An ordinance creating the Electrical Advisory Board; setting
forth the qualifications and -rules and regulations pertaining to its
licensing and operation of the Board; setting forth the powers and duties of
the Board; providing a penalty; providing a severance clause, repealing all
ordinances in conflict herewith; providing for publication; °AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. This ordinance shall be known as "The Electrical
Licensing Ordinance."
CHAPTER.1 - ELECTRICAL ADVISORY BOARD
,Section 1 -1: ELECTRICAL ADVISORY BOARD CREATED: There is here-
by created the Electrical Advisory Board (hereafter called "Board ") consisting
of seven (7) persons who shall be appointed by the City Council. This Board
shall have the guidance and assistance of the Building Official and the Chief
Electrical Inspector.
Section 1 -2: QUALIFICATIONS: Persons who serve on the Electri-
-c:al Advisory Board as members shall be qualified as follows:
(a) Two persons, each of whom shall have had at least five
years active experience as a Master Electrician.
(b) One person who shall have had at least five years active
experience as a Journeyman Electrician.
(c) Two persons each of whom shall be registered Professional
Engineers in the State of Texas actively engaged in electrical work as an
Electrical Engineer.
(d) One person who shall have had at least five (5) years
experience in the Commercial Building Industry.
(e) One person who shall have had five (5) years experience
in the Home Building Industry.
Section 1 -3: TENURE OF OFFICE: Four members of the Electrical
Advisory Board shall be appointed for the balance of the calendar year follow=
ing the date of adoption of this ordinance plus one full year. Three members
shall be appointed for the balance of this calendar year following the date
of adoption of this ordinance plus two full years. After the expiration of
the terms of the first appointees, all terms shall be for a term of two years.
The terms of all members shall continue until their successor is appointed.
Any member of the Board may be removed by the City Council for cause. Vacan-

cies within the Board shall be filled by appointment for the unexpired term.
Section 1 -4: REGULAR AND CALLED MEETINGS: The Board shall
hold one regular meeting per month and such special or called meetings as
are necessary for its proper performance of duty.
Section 1 -5: POWERS AND DUTIES: The Board shall at its
first meeting in each calendar year select a Chairman and a Vice - Chairman
and prescribe a procedure and order of business for hearing applications
for licenses and for hearing matters brought to it by the Chief Electrical
Inspector or on appeal and aggrievement appeals as provided herein, and for
general business sessions.
(a) It shall be the duty of said Board to pass upon the
qualifications "of all applicants for licenses. Any person who shall make
application for an Electrical License may obtain proper forms from the
Building Division. Upon receipt by the Building Official or his authorized
representative of an application accompanied by proper fee, an examination
shall be scheduled for the first Monday of the month following the receipt
of the application. If the first Monday of the month falls on a holiday,

a holiday. Upon request of any applicant for license as Journeyman Electrician
BY EXAMINATION, THE EXAMINATION SHALL BE SET FOR SOME DATE WITHIN SEVEN
(7) DAYS FROM DATE OF THE APPLICATION."
(b) Recognition of licenses from other cities: An Electri-
cian holding a current valid license in another city may apply for and
receive a similar license in the City of Corpus Christi without taking an
examination provided the following conditions are complied with,:
1. The applicant shall show that the current valid
license referred to above was issued by a City
having a licensing ordinance adopted in accordance
with the National Electric Code, and which is being
enforced.
2. The Electrician shall submit evidence he has
passed an Electrical Licensing Examination based or.
the National Electric Code from such a City as in
condition 1.
3. The Electrician receiving a license under this
provision must 4*A*MkA%M pay license fee and
comply with all other requirements under this
ordinance.

4. Where the Licensing Ordinance of another City has been
examined and the licensing procedure approved by the Board
under sub - paragraph (1) above, the Building Official or his
assistant may issue to the applicant an electrical license.

