FA66SW -17020 BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES OF AMERICA CONCERNING REMOTE TRANSMITTER SITE #2 & RR SITE AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, ALL AS MORE FULLY DESCRIBED IN THE SUPPLEMENTAL AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, SUPPLEMENTAL AGREEMENT No. 1 TO LICENSE No. FA66SW -17020 BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES OF AMERICA CONCERNING REMOTE TRANSMITTER SITE 12 AND RR SITE AT THE CORPUS CHRISTI INTERNATIONAL AIRPORT, ALL AS MORE FULLY DESCRIBED IN THE SUPPLEMENTAL AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO IMMEDIATELY EXECUTE THE AFORESAID AGREEMENT IN ORDER TO REDUCE TO WRITING THE FUNDING RESPONSIBILITY FOR LOCA- TION, REPLACEMENT, OR MODIFICATION OF ANY CLASS I AND 11 FACILITIES BY THE CITY, THE GOVERNMENT, OR OTHER PARTIES, CREATES A PUBLIC EMERGENCY AND IMPERA- TIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUC- TION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUC- TION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /77<./ DAY OF SEPTEMBER, 1969. ATTEST: -4/Y -CITY' SECR TARP THE CITY OF- CORPUS CHRISTI, TEXAS APPROVED: 16 DAY OF SEPTEMBER, 1969: CITY ATTORNEY i m i` 4 DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION SOUTHWEST REGION POST OFFICE BOX 1689 FORT WORTH, TEXAS 76101 License No. FA66SW -4020 Remote Transmitter Site #2 & RRSite Corpus Christi International Airport Corpus Christi, Texas SUPPLEMENTAL AGREEMENT NO. 1 THIS SUPPLEMENTAL AGREEMENT, made and entered into as of the 28th day of August 1969, by and between the UNITED STATES OF AMERICA, hereinafter called the LICENSEE, represented by the Contracting Officer executing this agree- ment, and the City of Corpus Christi, Corpus Christi International Airpor, whose address is Route 2, Box 902, Corpus Christi, Texas 78408, hereinafter called LICENSOR, WITNESSETH, That: WHEREAS, On the 21st day of July 1966, the parties hereto entered into License No. FA66SW -4020, covering the installation of Air Navigation facilities on said airport and as more particularly described in said license; and WHEREAS, On the 10th day of February 1969, a new administrative directive was issued requiring that all instruments covering Class I and II facilities be amended to include a paragraph citing clearly the funding responsibility for relocation, replacement, or modification of any such facilities by the ... Licensor, the Government, or other parties; and WHEREAS, the parties hereunto find it will be to their mutual benefit and advantage to amend said license; NOW, THEREFORE, the said license is hereby amended e }1gg�a elo Page 2 of 3 License No. FA66SW -4020 Remote Transmitter Site #2& RR Site Corpus Christi International Airport Corpus Christi, Texas i I in the following particulars only, viz: 1. TO ADD: Paragraph i2 , to the license as follows: 12. FUNDING RESPONSIBILITY CLASS I - II FACILITIES The airport owner agrees that any relocation, or replacement, or modification of any Federal Aviation Administration Class I or II facility, or components thereof, as defined below, covered by this contract during its term or any renewal thereof made necessary by airport improvements or changes which impair or interrupt the technical and /or operational character- istics of the facilities will be at the expense of the airport owner; except, when such improvements or changes are made at the specific request of the Government. In the event such relocations, replacements, or modifications are necessitated due to causes not attributable to either the airport owner or the Government, funding responsibility shall be determined by the Government. By (Corporate Seal) sW Form 4423 -4 (6/69) Corpus Christi, T as + - �ay of 1969 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass.this ordi- nance finally on the date it is introduced, or at the present'meeting of the City Council.
