AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS
WITH THE COMMUNITY COMMITTEE ON YOUTH EDUCATION AND
JOB OPPORTUNITIES, FOR THE HEALTH AND WELFARE COM-
PONENTS OF THE 1969 HEAD -START PROGRAM, A COPY OF
SAID CONTRACTS BEING ATTACHED HERETO AND MADE A
PART HEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY COUNCIL, ON MAY 27, 1964, ADOPTED A POLICY
STATEMENT CONCERNING POVERTY AND NEED IN THE CORPUS CHRISTI COMMUNITY;
AND
WHEREAS, THE STAFF OF THE CITY AND REPRESENTATIVES FROM ALL
AREAS OF THE COMMUNITY HAVE CAREFULLY STUDIED ECONOMIC CONDITIONS EXIST-
ING IN THE COMMUNITY; AND
WHEREAS, CERTAIN OPPORTUNITIES ARE AVAILABLE THROUGH TITLE
II(B) OF PUBLIC LAW 88-452 TO PARTICIPATE WITH THE FEDERAL GOVERNMENT
TO MOBILIZE THE FULL RESOURCES OF THE COMMUNITY; AND
WHEREAS, THE COMMUNITY COMMITTEE ON YOUTH EDUCATION AND JOB
OPPORTUNITIES OF NUECES COUNTY, TEXAS, HAS RECEIVED A GRANT UNDER TITLE
11 -A OF THE ECONOMIC OPPORTUNITY ACT OF 1964 FROM THE OFFICE OF ECONOMIC
OPPORTUNITY, EXECUTIVE OFFICE OF THE PRESIDENT OF THE UNITED STATES; AND
WHEREAS, CERTAIN COMPONENTS OF THE PROGRAM TO BE PROVIDED BY
THIS GRANT CAN BE EXECUTED BY THE CITY - COUNTY HEALTH AND WELFARE DEPART-
MENT OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS
CHRISTI BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE CONTRACTS WITH THE
COMMUNITY COMMITTEE ON YOUTH EDUCATION AND JOB OPPORTUNITIES FOR THE
FOLLOWING COMPONENT ACTIVITY:

ALL ACTIONS HERETOFORE TAKEN IN CONNECTION WITH THE CARRYING OUT OF SAID
CONTRACTS AND THE ADMINISTRATION OF FUNDS THEREUNDER IS HEREBY RATIFIED
AND CONFIRMED.

SECTION 2. THE NECESSITY FOR IMMEDIATE ACTION TO ASSURE
PARTICIPATION OF THE CITY WITH THE FEDERAL GOVERNMENT IN THE ECONOMIC
OPPORTUNITY PROGRAM OF THE FEDERAL GOVERNMENT CREATES A PUBLIC EMERGENCY
AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT
SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE
AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED,

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass.this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.

The Grantee and Delegate agree as follows:
1• WORK TO BE PERFORMED, The Delegate
shall, in a satisfactory manner as determined by
the Grantee, perform all activities in Attachment
"A„
2. COMPLIANCE WITH APPROVED PRO -
GRA14I. All activities authorized by this agree-
ment will be performed in accordance with the
approved work program, the approved budget,
the grant conditions and relevant OEO directives.
3, REPORTS, RECORDS & EVALUATIONS.
The Grantee shall supervise, evaluate, and pro-
vide guidance and direction to the Delegate in the
conduct of activities delegated under this con-
tract. The Delegate agrees to submit to the
Grantee such reports as may be required by OEO
directives or by the Grantee, including the re-
ports listed in Attachment "B” according to the
schedule there set out.
The Delegate also agrees to prepare and retain,
and permit the Grantee to insp:ct as it deems
necessary for grant purposes (in addition td in-
spections authorized by the conditions i» the grant
from OEO) the records listed in Attachment "C ",
as well as all other records that may be required
by relevant OEO directives, with the exception
Of confidential client information. The Delegate
further agrees that the Grantee may carry out
monitoring and evaluation activities to include,
at a minimum, those listed in Attachment "D ",

and wills ectively ensure the cooperation of the

7. SCHEDULE OF PAYMENT. Subject to re-
ceipt of funds from OEO, the Grantee agrees to
reimburse the Delegate for authorized expendi-
tures. An advance of $.) 111000 , for estimated
expenditures for ...1.... , (months) will be
made to the Delegate, who will submit to the
Grantee vouchers that are sufficient to support
payment under the Grantee's accounting proce-
dures established or approved by the Grantee's
accountant. Within 9Q days the Grantee
will approve or disapprove payment of the vouch-
ers, and will make additional payments equal to
the amount of such approved expenditures to the
Delegate. In no event, however, will the Delegate
receive reimbursement for personnel costs ex-
ceeding $..52,665 or for non -

8. TERMINATION. The Grantee may, by giv-
ing reasonable written notice specifying the ef-
fective date, terminate this contract in whole or
in part for cause, which shall include: (1) failure,
for any reason, of the Delegate to fulfill in a
timely and proper manner its obligations under
this contract, including compliance with the ap-
proved program and attached conditions, with
statutes and Executive Orders, and with such

cable at ally time; (2) submission by the Dele-
gate to OP or to the Grantee of reports that are
incorrect q' incomplete in any material respect;
(S) ineff c ive or improper use of funds provided
under this , contract; and (4) suspension or ter-
mination . ' OEO of 'the grant to the Grantee
under whi4 this contract is made, or the portion
thereof d egated by this contract. The Grantee
may also i 'assign and transfer this contract to
another g, ntee when required to do so by OHO
direction.
If the •blegate is unable or unwilling to com-
ply with uch additional conditions as may be
lawfully pplied by OEO to the grant to the
Grantee, lie Delegate shall terminate the contract
by giving easonable written notice to the Grantee,
signifyinglthe effective date thereof. In such
event the grantee may require the delegate to
ensure that adequate arrangements have been
made for the transfer of the delegated activities
to another Delegate or to the Grantee.
In the event of any termination, all property
and finished or unfinished, documents, data,
studies, and reports purchased or prepared by
the Delegate under this contract shall be disposed
of according to OEO directives, and the Delegate
shall be entitled to compensation for any un-

reimbursed expenses reasonably and necessaeh,
incurred in satisfactory performance of the con-
tract. Notwithstanding the above, the Delegate
shall not be relieved of liability to the Grantee
for damages sustained by the Grantee by virtue
of any breach of the contract by the Delegate
and the Grantee may withhold any reimburse-
ment to the Delegate for the purpose of set-off
until Ouch time as the exact amount of damages
due the Grantee from the Delegate is agreed upon
or otherwise determined.
9. NON - FEDERAL SHARE. The Delegate
will contribute $J�,$96.. to the program funds.
Such contribution shall be in cash in the amount
of 1:..: �' ..., and in -kind in the amount 'of

10. REVIEW OF NEW DIRECTIVES. The
Grantee will submit promptly to the Delegate for
comment those proposed additional directives
that it receives from OEO for comment.