(c) After completion of the examination, if the examination
was not under (b) above, the papers will be graded and the result announced
to the applicant immediately. Upon confirmation of the fact that the
applicant made 70% or more on the examination and that he has given satis-
factory references, posted satisfactory bond and paid the required fees,.
the Board shall authorize the issuance of a license. In the event inquiries
of the applicant's references and investigation of past experience record
does not result in satisfying the Board as to the qualifications of the
applicant, a satisfactory explanation and further references may be required
of the applicant. Upon failure to obtain the approval of the Board by the
furnishing of satisfactory references and satisfactory explanation of any
items in past experience record, or upon failure to make a grade of 70% or
more on the examination as graded by the Board, the Board shall deny the
license and notify the applicant accordingly.
(d) For examinations, the Board shall prepare 10 or more
sets of examinations for each class of license of electricians required to
be examined under this ordinance. -The sets of examinations may be changed
by the Board ac any time when no applications for examinations are pending.
When an application for examination has been filed, a set of examination
questions for the proper class of license shall be selected at random from
the several sets of examination questions and submitted to the applicant for
the examination.
(e) The examination for a Master Electrician's License will
be given in two parts - Part I, Questions, and Part II, Plans. Each of these
two parts will be graded on a basis,of 100% each. The applicant must make a
grade of at least 70% on each part in order to qualify for a Master's
License. The applicant will be given his questions and the examination will
be graded at the earliest convenience of the Board. Only if the applicant
makes 70% or more on Part I, will he be allowed to take Part H. Part II
may be taken any following Monday of the same month. If the applicant fails
to make at least 70% on Part II he may, at his request, take an Alternate
Part H. This Alternate Part II must be taken and passed within 90 days from
the date he failed the first Part II. If the applicant does not make at
least 70% on the Alternate Part II, he will be required to wait 90 days from
the time he failed the Alternate Part II before he can take the examination
for Master Electrician again. At that time he will be required to begin again
and take Part I, and he will be required to again follow the procedure out-

lined above as for the first taking of the examination. All other examina-
tions shall be in one part.
(f) Any applicant who has failed three examinations may
appeal the Board's failure to license him to the City Manager, who will
appoint a Special Board for the purpose of considering whether such applicant
should be licensed. This Special Board shall consist of a Licensed Master
Electrician, an Electrical Engineer, registered to practice in the State of
Texas, and a Mechanical Engineer, registered to practice in the State of
Texas. The Special Board may, in considering an appeal, review the examina-
tions previously administered by.the regular Board or, at its option, prepare,
administer and grade a special examination. The action of this Special Board
shall be reported to the City Manager with a recommendation based on their
investigations, and the action of the City Manager will constitute final
action on the appeal. .
(g) In the event the references or the past experience record
of the applicant is unsatisfactory to the Board, and the Board fails to
license him on that account, the applicant shall have the right to appeal to
the Gity Manager for the appointment of a Special Board having the same
qualifications as the Special Board used in case of failure of the examina-
tion and said Special Board shall make an independent inquiry of references
and an independent investigation of past experience record and make its
report and recommendation to the City Manager, and the action of the City
Manager will constitute final action on the appeal.
(h) It shall be the duty of the Board to conduct reviews of
grievances, make investigations and render decisions in keeping with their
findings.
Section 1 -6: QUORUM: Four (4) members of the Board present
a`t any meeting shall constitute a quorum for the transaction of business and
the concurring vote of not less than four (4) members of the Board shall be
necessary to constitute an official action of the Board.
Section 1 -7: RECORDS: The Board shall keep a Minute Book in
which shall be recorded all transactions and business of the Board.
The Board shall keep a record of the name and place of busi-
ness bf all persons to whom licenses have been issued; provided that said
Board shall not be responsible for the record of any person whose license
has not been renewed or has lapsed for a period in excess of 24 months.
Section 1 -8: CONDUCTING EXAMINATIONS: At each time of examina-
tion, the Board shall use one of the prepared sets which shall be of a
uniform language; fair, and impartial in nature; covering each classifica-
tion of license involved, and testing the knowledge and skill of each appli-
cant to do electrical work involving the installation, alteration, repair
and maintenance of electrical conductors and equipment.
