HomeMy WebLinkAbout09601 ORD - 01/07/1970JRR: mt;: 12 -17 -69 AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958 AS AMENDED, BY AMENDING ARTICLE IV, SECTION 9 -49, "RATES AND REN'T'AL FLES FOR USE OF SLIPS AND DOCK SPACE," FOR THE PURPOSE OF PRESCRIBI:G CURRENT AND APPROPRIATE RATES IN SAME; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CORPUS CHRISTI CITY CODE, 1958,AS AMENDED, BE, AND THE SAME IS HERESY, AMENDED BY AMCNOINO ARTICLE IV, SECTION 9-49, "RATES AND RENTAL FEES FOR USE OF SLIP AND DOCK SPACE," TO HEREAFTER READ AS FOLLOWS: "ARTICLE IV. "SECTION 9 -49. RATES AND RENTAL FEES FOR USE OF SLIPS AND DOCK SPACE. (1) DEFINITIONS: BOAT SLIP: THE AREA BOUND BY FOUR (4) TIE PILINGS, INCLUDING ONE -HALF OF AN ADJACENT CATWALK, AS DESIGNATED ON THE MARINA DEPARTMENT SLIP CHART. DOCK SPACE: AN AREA DETERMINED BY MULITPLYING THE LENGTH TIMES THE WIDTH OF THE TENANTS BOAT. SUITABLE SIZE SLIP: A SLIP WITH REFERENCE TO A PARTICULAR 80AT WHICH CAN PHYSICALLY AND SAFELY ACCOMMODATE SUCH BOAT AS DETERMINED BY THE MARINA DIRECTOR, CONSIDERING BOTH THE SAFETY OF THE VESSEL AND THE CITY PROPERTY. (E) THE RATES AND RENTAL FEES TO BE CHARGED FOR THE USE OF BOAT SLIPS AND BOAT SPACE IN THE CORPUS CHRISTI MARINA SHALL BE AS FOLLOWS: (A) THERE SHALT. BE A MINIMUM CHARGE OF TEN DOLLARS ($10.00 PER MONTH FOR EACH BOAT SLIP OR DOCK SPACE IN THE MARINA. (B) DOCK SPACE OR BOAT SLIP SMALL BE PAYABLE AT THE RATE OF TWO AND ONE -HALF CENTS (2-112V) PER SQUARE FOOT PER MONTH. THIS RACE SHALL BE APPLICABLE TO ALL SLIPS, EXCEPT THE TWENTY -TWO (22) SLIPS LOCATED ON THE SOUTH SIOE OF THE L -HEAD, THE RATE FOR WHICH IS FIXED IN SUBSECTION (C) HEREOF, AND FOR CHARTER BOATS FOR RENT OR HIRE, THE RATE FOR WHICH IS FIXED IN SUBSECTION (D) HEREOF. (C) THE RENTAL FOR EACH OF THE BOAT SLIPS LOCATED ON THE SOUTH SIDE OF THE L -BEAD SHALL BE TWO CENTS (2¢) PER SQUARE FOOT PER MONTH. (D) BOAT SLIPS USED BY CHARTER BOATS SHALL BE CHARGED AT THE RATE OF THREE CENTS (3¢) PER SQUARE FOOT PER MONTH WITH A MAXIMUM RATE OF EIGHTY DOLLARS ($80.00) PER MONTH UNLESS MORE THAN ONE OWNER REQUESTS TO LEASE THE SAME SLIP. IF MORE THAN ONE CHARTER BOAT OWNER DESIRES TO RENT A PARTICULAR SLIP, WRITTEN NOTICE OF SUCH REQUEST SHALL BE SUBMITTED TO THE MARINA SUPERINTENDENT WHO WILL SET A DATE AT LEAST THIRTY (30) DAYS THEREAFTER TO RECEIVE SEALED BIDS FOR THE MONTHLY RENTAL OF THE SLIP. SUCH BIDS WILL BE REQUIRED TO BE IN EXCESS OF THE AMOUNT WHICH WOULD