HomeMy WebLinkAbout09615 ORD - 01/21/1970AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF THE FOLLOWING BONDS: $1,700,000 PARK IMPROVEMENT BONDS; $2,1470,000 DRAINAGE IMPROVEMENT BONDS; $0,000 SERVICE CENTER DEVELOPMENT BONDS; $2,100,000 SANITARY SEWER IMPROVEMENT BONDS; $250,000 MARINA IMPROVEMENT BONDS; $14,910,000 STREET IMPROVEMENT BONDS; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF SAID CITY DEEMS IT ADVISABLE TO ISSUE THE BONDS OF SAID CITY FOR THE PURPOSES HEREINAFTER STATED; AND WHEREAS, IT IS HEREBY OFFICIALLY FOUND AND DETERMINED: THAT A CASE OF EMERGENCY OR URGENT PUBLIC NECESSITY EXISTS WHICH REQUIRES THE HOLDING OF THE MEETING AT WHICH THIS ORDINANCE IS PASSED, SUCH EMERGENCY OR URGENT PUBLIC NECESSITY BEING THAT THE PROCEEDS FROM THE PROPOSED BONDS ARE REQUIRED AS SOON AS POSSIBLE AND WITHOUT DELAY FOR NECESSARY AND URGENTLY NEEDED PUBLIC IMPROVEMENTS; THAT SAID MEETING WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW; AND THAT PUBLIC NOTICE OF THE TIME, PLACE, AND PURPOSE OF SAID MEETING WAS GIVEN AS REQUIRED BY LAW; AND THAT PUBLIC NOTICE OF THE TIME, PLACE, AND PURPOSE OF SAID MEETING WAS GIVEN AS REQUIRED BY CHAPTER 227, ACTS OF THE 61ST LEGISLA- TURE, REGULAR SESSION, 1969. _ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. THAT AT SAID ELECTION THE FOLLOWING PROPOSITIONS SHALL BE SUBMITTED IN ACCORDANCE WITH LAW: PROPOSITION NO. 1 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF 1,700,000, WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF IMPROVING LANDS FOR PARKS, INCLUDING COLE PARK FISHING PIER AND SEAWALL, POOLS AT BROWNLEE AND WINNEBAGO AND IN THE GREENWOOD AREA, ACQUISITION ALONG THE BAYFRONT AND AT BEN GARZA PARK, BUILDING EXPANSION AT T. C. AYERS AND BEN GARZA, AND IMPROVEMENTS AT GREENWOOD, TIMON PARKWAY, AIRPORT, CANDLEWOOD, COUNTRY CLUB, MOODY, LEXINGTON, SOUTH BAY, STONEGATE, MAIN DRIVE, AND HILLCREST AND OTHER PARK IMPROVEMENTS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY? PROPOSITION NO. 2 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $2,470AOOi WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING DRAINAGE IMPROVE- MENTS, INCLUDING BROWNLEE- LEATHERS AREA, MAYFIELD ROAD AND STARLITE LANE, RICHTER STREET AREA, NORTON, GARDENDALE AREA, MCBRIDE, STAPLES - WOOLRIDGE OUTFALL, FLOUR BLUFF AREA, WESTCHESTER, SANTA FE, HEARN ROAD OUTFALL, KOSTORYZ ROAD AND OTHER NEIGHBORHOOD DRAINAGE IMPROVEMENTS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY? PROPOSITION NO. 3 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $0,000, WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF PERMANENT IMPROVEMENTS FOR SERVICE CENTER AT THE AYERS STREET SITE, INCLUDING SANITATION AND STREET OPERAT- ING YARDS, MAINTENANCE FACILITIES, AND SHOPS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY? PROPOSITION NO. 4 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $2,100,000, WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF CONSTRUCTING IMPROVEMENTS TO THE SANITARY SEWER SYSTEM, INCLUDING RESIDENTIAL LINES IN FLOUR BLUFF AND ALONG LEOPARD STREET, OSO TREATMENT PLANT IMPROVEMENTS, LAWNVIEW TRUNK LINE, AND THE KOSTORYZ STATION FORCE MAIN, AND OTHER SANITARY SEWER IMPROVEMENTS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY? PROPOSITION NO. 5 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $250,000, WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION of THE CITY COUNCIL, FOR THE PURPOSE OF PERMANENT PUBLIC IMPROVEMENTS, TO -WIT: CONSTRUCTION OF MARINA IMPROVEMENTS, INCLUDING CONCESSION AND RESTROOM FACILITIES, REPLACEMENT OF PIERS AND PILINGS, AND OTHER IMPROVEMENTS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINK- ING FUND TO PAY SAID BONDS AT MATURITY? PROPOSITION NO. 6 SHALL THE CITY COUNCIL OF SAID CITY BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $4,910,000, WITH THE BONDS OF EACH SUCH SERIES OR ISSUE, RESPECTIVELY, TO MATURE SERIALLY WITHIN NOT TO EXCEED TWENTY - FIVE YEARS FROM THEIR DATE, AND TO BE SOLD AT SUCH PRICES AND BEAR INTEREST AT SUCH RATES AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL, FOR THE PURPOSE OF IMPROVING THE STREETS OF THE CITY, INCLUDING SOUTH STAPLES FROM PADRE ISLAND DRIVE TO SARATOGA, NORTH ALAMEDA, MCBRIDE LANE, GOLLIHAR FROM CADDO TO AIRLINE, HORNE ROAD, PADRE ISLAND DRIVE LIGHTING, WEST POINT ROAD, GREENWOOD DRIVE, VIOLET ROAD, MCKENZIE ROAD, PRESCOTT, AIRLINE FROM ALAMEDA TO OCEAN DRIVE, N.A.S. DRIVE, AYERS FROM NORTON TO PORT, NEIGHBORHOOD STREETS AND SIDEWALKS, AND OTHER STREET AND SIDEWALK IMPROVEMENTS; AND SHALL SAID CITY COUNCIL BE AUTHORIZED TO LEVY AND CAUSE TO BE ASSESSED AND COLLECTED ANNUAL AD VALOREM TAXES IN AN AMOUNT SUFFICIENT TO PAY THE ANNUAL INTEREST ON SAID BONDS AND PROVIDE A SINKING FUND TO PAY SAID BONDS AT MATURITY? 