAND, EDWARD H. BUNDICK, SR., AND WIFE, PEARL ALICE BUNDICK; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. There is hereby appropriated out of No. 220 Water System Bond Fund, the sum of $4,118.00, of which amount $4,000.00 is for acquisition of Parcel No. 7, and the sum of $118.00 is for incidental expenses and related costs, applicable to 0. N. Stevens Mud Drying Bed Project, said parcel being more fully described as follows, to -wit: Being a 0.576 acre tract of land out of that certain 56.75 acre tract of land out of the G. Farias Grant, Abstract No. 592 of Nueces County, Texas, described as First Tract in a deed from R. E. Fallin and wife, Adelaide Hoffman Fallin to H. D. Countiss dated August 6, 1929, and recorded in Volume 189, Page 136, Deed Record of Nueces County, Texas, said 0.576 acre tract of land being more particularly described by metes and bounds as follows: Beginning at the most easterly southwest corner of Tract A, Spillway Tracts, as shown by map of record in Volume 28, Page 63, Map Records, Nueces County, Texas; Thence N. 830 36' 53" E. with the extension eastward of the south line of said Spillway Tracts, a distance of 86.37 feet to a point for the northwest and beginning corner of the tract herein described; Thence continuing N. 830 36' 53" E a distance of 83.92 feet to a point for the Northeast corner of this tract; Thence S. 10 06' 41" E. a distance of 300.0 feet to a point in the north right -of -way line of 60 foot wide UpRiver Road for the southeast corner of this tract; Thence S. 830 36' 53" W with the North right -of -way line of said UpRiver Road, a distance of 83.92 feet to a point for the southwest corner of this tract; Thence N. 10 06' 41" W a distance of 300 feet to the place of beginning. SECTION 2. The City Manager be, and he is hereby, authorized and directed to execute real estate sales contract, for and on behalf of the City of Corpus Christi, with the owners of the aforesaid parcel, Edward H. Bundick, Sr., and wife, Pearl Alice Bundick. 933 i - SECTION 3. The necessity to appropriate the sums hereinabove described and to authorize the purchase of the aforesaid parcel for the 0. N. Stevens Mud Drying Bed Project, creates a public emergency and impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 26th day of March, 1969.
