AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE,
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A
CONTRACT JOINING THE COASTAL BEND LAW ENFORCEMENT NET,
A COPY OF SAID CONTRACT BEING ATTACHED HERETO AND MADE
A PART HEREOF; AUTHORIZING THE PAYMENT OF THE MONTHLY
CHARGE OUT OF THE POLICE DIVISION BUDGET COMMENCING
WITH THE EFFECTIVE DATE OF THIS CONTRACT AS THE CITY'S
PORTION OF THE COST OF OPERATIONS; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT JOINING THE COASTAL BEND LAW ENFORCEMENT NET, A COPY OF SAID
CONTRACT BEING ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. AUTHORIZATION IS HEREBY GIVEN TO MAKE PAYMENT OF THE
MONTHLY CHARGES OUT OF THE POLICE DIVISION BUDGET, COMMENCING WITH THE
EFFECTIVE DATE OF THIS CONTRACT, AS THE CITY'S PORTION OF THE COST OF
OPERATIONS.
SECTION 3. THE NECESSITY TO ENTER INTO THE AFORESAID CONTRACT
AT THE EARLIEST PRACTICABLE DATE IN ORDER TO EFFECTUATE THE TERMS THEREOF
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING
THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR
HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED
THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE
IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

AGREEMENT
ESTABLISHING THE COASTAL BEND LAW ENFORCEMENT NET
WHEREAS, the Counties of Aransas, Bee, Brooks, Jim Wells,
Kleberg, Nueces, Refugio, San Patricio, the incorporated Cities of Alice,
Aransas Pass, Beeville, Corpus Christi, Kingsville, Portland, Robstown, the
Coastal Bend Regional Planning Commission, all in the State of Texas, and
the Department of Public Safety of the State of Texas share common problems
of law enforcement; and
WHEREAS, said Counties, Cities and Agencies deem it in the
public interest to establish the Coastal Bend Law Enforcement Net in
accordance with the provisions of Chapter 570 of the regular session of
the 59th Legislature of the State of Texas;
NOW THEREFORE:
Section 1. The Coastal Bend Law Enforcement Net is hereby
established by the Counties of Aransas, Bee, Brooks, Jim Wells, Kleberg,
Nueces, Refugio, San Patricia, the incorporated Cities of Alice,
Aransas Pass, Beeville, Corpus Christi, Kingsville, Portland, Robstown,
and the Coastal Bend Regional Planning Commission. Other contiguous counties, or
cities within any member County, provided that such city have a population
in excess of 6,000 persons, may become a member of the Coastal Bend Law
Enforcement Net by majority vote of the membership.
Section 2. The Coastal Bend Law Enforcement Net is created
by said Counties, Cities and the Coastal Bend Regional Planning Commission
as a means whereby the health, safety and general welfare of the citizens
of the Coastal Bend may be improved through the operation of a closed
circuit teletype network between member agencies to increase the accuracy,
speed, and dependability of law enforcement communications; and for the
purpose of securing such teletype network service from the Southwestern
Bell Telephone Company and /or other companies, and for such additional law
enforcement purposes as may be found in the public interest.
Section 3. The Coastal Bend Law Enforcement Net shall
consist of members from said signitory Counties, Cities, the Coastal Bend
Regional Planning Commission, the Department of Public Safety and such
additional county and city governments as may later become joint sponsors
with the founding Counties, Cities, and Agencies. Members shall be
appointed in writing by their sponsoring governments and agencies utilizing
the following criteria:
a) Nueces County and the City of Corpus Christi:
two members each.

b) Other County and City Governments: one
member each.
c) Coastal Bend Regional Planning Commission:
one member.
d) Department of Public Safety: one member.
The sponsoring governments and agencies may each designate
one alternate member, who may vote only in the absence of a regular
member from his sponsoring government or agency. The .presence of a
majority of the total voting members shall constitute a quorum. The
approval of a majority of those present and authorized to vote, shall be
required for action.
Section 4. The Coastal Bend Law Enforcement Net shall
come into existence upon approval of this Agreement by six or more
sponsoring County and /or City Governments and shall remain in existence
so long as four or more sponsoring County and /or City Governments are
providing it with current payments, as provided herein.
Section 5. The members of the Coastal Bend Law Enforcement
Net shall take such administrative action pursuant to the establishment and
implementation of this Agreement as they may find advisable, including
the adoption of bylows for operation.
Section 6. For the purpose of financing the operation of the
Coastal Bend Law Enforcement Net member Counties and Cities hereby agree
to pay an amount not to exceed $100 per month per county and /or city.
The members appointed to the Coastal Bend Law Enforcement Net are
authorized and directed to expend these funds collectively in the most
economical manner consistent with providing a dependable 24 hour closed
circuit teletype network between their respective law enforcement
agencies, the Department of Public Safety, and other agencies as
determined by majority vote, and provide such other collective service
as may be found feasible with available funds. The Coastal Bend Law
Enforcement Net is authorized to have such encumbrances as may be incurred, and
not in excess of authorized funds, submitted directly to sponsoring County
and City Governments for payment or billed for payment by the Coastal Bend
Law Enforcement Net, as may prove most advisable. However, each
participating government and agency may provide for its own use such additional
associated devices as it may deem advisable. The Coastal Bend Law
Enforcement Net is authorized to accept such additional grants of
technical and financial assistance as may become available and are deemed
to be within the intent of this Agreement.

Section 7. Each sponsoring County and City Government,
the Coastal Bend Regional Planning Commission, and the Department of
Public Safety agree to provide 90 days written notice to other participants
prior to withdrawal of individual participation.
IN WITNESS WHEREOF, this Agreement is executed effective
as of ratification by the sixth county or city government:

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT'SUCH ORDINANCE OR