(a) Examinations shall be conducted in the manner and
sequence prescribed by the Board relative to each classification as specified
in Chapter 2 of this ordinance.
(b) The Board shall examine each applicant pertaining to the
competency of the applicant.
(c) Examinations shall be graded at the earliest convenience
of the Board.
(d) All applicants examined by the Board shall be graded on
the basis set out by the minutes of the Board.
(e) The Board shall be diligent and tolerant in aiding and
assisting all applicants by enlightening them concerning the rules prescribed
by the Board for examination. Mimeographed sheets of the requirements as
established by the Board for examination in each classification of electrical
license shall be issued by the Chief Electrical Inspector to each applicant
upon his request for examination.
Section 1 -9: SUSPENSION OR REVOCATION OF RIGHTS: (a) The
Board shall have the power to suspend or revoke the license of any electri-
cian who is found guilty of:
(1) The practice of any fraud or deceit in obtaining such
license.
(2) Taking out electrical permits in the name of some person,
firm, or corporation authorized by law to do electrical work and thereafter
permitting a person without a proper license to do the work.
(3) Any gross negligence, incompetency, or misconduct in
the performance of electrical work within the jurisdiction of the City under
this ordinance or the Corpus Christi Electrical Code.
(b) In determining any such charges, the Board shall proceed
upon sworn information furnished it by an official of the City, or by some
person aggrieved by the action of an electrician in the performance of
electrical work for which an electrical permit is required by the Corpus
Christi Electrical Code. Such information shall be in writing and shall be
duly verified by the person familiar with the facts therein charged. The
Board, if it deems the information sufficient to support further action on
its part, shall make an order setting the charges therein contained for
hearing at a specified time and place, and the Secretary of the Board, with
the advice of the City Attorney, shall cause a copy of the Board's order
and of the information to be served upon the accused by registered mail at
least thirty(30) days before the date appointed in the order for the hearing.
The accused may appear in person or by counsel, or both, at the time and
place named in the order and make his defense to the same. The City Attorney
shall provide counsel for the Board. If the accused fails or refuses to
appear, the Board may proceed to hear and determine the charge in his
absence. If the accused pleads guilty, or if, upon a hearing of the charge,
the Board shall find any of the charges to be true, it may enter an order
suspending or revoking the license of such electrician. The Board shall
have the power, through its chairman or secretary, to administer oaths and
to compel the attendance of witnesses before it by subpoena issued over the
signature of the Secretary and Seal of the Board.
(c) When the Board has completed such hearing, it shall
cause a record of its tinding and decision to be filed with the City Secre-
tary and shall cause a certified copy thereof to be forwarded to the accused.
(d) It shall be unlawful for any person, firm or corporation
whose rights under a license have been suspended or revoked by the Board to
engage in or do electrical work for which a permit is required by the Corpus
Christi Electrical Code.
(e) The Board shall in reciting its decision (subparagraph
(c) above) make provision for reinstatement based upon written notice by the
Board at the expiration of a specified period, or by the suspended person
satisfactorily passing an examination given for the same grade of electrician
from which he was suspended. Such order of reinstatement shall be filed as
a part of the record and a copy shall be made and given or mailed to the
person so reinstated.
CHAPTER 2 - QUALIFICATION AND LICENSING OF ELECTRICIANS
Section 2 -1: LICENSE REQUIRED: It shall be unlawful for any
person to engage in the business of installing, maintaining, altering or
repairing of any wiring, fixtures or equipment used for the conducting of
electricity for which a permit is required by the Corpus Christi Electrical
Code, nor shall any person, firm or corporation in any manner undertake to
execute such work unless such person, firm or corporation is holder of a
license as required herein, except as provided in Section 2 -14 of this
Chapter.
(a) Every electrical contractor must have a current license
as a Master Electrician. Every Master Electrician must have and maintain
an established place of business and shall have a telephone and a person in
attendance to receive messages from the Electrical Inspection Section of
Ae City or other persons concerned during regular business hours.
