TEXAS:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, CALLING AN ELECTION ON THE QUESTION OF
LOCATION OF ANOTHER DAM ON THE NUECES WATERSHED;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT AN ELECTION SHALL BE HELD IN SAID CITY ON THE
ATH DAY OF FEBRUARY, 1970, IN THE SEVERAL REGULAR ELECTION PRECINCTS OF
SAID CITY, AND AT THE POLLING PLACES, AS FOLLOWS:

THE MAYOR OF SAID CITY SHALL APPOINT THE ELECTION OFFICERS TO
HOLD SAID ELECTIONp IN ACCORDANCE WITH LAW.
2• THAT AT SAID ELECTION THE FOLLOWING PROPOSITION SHALL BE
SUBMITTED IN ACCORDANCE WITH LAW:
PROPOSITION "A"
THE CITY COUNCIL RECOMMENDS THAT ANOTHER DAM BE CONSTRUCTED
ON THE NUECES WATERSHED TO BE COMPLETED BETWEEN 1975 AND
1950. THE COUNCIL HAS CAREFULLY STUDIED ALTERNATIVE FINANC-
ING AND CONSTRUCTION METHODS AND HAS CONCLUDED THAT THE
FEDERAL BUREAU OF RECLAMATION SHOULD BE ASKED TO CONSTRUCT
THE DAM AND10 ALLOW THE CITY TO REPAY THE COST OVER FIFTY
i (50) YEARS. THE CITY HAS ASKED THE BUREAU TO STUDY ALL
I
FEASIBLE RESERVOIR SITES. THESE STUDIES CONCLUDE THAT THE
TWO BEST SITES ARE THE LOWER OR R & M SITE FIVE MILES NORTH
OF CALALLEN AND THE UPPER OR CHOKE CANYON SITE WEST OF THREE
RIVERS. THE BUREAU HAS ESTIMATED THE COST AT CHOKE CANYON
AT $37,46o,000 FOR AN ANNUAL WATER YIELD OF 45 BILLION GALLONS
AND AT R & M AT $85,386,000 FOR AN ANNUAL WATER YIELD OF 54
I BILLION GALLONS. IT ISM THEREFORE, SUBMITTED FOR THE CHOICE
OF THE VOTERS TO INDICATE THEIR PREFERENCE BY THEIR VOTE AS
I1 TO WHETHER THE PROPOSED DAM SHALL BE LOCATED AT CHOKE CANYON
SITE OR THE R & M SITE.
3. THAT SAID ELECTION SHALL BE HELD IN ACCORDANCE WITH THE PROVI-
SIONS OF THE CITY CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS.
II. THAT THE OFFICIAL BALLOTS FOR SAID ELECTION SHALL BE PREPARED
IN ACCORDANCE WITH THE TEXAS ELECTION CODE SO AS TO PERMIT THOSE VOTERS
DESIRING TO PREFER THE CHOKE CANYON SITE TO HAVE WRITTEN OR PRINTED ON
THEIR BALLOTS THE FOLLOWING WORDS:
°I PREFER THE CHOKE CANYON SITE, ESTIMATED T5O1 COST
{1\ `+60,000 WITH AN ANNUAL WATER SUPPLY OF 4 BILLION
GALLONS.
AND THOSE VOTERS DESIRING TO PREFER THE R & M SITE TO HAVE WRITTEN OR
PRINTED ON THEIR BALLOTS THE FOLLOWING WORDS:
"I PREFER THE R & M SITES ESTIMATED TO COST 56 000
WITH AN ANNUAL WATER SUPPLY OF 54 BILLION GALLONS.
5. THAT VOTING MACHINES SHALL BE EMPLOYED AT THE ELECTION
HEREIN ORDERED IN ACCORDANCE WITH THE PROVISIONS OF V.A.T.S. ELECTION CODE,
ARTICLE 7.14.
