AN ORDINANCE
APPROVING AND ADOPTING THE WRITTEN STATEMENT AND
REPORT•OF THE DIRECTOR OF PUBLIC WORKS, SHOWING THE
ESTIMATES OF THE TOTAL COSTS OF ALL THE IMPROVEMENTS,
THE ESTIMATES OF THE COST PER FRONT FOOT PROPOSED TO
BE ASSESSED AGAINST THE ABUTTING PROPERTY, AND THE REAL
AND TRUE OWNERS THEREOF, FOR THE CONSTRUCTION OF SIDE-
WALKS ON THE HEREINAFTER NAMED STREETS IN THE CITY OF
CORPUS CHRISTI, TEXAS, TO -WIT:

DETERMINING AND FIXING THE PORTION OF SAID COST AND THE
RATE THEREOF PROPOSED TO BE ASSESSED AGAINST AND PAID BY
THE ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF;
DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST
SAID ABUTTING PROPERTY, AND THE REAL AND TRUE OWNERS
THEREOF, FOR THE PORTION OF SAID COST APPORTIONED TO THEM;
ORDERING AND SETTING A HEARING AT 3:00 O'CLOCK P.M., ON THE
/0 tb DAY OF DECEMBER, 1969, IN THE COUNCIL CHAMBER OF THE
CITY HALL OF CORPUS CHRISTI, TEXAS, AS THE TIME AND PLACE
FOR THE HEARING OF THE REAL AND TRUE OWNERS OF SAID ABUTTING
PROPERTY AND ALL OTHERS INTERESTED IN SAID ABUTTING PROPERTY
OR IN ANY OF THE PROCEEDINGS CONCERNING SAID ASSESSMENTS AND
IMPROVEMENTS; DIRECTING THE CITY SECRETARY OF THE CITY OF
CORPUS CHRISTI, TEXAS, TO GIVE NOTICE OF SAID HEARING AS
REQUIRED BY LAW; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, HEREBY FINDS AND DETERMINES:
(A) THAT THE CITY COUNCIL HAS HERETOFORE, BY ORDINANCE, ORDERED
THE CONSTRUCTION OF SIDEWALKS ON THE HEREINAFTER NAMED STREETS IN THE CITY
OF CORPUS CHRISTI, TEXAS, WITHIN THE LIMITS DEFINED:

AND IN THE MANNER AND ACCORDING TO THE PLANS AND SPECIFICATIENS THEREFOR,
WHICH SAID PLANS AND SPECIFICATIONS HAVE BEEN APPROVED AND ADOPTED BY
THE CITY COUNCIL.
(B) THAT A NOTICE DULY ENACTED IN THE NAME OF THE CITY OF CORPUS
CHRISTI, TEXAS, OF THE ENACTMENT OF THE SAID ABOVE DESCRIBED ORDINANCES HAS
HERETOFORE BEEN FILED WITH THE COUNTY CLERK OF NUECES COUNTY, TEXAS, THE
COUNTY IN WHICH THE CITY OF CORPUS CHRISTI IS SITUATED, AND SUCH NOTICE
HAS BEEN DULY RECORDED IN THE DEED OF TRUST RECORDS OF NUECES COUNTY, TEXAS.
(C) THAT THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
HAS CAUSED THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND FILE ESTIMATES OF
THE COSTS OF SUCH IMPROVEMENTS, AND ESTIMATES OF THE AMOUNT PER FRONT FOOT
TO BE ASSESSED AGAINST THE PROPERTY ABUTTING SAID SIDEWALKS; AND THE
DIRECTOR OF PUBLIC WORKS HAS HERETOFORE FILED SAID ESTIMATES AND A STATE-
MENT OF OTHER MATTERS RELATING THERETO WITH SAID CITY COUNCIL, AND THE SAME

HAVING BEEN RECEIVED, EXAMINED AND APPROVED BY SAID CITY COUNCIL; AND1diAT
IN ACCORDANCE WITH SAID STATEMENT OF THE ESTIMATE SO FILED BY THE DIRECTOR
OF PUBLIC WORKS AND HEREIN APPROVED, THE AMOUNT OF SAID ESTIMATED COSTS
ARE HEREIN APPROVED, AND THE AMOUNT OF SAID ESTIMATED COSTS ARE HEREINAFTER
STATED AND SET OUT AND A SCHEDULE CONTAINED IN SECTION Z HEREOF.
SECTION Z. THE WRITTEN STATEMENT AND REPORT OF THE DIRECTOR OF
PUBLIC WORKS HERETOFORE FILED WITH THE CITY COUNCILS SHOWING THE ESTIMATED
TOTAL COSTS OF THE CONSTRUCTION OF SAID SIDEWALKS, SHOWING THE AMOUNTS
PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST THE ABUTTING PROPERTY AND
AGAINST THE REAL AND TRUE OWNERS THEREOF FOR SAID IMPROVEMENTS, SHOWING
TOTAL ESTIMATED COST OF THE CONSTRUCTION OF SAID SIDEWALKS PROPOSED TO
BE ASSESSED AGAINST AND PAID TO THE CITY OF CORPUS CHRISTI BY THE ABUTTING
PROPERTY AND THE REAL AND TRUE OWNERS THEREOF TO REIMBURSE THE SAID CITY
FOR A PORTION OF THE COSTS OF SAID IMPROVEMENTS AND SHOWING THE TOTAL
ESTIMATED COST OF SAID IMPROVEMENTS HAVING BEEN RECEIVED AND EXAMINED BY
THE CITY COUNCIL SAID REPORT AND THE ESTIMATES THEREIN SHOWN ARE HEREBY
IN ALL THINGS APPROVED AND ADOPTED; AND IT IS HEREBY FOUND AND DETERMINED
BY THE SAID CITY COUNCIL THAT THE ESTIMATED COSTS OF SAID IMPROVEMENTS

