AN ORDINANCE
CLOSING TO VEHICULAR TRAFFIC THE EAST 10 FEET OF LOT 15,
BLOCK 23, DEL MAR ADDITION TO THE CITY OF CORPUS CHRISTI,
NUECES COUNTY, TEXAS; RESERVING THEREIN THE SAID SPACE
AS A UTILITY EASEMENT; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI HAS BEEN
PETITIONED THAT THE ALLEY EASEMENT CROSSING LOTS 15 AND 16, BLOCK 23, DEL
MAR ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE CLOSED
TO VEHICULAR TRAFFIC; AND
WHEREAS, THE CITY COUNCIL AT ITS REGULAR MEETING ON THE 8TH DAY OF
OCTOBER, 1969, AUTHORIZED PUBLICATION OF NOTICE OF PUBLIC HEARING BEFORE THE
CITY COUNCIL TO CONSIDER SUCH CLOSING OF SAID ALLEY; AND
WHEREAS, NOTICE OF THE PROPOSED CLOSING OF THE SAID ALLEY HAS BEEN
GIVEN BY PUBLICATION AND BY MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS
ABUTTING SAID ALLEY AND WITHIN 450 FEET THEREFROM, IN ACCORDANCE WITH THE
CHARTER OF THE CITY OF CORPUS CHRISTI, AS PROVIDED FOR UNDER ARTICLE II,
SECTION 6 THEREOF; AND
WHEREAS, IN ACCORDANCE WITH THE NOTICE GIVEN AS ABOVE SET OUT, A
PUBLIC HEARING WAS HELD BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
AT 2 :00 O'CLOCK P.M. ON THE 29TH DAY OF OCTOBER, 1969, IN THE CITY COUNCIL
CHAMBER AT THE CITY HALL; AND
WHEREAS, IT WAS DETERMINED THAT THE PUBLIC SAFETY, WELFARE, CONVEN-
IENCE AND NECESSITY WILL BE BETTER SERVED BY THE CLOSING TO VEHICULAR TRAFFIC
OF THE EAST 10 FEET OF LOT 15, BLOCK 23, DEL MAR ADDITION TO THE CITY OF
CORPUS CHRISTI:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE EASEMENT HERETOFORE EXISTING ACROSS LOT 15,
BLOCK 23, DEL MAR ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
IS HEREBY CLOSED TO VEHICULAR TRAFFIC, SAVE AND EXCEPT THAT PORTION WHICH
REMAINS IN THE SUBSTITUTE EASEMENT HEREIN PROVIDED FOR AND WHICH SHALL BE
GRANTED BY THE FIRST STATE BANK OF CORPUS CHRISTI AS A CONDITION TO THIS
CLOSING. AS A CONDITION TO THE CLOSING, THE FOLLOWING EASEMENT SHALL BE

GRA14TED BY THE FIRST STATE BANK AND IS HEREBY RESERVED TO THE CITY IN LIEU
OF THE EASUIENT ON THE EAST:
BEGINNING at the southeast corner of Lot 13, Block 23, Del Mar
Addition for the southeast comer of this tract.
THENCE S 580 54' W, with the south boundary of said Lot 13, 10.00'
for the southwest corner of this tract.
THENCE N 310 06' W, parallel to the east boundary of said Lot 13,
125.00' to a point for an inside corner of this tract.
THENCE N 760 b6' W. 14.14' to a point on the north boundary of
said Lot 13 which is also the south boundary of Lot 18 of said Block
23, for an inside corner of this tract.
THENCE S 580 54' W, with said south boundary of said Lot 18, the
common boundary between said Lot 13 and Lot 18, at 30.0' across
the east boundary of Lot 17, at 80.0' across the east boundary of
Lot 16, in all a distance of 113.00' to a point 33.00' beyond the
east boundary of said Lot 16, for a point of tangency, on outside
corner of this tract, whence the southeast corner of said Lot 16, of
Block 23, Del Mar Addition bears N 580 54' E 33.0'.
THENCE, continuing along a curve with a 27.0' radius, leaving the
boundary lire of Lot 16 rand curving to the no, thwast a distance
of 42.41' to the original western boundary line of the alleyway
separating Block 22 from Block 23, in the original Del Mar Addition plat,
for the extreme northwest corner of this new location of alleyway,
which point is the common boundary of Lots 6 and 7, Block 22 and the
said original alley.
THENCE, N 580 54' east across said original alleyway to the original
western boundary line of Lot 16, Block 23, Del Mar Addition, 10.0'
for an outside corner of this tract.
THENCE, along a curve with a 17.0' radius, providing for a 10 -foot
alleyway curving to the east a distance of 26.70' to a point within
Lot 16, 10 feet to the north of the south boundary line of Lot 16, and
33.0 from the east boundary line of Lot 16.
THENCE, continuing on at a distance of 10 feet from the south boundary
line of Lot 16 and parallel to said boundary line, N 580 54' E, at 33.0'
across the east boundary of Lot 16, at 83.0' across the east boundary of
Lot 17, in all a distance of 113.0' to a point on the east boundary-of Lot
18, which is also the west boundary of Lot 19, Block 23, for the northeast
of this tract, whence, the northwest corner of said Lot 18 bears N 310
06' W, 125.00'.
THENCE, S 310 06' E with the east boundary of said Lot 18, at 10.0'
pass the southeast corner of said Lot 18, which is also the northeast
corner of said lot 13, and then continuing with the east boundary of
said Lot 13, in all a distance of 145.00' to 1-he southeast corner and place
of beginning.
RESERVING, HOWEVER, UNTO THE CITY OF CORPUS CHRISTI, FOR UTILITY EASEMENT,
THE AREA $O OCCUPIED 114 THE EASEMENT HERETOFORE EXISTING ACROSS LOT 15,
BLOCK 23, DEL 14AR ADDITION.

SECTION 2. THE FACT THAT PUBLIC CONVENIENCE AND NECESSITY WILL
BE BETTER SERVED BY THE CLOSING OF THE HEREINABOVE DESCRIBED ALLEY TO
VEHICULAR TRAFFIC CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECES-
SITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE
PUBLIC NECESSITY EXIST AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUS-
PENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO-
DUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS
PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE f�.C..(J ''Il DAY OF NOVEMBER,

, For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend ;jaid Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