6. THAT THE CITY SECRETARY OF THE CITY OF CORPUS CHRISTI SHALL
BE THE CLERK FOR ABSENTEE VOTING AT SAID ELECTION; AND THE OFFICE OF SAID
CITY SECRETARY IN THE CITY HALL IS HEREBY DESIGNATED AS THE PLACE AT WHICH
ABSENTEE VOTING SHALL BE CONDUCTED FOR SAID ELECTION, DURING THE REGULAR
OFFICE HOURS OF SAID CITY SECRETARY. VOTING MACHINES SHALL BE USED BOTH
FOR ABSENTEE VOTING BY PERSONAL APPEARANCE AND FOR VOTING AT THE REGULAR
POLLING PLACES AT SAID ELECTION; BUT PAPER BALLOTS SHALL BE USED FOR
ABSENTEE VOTING BY MAIL. A SPECIAL CANVASSING BOARD SHALL BE APPOINTED
BY THE MAYOR, AS PROVIDED BY LAW, TO COUNT AND CANVASS ALL ABSENTEE VOTES
AND BALLOTS CAST AT SAID ELECTION.
7. A SUBSTANTIAL COPY OF THIS ORDINANCE SHALL SERVE AS PROPER
NOTICE OF SAID ELECTION. NOTICE SHALL BE GIVEN IN ACCORDANCE WITH ARTICLE
704, REVISED CIVIL STATUTES OF 1925, AS AMENDED. THE MAYOR IS AUTHORIZED
AND DIRECTED TO HAVE A COPY OF SAID NOTICE POSTED AT THE CITY HALL IN SAID
CITY AND AT EACH OF THE VOTING PLACES IN SAID CITY, NOT LESS THAN FIFTEEN
DAYS PRIOR TO THE DATE FIXED FOR HOLDING SAID ELECTION. HE SHALL ALSO
CAUSE SAID NOTICE TO BE PUBLISHED ON THE SAME DAY IN EACH OF TWO SUCCESSIVE
WEEKS IN A NEWSPAPER OF GENERAL CIRCULATION PUBLISHED WITHIN SAID CITY,
THE DATE OF THE FIRST PUBLICATION TO BE NOT LESS THAN FOURTEEN DAYS PRIOR
TO THE DATE SET FOR SAID ELECTION. EXCEPT AS OTHERWISE PROVIDED IN SAID
ARTICLE 704, AS AMENDED, THE MANNER OF HOLDING SAID ELECTION SHALL BE
GOVERNED BY THE LAWS GOVERNING GENERAL ELECTIONS.
8. THAT THE PUBLIC IMPORTANCE AND PRESSING NEED FOR SUBMISSION
TO THE PUBLIC OF THE PROPOSITION HEREIN CONTAINED CREATES A PUBLIC EMERGENCY
AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF RULES AND
CHARTER PROVISIONS REQUIRING SAME TO BE CONSIDERED AND VOTED UPON AT THREE
REGULAR MEETINGS, AND SUCH FACTS REQUIRE THAT THIS ORDINANCE BE PASSED
AND TAKE EFFECT IMMEDIATELY AS AN EMERGENCY MEASURE, AND SUCH RULES AND
PROVISIONS ARE HEREBY SUSPENDED AND THIS ORDINANCE IS PASSED AND SHALL TAKE
EFFECT AS AN EMERGENCY MEASURE, AND SHALL BE IN FULL FORCE AND EFFECT
IMMEDIATELY UPON ITS PASSAGE.
9. IT IS HEREBY OFFICIALLY FOUND AND DETERMINED THAT THE MEETING
AT WHICH SAID ELECTION WAS CALLED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW AND PUBLIC NOTICE OF THE TIME, PLACE, AND PURPOSE OF SAID MEETING WAS
GIVEN AS REQUIRED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR
SESSION, 1969.
PASSED AND APPROVED THIS THE 21ST DAY OF JANUARY, 1970.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; 1, therefore,
request that you suspend laid Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