(b) All Master Electricians engaged in the installation or
repair of electrical wiring shall have his firm name conspicuously displayed
on all trucks used by his firm in the transaction of his business.
(c) It shall be unlawful for any person to falsely represent
himself as a Licensed Electrician of any class set forth in this ordinance
or to use the words Electrical Contractor, Master Electrician, Electrician,
or words of similar import or meaning, on signs, cards, stationery, or by
any other manner whatsoever, unless said person is properly licensed within
the meaning of the word used as provided in this ordinance.
Section 2 -2: CLASSIFICATION OF LICENSES: There shall be

1. Master Electrician; 2. Master Electrician -Sign; 3.
Master Electrician - Elevator; 4. Journeyman Electrician; 5. Limited
Journeyman Electrician; 6. Maintenance Electrician; 7. Apprentice Electri-
cian.
Section 2 -3: METHOD OF LICENSING: To secure a license as a
qualified and competent electrician in any of the classes set out in Section
2 -2, an application shall be made in writing and addressed to the Board.
The application shall show the applicant's name and address, and such other
information as may be prescribed by the Board, and shall be made out on
forms available in the office of the Chief Electrical Inspector.
(a) In addition to submitting a properly executed applica-
tion, the applicant, if of contractual status under classification of
licenses 1, 2, or 3, Section 2 -2 above, shall file with the application an
affidavit setting forth the name of the person who is the owner of the busi-
ness, the address of the place of business; or if the business is a firm,
partnership or corporation, the names of officers who own or operate the
business, their addresses, the address of the business, and the name and
address of the person who shall be responsible for the conduct and in
charge of the business for all work done. The applicant shall further state
the method of supervision of work to be contracted by the firm and the name
of the Licensed Electrician who is legally proficient as specified in this
ordinance who shall be responsible for the actual installation, repair, and/
or maintenance of electrical conductors and equipment which is to be carried
on by the person, firm or corporation.
(b) Master Electrician: Applicants for a license as Master
Electrician shall file with the application an affidavit setting forth that
such applicant is not less than twenty -one (21) years of age and has had not
less than five (5) years experience in the installation, alteration, and
repair of electrical equipment and conductors, or equally qualifying exper-
ience for at least five (5) years.
(c) Master Electrician -Sign or Elevator: If the applicant
desires to do work in electrical elevator or electrical sign installation,
repair, and /or maintenance, he shall pass a special examination on the same
basis as that given to a Master Electrician, but with diagrams and a set of
questions applicable to his particular classification.
Applicant shall be examined as provided in Chapters 1 and 2.
A certificate of graduation from, or an affidavit of attendance at a recog-
nized technical school or college shall be credited year for year not
exceeding three (3) years as part of the required five (5) years experience.
(d) Journeyman Electrician: Applicants for registration as
Journeyman Electrician shall file with the application an affidavit setting
forth that he is not less than eighteen (18) years of age and that he has
had not less than four years experience as an electrician's helper or
apprentice electrician.
1. Applicant shall be examined as provided in Chapter 1.
Applicant shall make in his application affidavit a statement that he will
engage only in the employ of any person registered under the first three
(3) classifications under the provisions of this ordinance, and shall per-
form all installation, alteration and repair of electrical wiring, fixtures
and equipment in accordance with the Corpus Christi Electrical Code, and
that he will not independently engage in the business of contracting such
electrical work.
(e) Limited Journeyman Electrician: Applicants for
license as Limited Journeyman Electrician shall file with the application
an affidavit setting forth that he is not less than eighteen (18) years of
age and that he has had not less than two years experience as an electri-
cian's helper or apprentice electrician.
Applicant shall make in his application affidavit a state-
ment that he will engage only in the employ of or under the supervision of
a Master Electrician (Sign) or a Master Electrician (Elevator); and that
he shall perform all installation, alteration and repair of equipment in
accordance with the Corpus Christi Electrical Code and that he will not
independently engage in the business of contracting such electrical work.
