HomeMy WebLinkAbout09467 ORD - 08/27/1969BJW:8/27/69 TEXAS:- AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN AMENDMENT TO THE ELECTRIC SERVICE CONTRACT WITH CENTRAL POWER AND LIGHT COMPANY, AUTHORIZED BY ORDI- NANCE NO. 9219, SO AS TO PROVIDE FOR THE RATE OF 1.10t " PER KWH FOR MAINTENANCE AND OPERATION OF 100 WATT OBSTRUCTION LIGHTS, AS AS MORE FULLY SET FORTH IN THE AMENDMENT TO SAID ELECTRIC SERVICE CONTRACT, A COPY OF WHICH AMENDED OR SUPPLEMENTAL AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL bF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A SUPPLEMENTAL AGREEMENT WITH CENTRAL POWER AND LIGHT COMPANY, SUPPLEMENT- ING THE AGREEMENT AUTHORIZED BY ORDINANCE No. 9219, PASSED AND APPROVED BY THE CITY COUNCIL ON JANUARY 29, 1969, CONCERNING TRAFFIC SIGNAL AND FREEWAY SIGN LIGHTING, A COPY OF SAID SUPPLEMENTAL AGREEMENT BEING ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO EXECUTE THE AFORESAID AGREEMENT AS PROMPTLY AS POSSIBLE IN ORDER TO EFFECTUATE THE TERMS THEREOF CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE �L-_ DAY OF AUGUST, 1969: ATTEST: CI Y SECRETARY YOR THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: Q % DAY OF AUGUST, 1969: CITY A't<TOhNEY O 9467 PROJECT 9 AMENDMENT TO TRAFFIC SIGNAL AND FREEWAY SIGN LIGHTING CONTRACT NUMBER 6538 OF JANUARY 20, 1969 This supplemental agreement shall constitute an amendment to that certain "TRAFFIC SIGNAL AND FREEWAY SIGN LIGHTING CONTRACT NUMBER 6538" (hereinafter referred to as the "Contract ") entered into and executed as of the 20th day of January, 1969 between and by the City of Corpus Christi (hereinafter referred to as the "City ") and the Central Power and Light Company (hereinafter referred to as the "Company "); _W I T N E S S E T H WHEREAS, the City is responsible for the operation and maintenance of a Free- way Lighting System in the City of Corpus Christi on State Highway 358 for the State Highway 358 Interchange with connections along State Highway 286 (relocated) to the south end of the Gollihar Street Interchange; which system is shown on the drawing marked Exhibit "A" attached hereto and made a part hereof, and which system shall, for the purpose of the contract as amended, be known as Project No. 9, which Project No. 9 includes sixteen (16) all being 100 Watt obstruction lights mounted four (4) to the pole on four (4) one hundred and fifty foot (150 ft) steel poles, and; WHEREAS, the Company agrees to provide electric service to the above describ- ed 100 Watt obstruction light at an existing agreed rate of I.lt per KWH and to maintain the 100 Watt lamps, which can be lowered to base of pole, at' actual replacement cost which will be considered as above normal maintenance cost. NOW, THEREFORE, this supplemental agreement shall become an amendment to the contract and the included part of Project No. 9 shall from the date hereof be operated under said agreement as though originally included as a part thereof but the contract as amended should not be otherwise affected hereby. IN TESTIMONY WHEREOF, the Central'Power and Light Company has caused these presents to be signed in its name by its authorized officer, and to be attested by its Secretary, and the City has caused these presents to be signed by the City Manager of the City of Corpus Christi and attested by its City Secretary as of the _ day of , 196 ATTEST: 7: -` ATTEST: City Secretary APPROVED AS TO LEGAL FORM THIS _DAY OF , 196 City Attorney CENTRAL POWER AND LIGHT COMPANY BY Vice President CITY OF CORPUS CHRISTI BY Corpus Christi, Texas day of v , 19Qf TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass.this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
