AN ORDINANCE
AMENDING ORDINANCE NO. 9098, PASSED AND APPROVED BY
THE CITY COUNCIL ON OCTOBER 30, 1968, BY AMENDING
SECTION 3 THEREOF, SO AS TO REDUCE DRIVEWAY ASSESS-
MENTS FOR MACARTHUR STREET, FROM BELTON TO BURNET,
IN THE AMOUNT OF $2,246.52; AND DECLARING AN EMERGENCY.
WHEREAS, ORDINANCE NO. 9098, PASSED AND APPROVED BY THE CITY
COUNCIL ON OCTOBER 302 1968, CLOSED THE HEARING ON CERTAIN STREET IMPROVE-
MENTS, INCLUDING A PORTION OF MACARTHUR STREET, FROM BELTON TO BURNET, AND
LEVIED ASSESSMENTS AGAINST THE PROPERTIES ABUTTING SAID PORTION OF SAID
STREET; AND
WHEREAS, IT HAS BEEN DEEMED FEASIBLE TO INCREASE THE WIDTH OF
MACARTHUR STREET FROM 28 FEET, AS ORIGINALLY PLANNED, TO 44 FEET, DUE TO
THE INCREASE IN TRAFFIC ALONG SAID STREET; AND
WHEREAS, IN VIEW OF THIS ADDITIONAL WIDENING OF MACARTHUR STREET,
IT HAS BEEN DETERMINED THAT THE ASSESSMENT ROLL ADOPTED IN THE AFORESAID
ORDINANCE NO. 9095, SHOULD BE AMENDED TO REDUCE THE AMOUNT OF ASSESSMENTS
FOR DRIVEWAY CONSTRUCTION ABUTTING MACARTHUR STREET, FROM BELTON TO BURNET:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT ORDINANCE N0. 9098, PASSED AND APPROVED BY THE
CITY COUNCIL ON OCTOBER 302 1968, BE AND THE SAME IS HEREBY AMENDED BY
AMENDING SECTION 3 THEREOF, SO AS TO REDUCE DRIVEWAY ASSESSMENTS FOR PRO-
PERTIES ABUTTING MACARTHUR STREET, FROM BELTON TO BURNET, IN THE AMOUNT OF
$22246.52, AS REFLECTED IN THE CORRECTED ASSESSMENT ROLL, A COPY OF WHICH
IS ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO IMMEDIATELY EFFECT THE AFORESAID
AMENDMENT IN ORDER TO CORRECT THE ASSESSMENTS FOR PROPERTIES ABUTTING
MACARTHUR STREET BETWEEN BELTON AND BURNET, CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH

This project, number 22o -67 -92.2, consists of the improvements to
the above streets in the following manner:
1. The construction will consist generally of excavation to
depth and width to permit the laying of standard 6 inch
curb and gutter section and the installation of pavement
as follows:
�, A 'a. Residential Section - The base for residential streets
will consist of o inch compacted sub - grade, 8 inches
of compacted caliche bate, a prime coat, and 1 inch of
Type "D" Asphaltic Concrete surface for the width of,
31 feet measured from the back of curbs.
b. Collector Streets - The base will consist of 6 inch
- - compacted sub - grade, 10 inches of caliche base, prime
F coat, and 1 inch of Type "D" Asphaltic Concrete for
a width varying from 41 feet measured from the back
a of curbs to 45 feet measured from the back of curbs.
2. Also to be constructed on this project are reinforced concrete
fivrE" sidewalks, 5 feet wide where tied to the back of the curb and
4 feet wide where next to the property line, 4 inches thick;
concrete driveways are also proposed as required by property
owners; and also storm sewers as needed to drain the streets.
Assessment rates have been calculated by using the unit prices
taken from the low bid and applying these unit prices to the
front footage of the abutting property in accordance with the
assessment policy as follows:
R -1, R -2 zone and.use for 31' B.B.

R -1, R -2 zone and use 45' B.B. and 10" caliche base
Curb, gutter, pvmt. @ $5.66 p.l.f.
Other than R -1 or R -2 zone or use and 41' B.B.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