3. That said election shall be held in accordance with the provisions of the City Charter of the City of Corpus Christi, Texas, and that said election shall be held and conducted in effect as two separate but simultaneous elections, to -wit: one election at which only the resident, qualified electors who own taxable property in the City and who have duly rendered the same for taxation shall be entitled to vote on said PROPOSITIONS, and another election at which all other resident, qualified electors of the City shall be entitled to vote on said PROPOSITIONS. The votes cast at each of said separate but simultaneous elections shall be recorded, returned, and canvassed separately. It is hereby declared that the purpose of holding the election in such manner is to ascertain arithmeti- cally: (a) the aggregate votes cast at the election for and against said PROPOSITIONS by resident, qualified electors of the City, and also (b) the aggregate votes cast at the election for and against said PROPOSITIONS by resident, qualified electors who own taxable property in the City and who have duly rendered the same for taxation. Each elector shall be entitled to vote once, in accordance with the foregoing provisions of this Ordinance. 4. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITIONS, which shall be set forth in substantially the following form: PROPOSITION NO. 1 FOR ) THE ISSUANCE OF PARK IMPROVEMENT BONDS AGAINST ) PROPOSITION NO. Z FOR ) THE ISSUANCE OF DRAINAGE IMPROVEMENT BONDS AGAINST ) PROPOSITION NO. 3 FOR ) THE ISSUANCE OF CENTRAL FIELD OPERATION AND EQUIPMENT SERVICE CENTER BONDS AGAINST ) PROPOSITION NO. 4 FOR 1 THE ISSUANCE OF SANITARY SEWER IMPROVEMENT BONDS AGAINST ) PROPOSITION NO. 5 FOR ) THE ISSUANCE OF MARINA BONDS AGAINST ) PROPOSITION NO. 6 FOR ) THE ISSUANCE OF STREET IMPROVEMENT BONDS ) AGAINST ) 5. That voting machines shall be employed at the election herein ordered in accordance with the provisions of V.A.T.S. Election Code, Article 7.14. 6. That the City Secretary of the City of Corpus Christi shall be the clerk for absentee voting at said election; and the office of said City Secretary in the City Hall is hereby designated as the place at which absentee voting shall be con- ducted for said election, during the regular office hours of said City Secretary. Voting machines shall be used both for absentee voting by personal appearance and for voting at the regular polling places at said election; but paper ballots s.-all be used for absentee voting by mail. A Special Canvassing Board shall be appointed by the Mayor, as provided by law, to count and canvass all absentee votes and ballots cast at said election. 7. A substantial copy of this Ordinance shall serve as proper notice of said election. Notice shall be given in. accordance with Article 704, Revised Civil SU:utes of 1925, as amended. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall in said City and at each of the voting places in said City, not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. 8. That the public importance and the pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts require that this ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and shall be in full force and effect immediately upon its passage. 9. It is hereby officially found and determined that the meeting at which said election was called was open to the public as required by law and public notice of the time, place, and purpose of said meeting was given as required by Chapter 227, Acts of the 61st Legislature, Regular Session, 1969. I, therefore, request that the City Council pass the proposed ordinance calling an election for the issuance of said bonds as an emergency measure.