(f) Maintenance Electrician: Applicants for registration
as Maintenance Electrician shall file with the application an affidavit
setting forth that he is not less than twenty -one (21) years of age and has
had not less than two (2) years experience in building electrical mainten-
ance under a person who was a licensed electrician; or has held at least a
Journeyman Electrician's license for a continuous period of not less than
twelve (12) months.
(1) Applicant shall file with his application a letter
bearing the signature of the person by whom he is regularly employed and
the address of the place of employment, or shall state that he intends to
do work under this classification and will furnish the Chief Electrical
Inspector with the letter described above when so employed and will notify
the Chief Electrical Inspector of each such change of employment during the
life of his license.
(2) Applicant shall pass an examination equivalent to and
on the same basis of a Journeyman Electrician as provided herein.
(g) Apprentice Electrician: Applications filed for a
license as Apprentice Electrician shall state the age of the applicant and
the intent that he is engaging in the learning of and assisting in the
installation, maintenance, or repair of electrical wiring, fixtures and
equipment working directly under the supervision of a person holding a
license of any of the foregoing classifications; or that he is enrolled in
a certified trade school pursuing a -iourse in the electrical trades.
Section 2 -4: GENERAL: In the actual work of installing,
maintaining, altering or repairing any electric conductors or equipment
for which a permit is required by ordinance, there shall be present and in
direct supervision a qualified electrician of the proper classification.
It shall be required that an electrician of the license classification of
the first three grades as listed in Section 2 -2 above, be liable and respon-
sible for layout and technical supervision of any work which has required
the securing of permits, and a journeyman or higher classified grade electr,
cian shall be in direct "on the job" supervision of work carried on as
specified herein; except in work falling under the classifications of sign
or elevator work which work shall be performed by or directly supervised by
the person holding such license or a journeyman particularly qualified in
such branch of electrical work. Should it come to the notice of the Building
Official or his assistant that such supervision and control are not being
maintained, in addition to filing of complaint in the Corporation Court for
such violation of this ordinance, the inspector may order the work to be
discontinued and the person, firm or corporation to whom the permit has been
issued shall discontinue further work until approval by the Electrical
Inspector that proper supervision has been employed or supplied; provided
further that nothing herein shall be construed as prohibiting the employment
of apprentices assisting a person duly licensed and qualified under the pro-
visions of this ordinance. Provided further that no more than one (1)
Apprentice is employed for each duly licensed Master or Journeyman Electri-
cian on any one electrical installation.
Section 2 -5: FEES FOR EXAMuvA ION On LICENSE: the fees
covering examination for a license to qualified electricians of all classes
shall be payable to the City of Corpus Christi at the Building Division as
set out in Table I in Subsection (c) of this section. The examination fee
shall accompany the application for license. The license fee shall be paid
to the Building Division before the issuance of a license and only after the
person has been approved-by the Board.
•(a) Annual renewal of licenses shall be accomplished by
issuance of a license signed by the Building Official or his assistant
issued upon payment each calendar year extending the validity of a license
for that calendar year only.
(b) Such renewals shall be in compliance with regulations of
'Section 2 -8 herein.

Section 2 -7: LICENSES: A license shall be prepared and used
by the Board in the licensing of each classification of electricians listed
in Section 2 -2.
(a) The license as issued shall bear the signature of the'
Chairman of the Board and the signature of the Chief Electrical Inspector,
and be issued only after the applicant or licensee has paid to the City the
required annual license renewal fee for his classification as set forth in
Section 2 -5 (cj, Table I, herein.
(b) A license shall expire December 31 of each year, and
unless renewed, the holder shall be deemed unlicensed under the provisions
of this ordinance; provided, however, that reinstatement and renewal can be
done by payment of the annual fee within six (6) months, or, where the
license holder has secured the license by examination, by payment of twice
the annual fee within two (2) years of the date of expiration. Failure to
secure reinstatement and renewal within two (2) years from the expiration
date shall require a new application and.examination as in the first
instance.
