AN ORDINANCE
APPROPRIATING OUT OF NO. 291, PARK BOND FUND THE SUM
OF $10,1IJ&2 OF WHICH AMOUNT $5,300 IS FOR ACQUISITION
OF PARCEL NO. 1, $5,020 IS FOR ACQUISITION OF PARCEL
NO. 6 AND $2112 IS FOR INCIDENTAL EXPENSE AND RELATED
COSTS, APPLICABLE TO PROJECT NO. 291 - 611 -4, ELGIN PARK;
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
REAL ESTATE SALES CONTRACTS, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI WITH THE OWNERS OF PARCEL NO.
1, DIEGO AVILA AND WIFE ISABEL AVILA AND WITH THE
OWNERS OF PARCEL NO. 6, HILARIO GONZALEZ AND WIFE ROSA
GONZALEZ OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF No. 291 PARK
BOND FUND THE SUM OF $10,14112 OF WHICH AMOUNT $5,300 IS FOR ACQUISITION
OF PARCEL No. 1, $5,020 IS FOR ACQUISITION OF PARCEL No. 6 AND $2142 1S FOR
INCIDENTAL EXPENSE AND RELATED COSTS, ALL IN CONNECTION WITH PROJECT No.
291 - 614 -14, ELGIN PARK, SAID PARCELS BEING MORE FULLY DESCRIBED AS FOLLOWS,

CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS
RECORDED IN VOLUME 8, PAGE 52, MAP RECORDS, NUECES
COUNTY, TEXAS.

LOT 21, BLOCK 2, EL REY ADDITION, AN ADDITION TO THE
CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS
RECORDED IN VOLUME 8, PAGE 52, MAP RECORDS, NUECES
COUNTY, TEXAS.
SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACTS AND SUCH OTHER INSTRU-
MENTS AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI, THE AFORESAID PARCELS FROM THE RESPECTIVE OWNERS, DIEGO
AVILA AND WIFE ISABEL AVILA, OWNERS OF PARCEL No. 1, AND HILARIO GONZALEZ
AND WIFE ROSA GONZALEZ, OWNERS OF PARCEL No. 6.
SECTION 3. THE NECESSITY TO APPROPRIATE THE SUMS HEREINABOVE
DESCRIBED AND THE ACQUISITION OF THE PARCELS AFORESAID CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST
AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED, THIS THE /weDAY OF JANUARY, 1970,

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