OTHERWISE BE CHARGED FOR THE SLIP. THE BIDDER SUB- MITTING THE HIGHEST BID MUST AGREE TO SIGN A ONE -YEAR LEASE FOR THE SLIP AND PAY THREE (3) MONTHS OF THE LEASE IN ADVANCE SO THAT AT ALL TIMES EXCEPT DURING THE FINAL NINETY (90) DAYS OF THE LEASE PERIOD, THE TENANT IN ANY SLIP OBTAINED WILL HAVE PAID IN ADVANCE AT LEAST NINETY (90) DAYS RENT. SUCH HIGHER RATE SHALL CONTINUE AFTER THE END OF THE ONE -YEAR LEASE PERIOD UNLESS THE OWNER WISHES TO BE RELEASED FROM THE ADDITIONAL PAYMENT. AT SUCH TIME BIDS WILL AGAIN BE TAKEN FOR THE SLIP TO DETERMINE THE TENANT AND RATE WHICH WILL APPLY THEREAFTER. ALL BERTHS AND SLIPS SHALL BE ASSIGNED BY THE MARINA SUPERVISOR. NO PERSON, SPECIFICALLY INCLUDING THE OWNER, MASTER OR OPERATOR OF ANY WATERCRAFT, SHALL ALLOW SUCH WATERCRAFT TO OCCUPY ANY -2- SLIP OR DOCK SPACE AFTER THE PERIOD FOR WHICH THE RENT HAS BEEN PAID HAS EXPIRED. ALL-FEES ARE PAYABLE IN ADVANCE AT THE SUPERVISORS' OFFICE OR AT THE COLLECTION SECTION OF THE FINANCE DEPARTMENT. (3) IF A SLIP OF SUITABLE SIZE IS NOT AVAILABLE FOR A PAR- TICULAR BOAT, PROPER APPLICATION FOR SLIP ASSIGNMENT HAVING BEEN MADE, AND AS A CONSEQUENCE THE BOAT OCCUPIES A SLIP OF MORE THAN SUITABLE SIZE FOR SUCH BOAT, THE BOAT WILL BE CHARGED ON THE BASIS OF A SUITABLE SIZE SLIP UNTIL SUCH SUIT- ABLE SLIP BECOMES AVAILABLE. WHENEVER A SUITABLE SIZE SLIP BECOMES AVAILABLE FOR A BOAT OCCUPYING A LARGER SLIP THE OWNER OR OPERATOR OF SUCH BOAT SHALL, WITHIN NOT MORE THAN THREE (3) DAYS AFTER NOTICE OF THE SUITABLE SIZE AVAILABILITY GIVEN TO THE OWNER OR OPERATOR BY THE MARINA DEPARTMENT, REMOVE SUCH BOAT FROM THE LARGER TO THE SMALLER AVAILABLE SLIP AS ASSIGNED. UNLESS THE BOAT OWNER OR OPERATOR OBTAINS AN EXTENSION OF TIME, GRANTED IN WRITING BY THE MARINA SUPERINTENDENT, TO REMAIN, FOR GOOD CAUSE, IN SUCH LARGER SLIP, THE BOAT SHALL, AFTER EXPIRY OF THE THREE -DAY PERIOD, BE ASSESSED AND CHARGED THE APPLICABLE DOCKAGE SPACE RATE FOR THE LARGER SLIP. A LARGER BOAT, IN LINEAR FOOTAGE, SHALL BE ACCORDED PRIORITY FOR ASSIGNMENT TO A SUITABLE SIZE SLIP OVER A SMALLER BOAT WHICH MIGHT ALSO BE ACCOMMODATED IN THE SAME SLIP." SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVI- SION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER CRDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 3. THIS ORDINANCE SHALL TAKE EFFECT AND BE IN FORCE AND EFFECT JANUARY I, 1970. SECTION 4. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE.