This project shall be known as Sidewalk Improvements Unit V, and it consists
of the construction of concrete end shell sidewalks within the City. These
walks are proposed to be a, minimum of 4' wide, 4" thick, and where necessary,
5' wide, 4" thick. The locations of the proposed improvements are as follows:
1) Alameda reet, from Hancock to Agnes

The assessment rates have been determined by using the unit bid price on 4'
wide or on 5' wide, 4" thick., reinforced concrete sidewalk, and applying
this bid price to the front footage of the abutting property. The rates are
as follows:

Credits have been issued for existing sidewalks in suitable condition.

SECTION 3. THE COST OF SAID IMPROVEMENTS SHALL BE PAID AS
FOLLOWS TO -WIT:
(A) THE CITY SHALL REIMBURSE ITSELF FOR NOT MORE THAN 80% OF
THE COST OF THE IMPROVEMENTS BY ASSESSMENT AGAINST THE RESPECTIVE ABUTTING
PROPERTIES AND THE REAL AND TRUE OWNERS THEREOF IN ACCORDANCE WITH THE
PROVISIONS OF ARTICLE 11058, VERNON'S TEXAS CIVIL STATUTES. NO ASSESSMENTS
SHALL BE MADE AGAINST ANY ABUTTING PROPERTY OR THE REAL AND TRUE OWNERS
THEREOF FOR COSTS IN EXCESS OF THE BENEFITS TO SUCH PROPERTY IN ENHANCED
VALUE THEREOF BY MEANS OF SUCH IMPROVEMENTS. THE AMOUNTS OF SUCH ASSESS-
MENTS SHALL CONSTITUTE A FIRST AND PRIOR LIEN UPON ALL SUCH PROPERTIES AND
A PERSONAL LIABILITY OF THE REAL AND TRUE OWNERS THEREOF, WHETHER NAMED
OR CORRECTLY NAMED OR NOT. ASSIGNABLE CERTIFICATES IN EVIDENCE OF THE
ASSESSMENTS SO LEVIED SHALL BE ISSUED IN FAVOR OF THE CITY OF CORPUS
CHRISTI FOR THE AMOUNT OF THE ASSESSMENT. SAID PAYMENTS SHALL BE PAYABLE
IN MONTHLY INSTALLMENTS OF NOT EXCEEDING TWENTY -FOUR (24) IN NUMBER, SAID
PAYMENTS TO BE MADE AT THE CITY HALL IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS) THE FIRST OF WHICH SHALL BE PAYABLE WITHIN THIRTY (30) DAYS
FROM THE DATE OF THE COMPLETION OF SAID IMPROVEMENTS AND THEIR ACCEPTANCE
BY THE CITY OF CORPUS CHRISTI, AND ONE INSTALLMENT EACH MONTH THEREAFTER
UNTIL PAID, WITH INTEREST THEREON AT THE RATE OF SIX AND ONE -HALF PERCENT
(6- 1/2,%) PER ANNUM, PAST DUE PRINCIPAL AND INTEREST TO BEAR INTEREST AT
THE SAME RATE. PROVIDED, HOWEVER, THAT THE OWNERS OF ANY OF SAID PROPER-
TIES SHALL HAVE THE PRIVILEGE OF PAYING ALL OR ANY OF SAID INSTALLMENTS
AT ANY TIME BEFORE MATURITY THEREOF BY PAYING THE TOTAL AMOUNT OF PRINCIPAL
OF SUCH INSTALLMENT TOGETHER WITH INTEREST ACCRUED THEREON DOWN TO THE DATE
OF PAYMENT. THE OWNERS OF ANY OF SAID PROPERTY MAY PAY THE TOTAL AMOUNT
ASSESSED AGAINST THEM AND THEIR PROPERTY WITHOUT INTEREST WITHIN THIRTY
(30) DAYS AFTER THE COMPLETION AND ACCEPTANCE OF SAID IMPROVEMENTS. IF
DEFAULT BE MADE IN THE PAYMENT OF ANY OF SAID INSTALLMENTS OF PRINCIPAL OR
INTEREST, PROMPTLY AS IT MATURES THEN AT THE OPTION OF THE CITY OF CORPUS
CHRISTI OR ITS ASSIGNS, THE ENTIRE AMOUNT OF THE ASSESSMENT UPON WHICH
DEFAULT IS MADE, TOGETHER WITH REASONABLE ATTORNEYS FEES AND ALL COLLECTION
COSTS, IF INCURRED, SHALL BE AND BECOME IMMEDIATELY DUE AND PAYABLE.

