AN ORDINANCE
RELEASING A PORTION OF THE UTILITY EASEMENT RESERVED
IN ORDINANCE 9455 ON THE OCCASION OF THE CLOSING OF A
PORTION OF 18TH STREET EXTENDING SOUTHWARD FROM THE
RIGHT OF WAY OF MORGAN STREET SO AS TO REDUCE SAID
UTILITY EASEMENT TO A WIDTH OF TWENTY -FIVE (25) FEET
ALONG THE WESTERN SIDE AND WITHIN THE FORMER RIGHT OF
WAY OF SAID 18TH STREET; AND DECLARING AN EMERGENCY.
WHEREAS, THE PROPERTY OWNER ABUTTING THAT PORTION OF 18TH
STREET ORDERED CLOSED BY ORDINANCE 9455 ARE DESIROUS OF UTILIZING A
PORTION OF SAID FORMER RIGHT OF WAY AND HAVE OFFERED TO RELOCATE THE
CITY UTILITY LINES NOW LOCATED IN SAID FORMER RIGHT OF WAY, AT THE
EXPENSE OF SAID PROPERTY OWNER, TO THE EFFECT THAT SAID UTILITY
EASEMENT SHALL BE REDUCED TO A WIDTH OF TWENTY -FIVE (25) FEET, LOCATED
ON THE WESTERN PORTION OF SAID FORMER 18TH STREET RIGHT OF WAY; AND
WHEREAS, SUCH OFFER IS AGREEABLE TO THE CITY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THAT PORTION OF THE UTILITY EASEMENT WHICH
WAS FORMERLY THE RIGHT OF WAY OF 18TH STREET, SOUTH OF THE RIGHT OF WAY
LINE OF MORGAN STREET, WHICH PORTION OF 18TH STREET WAS HERETOFORE
CLOSED BY ORDINANCE 9455, IS HEREBY REDUCED TO A WIDTH OF TWENTY -FIVE
(25) FEET ON THE WESTERN PORTION OF SAID FORMER RIGHT OF WAY OF 18TH
STREET, ON THE CONDITION THAT THE ABUTTING PROPERTY OWNER RELOCATE THE
EXISTING UTILITY LINES NOW IN THE EASTERN PORTION OF SAID FORMER 18TH
STREET RIGHT OF WAY AT THE EXPENSE OF SAID PROPERTY OWNER, OR BY REIM-
BURSING THE CITY FOR THE COST TO THE CITY OF THE RELOCATION OF SAID

UTILITY LINES, AND UPON THE COMPLETION OF SAID RELOCATION, THIS ORDINANCE
SHALL BECOME EFFECTIVE AND.A PROPER QUITCLAIM DEED PERTAINING TO THE
EASTERN PORTION OF THE FORMER 18TH STREET RIGHT OF WAY RESERVED AS A
UTILITY EASEMENT IN ORDINANCE 9455 SHALL BE EXECUTED BY THE CITY MANAGER
AND DELIVERED TO THE PROPERTY OWNER.

SECTION 2. THE FACT THAT THE PROPERTY OWNER IS PREPARED TO
IMMEDIATELY TAKE STEPS TO IMPROVE SAID PROPERTY ABUTTING THE FORMER
18TH STREET RIGHT OF WAY AND THE EASTERN PORTION OF SAID 18TH STREET
RIGHT OF WAY AND THAT IT IS TO THE INTEREST OF THE PUBLIC TO ASSIST IN
PERMITTING THE PROMPT COMMENCEMENT OF SAID IMPROVEMENT, CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUS-
PENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO
EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT
THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF SEPTEMBER, ig6g.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
