HomeMy WebLinkAbout09610 ORD - 01/21/19701/21/70:E AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER,FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A SUPPLEMENT TO CONTRACT WITH ALLRIGHT CORPUS CHRISTI, INC., WHICH WAS AUTHORIZED BY ORDINANCE 8963, A COPY OF SAID SUPPLEMENT TO CONTRACT BEING ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY OF CORPUS CHRISTI AND ALLRIGHT CORPUS CHRISTI, INC., HAVE PREVIOUSLY ENTERED INTO A CONTRACT, AUTHORIZED BY ORDINANCE No. 8963, PASSED ON JULY 31, 1968, REGARDING THE LEASING OF PARKING SPACES ON ALLRIGHT PARKING LOT LOCATED ON THE CORNER OF LAWRENCE AND MESQUITE STREETS, ADJACENT TO THE BUILDING NOW OCCUPIED BY THE TAX AND COLLECTION OFFICES OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, IT 15 CONTEMPLATED THAT THE CITY OF CORPUS CHRISTI WILL LEASE THE LOT IMMEDIATELY NORTH OF THE PARKING AREA NOW USED BY THE CITY TAX - COLLECTION OFFICE AND IT WILL BE NECESSARY TO ENTER SAID NEW AREA THROUGH THE PARKING AREA IMMEDIATELY SOUTH THEREOF, WHICH ENTRANCE WILL ELIMINATE THE OTHERWISE POSSIBLE USE OF SPACES NO. 24 AND No. 25 COVERED BY CONTRACT AUTHORIZED BY ORDINANCE NO. 8963, THEREBY NECESSITATING A SUPPLEMENT TO THE AFORESAID CONTRACT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE A SUPPLEMENT TO CONTRACT AUTHORIZED BY ORDINANCE N0. 8963 WITH ALLRIGHT CORPUS CHRISTI, INC., A COPY OF WHICH SUPPLEMENT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO EXECUTE THE ABOVE REFERENCED SUPPLEMENT TO CONTRACT IN ORDER THAT AN ENTRANCE MAY BE PROVIDED TO PROPOSED ADDITIONAL PARKING SPACE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON 961LO THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE _., DAY OF JANUARY, 1970, ATTE CITY SECRET MA R tl THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: DAY OF JANUARY, 1970: CITY ATT EY 1.....1.11.1 I- SUPPLEMENTAL AGREEMENT THE STATE OF TEXAS Q COUNTY OF NUECES WHEREAS, BY ORDINANCE NO. 8963, PASSED AND APPROVED BY THE CITY COUNCIL ON AUGUST 7, 1968, AGREEMENT WAS ENTERED INTO BETWEEN ALLRIGHT CORPUS CHRISTI, INC., AND THE CITY OF CORPUS CHRISTI FOR THE LEASING BY THE CITY OF CERTAIN PARKING SPACES ON THE PARKING LOT LOCATED ON THE CORNER OF LAWRENCE AND MESQUITE STREETS, ADJACENT TO THE BUILDING NOW OCCUPIED BY THE CITY TAX AND COLLECTION OFFICES, AND BEING THAT PORTION OF THAT PARKING LOT LOCATED NEAREST THE SPARKS BUILDING, WHICH FRONTS ON LAWRENCE STREET; AND WHEREAS, IT IS CONTEMPLATED THAT THE CITY OF CORPUS CHRISTI WILL LEASE THE LOT IMMEDIATELY NORTH OF THE PARKING AREA NOW USED BY THE CITY TAX COLLECTION OFFICE AND IT WILL BE NECESSARY TO USE THE ENTRANCE TO SAID LOT THROUGH THE PARKING AREA IMMEDIATELY SOUTH THEREOF, WHICH ENTRANCE WILL ELIMINATE THE OTHERWISE POSSIBLE USE OF SPACES NOS. 24 AND 25 OF THE PARKING AREA INVOLVED IN THE CONTRACT DATED NOVEMBER 25, 1968, BETWEEN ALLRIGHT CORPUS CHRISTI, INC. AND THE CITY OF CORPUS CHRISTI: IT IS, THERE- FORE, NECESSARY TO SUPPLEMENT SAID CONTRACT BY THE TERMS HEREINAFTER SET FORTH: 1- SPACES NOS. 24 AND 25 OF THE THIRTY -FOUR (34) PARKING SPACES UNDER LEASE BY THE CITY, USABLE BY ALLRIGHT CORPUS CHRISTI ON SATURDAYS WILL BE DELETED FROM SAID AGREEMENT, AND THE CITY AND ITS EMPLOYEES WILL BE PERMITTED ACCESS TO THE LOT IMMEDIATELY TO THE NORTH OF SAID PARKING AREA THROUGH SAID AREA PREVIOUSLY USED AS PARKING SPACES NOS. 24 AND 25, AND IN ACCORDANCE WITH THE AGREEMENT HERETOFORE EXISTING BETWEEN CITY AND ALLRIGHT, FOR THE USE BY ALLRIGHT OF THE SAID "NO PARKING" SPACES ON SATURDAYS, THE LEASE -BACK RENTAL HERETOFORE AGREED TO BETWEEN THE CITY AND ALLRIGHT SHALL BE REDUCED FROM TWENTY -EIGHT AND 33/100 DOLLARS ($28.33) TO TWENTY -TWO AND 33100 DOLLARS ($22.33) PER MONTH. OTHER THAN AS HEREIN PROVIDED, ALL OTHER PROVISIONS OF THE HERETOFORE EXISTING AGREEMENT BETWEEN THE CITY AND ALLRIGHT ARE HEREBY CONTINUED IN FULL FORCE AND EFFECT.