SECTION 4. A HEARING SHALL BE HAD AND GIVEN TO THE REAL AND TRUE
OWNERS OF, AND ALL OWNING OR CLAIMING ANY INTEREST IN ANY PROPERTY ABUTTING
UPON SAID SIDEWALKS, AND TO ALL OTHERS OWNING, OR CLAIMING ANY INTEREST IN
SAID PROPERTY OR ANY OF SAID MATTERS, AS TO THE ASSESSMENTS AND AS TO THE
AMOUNTIO BE ASSESSED AGAINST EACH PARCEL OF ABUTTING PROPERTY, AND THE
REAL AND TRUE OWNERS THEREOF, AND AS TO THE SPECIAL BENEFITS, IF ANY, TO
SAID PROPERTY TO BE RECEIVED BY SAID IMPROVEMENTS, AND CONCERNING ANY
ERROR, INVALIDITY, IRREGULARITY OR DEFICIENCY IN ANY PROCEEDING OR CONTRACT
WITH REFERENCE THERETO OR CONCERNING ANY MATTER OR THING CONNECTED THERE-
WITH, WHICH HEARING SHALL BE HELD BY THE CITY COUNCIL OF CORPUS CHRISTI,
TEXAS, IN THE COUNCIL CHAMBER OF THE CITY HALL OF THE CITY OF CORPUS
CHRISTI, AT 3:00 O'CLOCK P.M., ON THE DAY OF DECEMBER, 1969, AT
WHICH TIME AND PLACE ALL PERSONS, FIRMS, CORPORATIONS OR ESTATES OWNING OR
CLAIMING ANY SUCH ABUTTING PROPERTY, OR ANY INTEREST THEREIN, AND THEIR
AGENTS OR ATTORNEYS, AND PERSONS INTERESTED IN SAID PROCEEDINGS, SHALL BE
NOTIFIED TO APPEAR AND BE HEARD IN PERSON, OR BY COUNSEL, AND MAY OFFER

SECTION 5. FOLLOWING SUCH HEARING AS ABOVE PROVIDED, ASSESS-
MENTS WILL BE LEVIED AGAINST SAID ABUTTING PROPERTY, AND THE REAL AND TRUE
OWNERS THEREOF FOR THAT PORTION OF THE COSTS OF SAID IMPROVEMENTS HEREIN -
ABOVE DETERMINED TO BE PAYABLE BY SAID ABUTTING PROPERTY AND THE REAL AND

NEVERTHELESS, THE REAL AND TRUE OWNERS OF SAID ABUTTING PROPERTY SHALL
BE LIABLE AND THE ASSESSMENT AGAINST-SAID ABUTTING PROPERTY SHALL BE
VALID WHETHER OR NOT SUCH OWNER BE NAMED, OR CORRECTLY NAMED, OR SAID
PROPERTY CORRECTLY DESCRIBED THEREIN.
SECTION 6. EACH PORTION OF SAID STREETS HEREINABOVE DESCRIBED
AND DESIGNATED BY UNIT NUMBERS CONSTITUTES A SEPARATE AND INDEPENDENT
UNIT OF THE IMPROVEMENTS AND SHALL BE IMPROVED AND THE IMPROVEMENTS CON-
STRUCTED THEREIN AS SEPARATE AND INDEPENDENT FROM EACH AND EVERY OTHER
UNIT OF SAID STREETS, AND THE ASSESSMENTS TO BE LEVIED FOR SAID IMPROVE-
MENTS IN EACH UNIT OR PORTION OF SAID STREETS SHALL BE ALTOGETHER SEPARATE
AND DISTINCT AND INDEPENDENT OF AND FROM THE ASSESSMENTS TO BE LEVIED IN
EVERY OTHER OF SAID UNITS AND PORTIONS OF SAID STREETS, AND, IN MAKING AND
LEVYING SAID ASSESSMENTS AGAINST THE PROPERTY ABUTTING UPON CIE OF
SAID UNITS NO MATTER OR CIRCUMSTANCE IN CONNECTION WITH ANY OTHER OF
SAID UNITS SHALL BE CONSIDERED OR HAVE ANY EFFECT UPON THE OTHER, ALL AS
FULLY AND TO THE SAME EXTENT AS IF SEPARATE PROCEEDINGS AND CONTRACTS HAD
BEEN HAD AND EXECUTED WITH REFERENCE TO THE IMPROVEMENTS TO BE MADE IN
EACH OF SAID UNITS.

SECTION 7. THE NEED FOR THE CONSTRUCTION OF SAID SIDEWALKS
WITHOUT DELAY CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY
TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND
THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