(c) Should the holder of a license take up another occu-
pation or otherwise indicate that he has abandoned his occupation as classi-
fied in Chapter 2 of this ordinance, even though he may apply for a license
each year, he shall be examined every two (2) years to maintain his license.
Section 2 -8: LOST OR DESTROYED: Licenses lost or destroyed
during the yeai for which they are issued shall be reissued by the Chief
Electrical Inspector; provided satisfactory evidence has been presented by
the licensee of such loss or destruction, and provided the licensee pay to
the City at the Chief Inspector's Office the sum of one dollar ($1.00) for
each such duplicate license.
Section 2 -9: TERMINATION OF LICENSE. NO REFUND: Refunds
shall never be given for the unexpired portion of the annual license period.
Section 2 -10: LICENSE NOT TRANSFERABLE: It shall be unlawful
for any person to lend, rent or transfer his license, his badge or any rights
to any other person, and for any person to make use of any such rights which
are not actually his own.
Section 2 -11: ALTERING OR AMENDING LICENSE: It shall be
unlawful for any person other than the Chief Electrical Inspector at the
direction of the Board to alter or amend in any manner any license as set
forth herein.
Section 2 -12: DISPLAY OR EVIDENCE OF LICENSE: It shall be
required that all electricians fittingly display their licenses as provided
herein.
(a) Every holder of a license as a Master Electrician, Master Electrician-
Sign or Master Electrician - Elevator shall display his license in a conspicuous
place in his principle place of business.
(b) Every holder of a license shall carry his license or
approved substitute therefor on his person at all times while doing electrical
work and shall produce and exhibit it when requested by any Electrical
Inspector or official of the City.

Section 2 -14: EXCEPTIONS FROM LICENSE REQUIREMENTS: The
following classes of work may be carried out by persons who are not licensed
electricians.
(a) The replacement of lamps or fuses, and the connection of
portable devices to suitable receptacles which receptacles have been perman-
ently installed.
(b) The installation, alteration or repairing of any wiring
devices or equipment in accordance with Article 720 and Article 725 of the
National Electrical Code, 1968 Edition.
.(c) The installation, alteration or repair of electric
wiring, devices, appliances and equipment installed by or for an electrical
public service corporation, including Cable Television, operating under a
franchise from the City when for the use of such corporation in the genera-
tion, transmission, distribution or metering of the electrical energy, or
for the use of such a corporation in the operation of street railways
signals or the transmission of intelligences as specified in Chapter 1 of
the Corpus Christi Electrical Code.
CHAPTER 3 - PENALTIES
Section 3 -1: PENALTY FOR VIOLATION: Any person, firm,
corporation or association who violates any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon conviction there-
of, shall be punished by a fine of not more than two hundred ($200.00)
dollars, and each and every day of continuance thereof shall constitute a
distinct and separate offense.
Section 3 -2: INJUNCTION: In addition to the penal remedy
herein, the City Attorney shall, upon direction by the City Manager, in-
stitute any appropriate action or proceeding, including actions for injunc-
tion to prevent, restrain, correct or abate any act, conduct, work, business,
practice or use which is a violation of and illegal under this ordinance.
SECTION 2: VALIDITY CLAUSE: If for any reason, any section,
paragraph, subdivision, clause, phrase or provision of this ordinance shall
be held invalid, it shall not affect any valid provisions of this or any
other Ordinance or Code of this City of Corpus Christi to which these rules
and regulations regulate.

SECTION 3. REPEAL OF CONFLICTING ORDINANCES: All Ordinances
or Codes, or parts of Ordinances or Codes of the City of Corpus Christi
in conflict herewith shall as to such conflict be controlled by this
Ordinance.
SECTION 4. Publication shall be made one time in the official
publication of the City of Corpus Christi, which publication shall contain
the caption stating in substance the purpose of the ordinance.
SECTION 5.. THE NECESSITY TO ADOPTITHE'HEREINABOVE DESCRIBED
PROVISIONS AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE'OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT
SUCH PUBLIC EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass.this ordi-
nance finally on the date it is introduced, or at the presene meeting of the
City Council.
