HomeMy WebLinkAbout09597 ORD - 01/07/1970VMP:1/7/70 AN ORDINANCE APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $5,322, OF WHICH AMOUNT $5,200 IS FOR ACQUISITION OF PARCEL NO. 4 AND $122 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT NO. 291 -64-4, ELGIN PARK; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BE- HALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNERS, ELBERT S. COX, ALEX COX, ALBINO CONSINO AND WIFE, TOMASA CONSINO; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF N0. 291 PARK BOND FUND THE SUM OF $5,322, OF WHICH AMOUNT $5,200 IS FOR ACQUISITION OF PARCEL NO. 11 AND $122 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT N0. 291 -64 -4, ELGIN PARK, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT: LOT 19, BLOCK 2, EL REY ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. SAID PROPERTY BEING FURTHER IDENTIFIED BY MAP VOL. S, PAGE 52, MAP RECORDS OF NUECES COUNTY, TEXAS. SECTION 2. THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH THE OWNERS OF THE AFORESAID PARCEL, ELBERT S. COX, ALEX COX, ALBINO CONSINO AND WIFE, TOMASA CONSINO. SECTION 3. THE NECESSITY TO APPROPRIATE THE SUMS HEREINABOVE DESCRIBED AND TO AUTHORIZE THE PURCHASE OF THE AFORESAID PARCEL FOR THE ELGIN PARK PROJECT CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF JANUARY, 1970. FIN 2 -55 Revised 7 -31 -69 4J Corpus Christi, Texas day of , 14-L TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
