HomeMy WebLinkAbout09618 ORD - 01/28/1970ACG:BJW:1 /21/70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI CER- TAIN DEED RESTRICTIONS IN CONNECTION WITH PROJECT NO. 291 - 611 -11 AND OSC -36 (DL) OPEN SPACE LAND PROGRAM, ELGIN PARK, THAT ARE TO BE FILED FOR RECORD INDICATING THAT THE PARCELS MAY NOT BE SOLD, LEASED OR OTHERWISE TRANSFERRED WITHOUT THE PRIOR WRITTEN APPROVAL OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT, A SUBSTANTIAL COPY OF THE FORM OF SUCH RESTRICTIONS BEING ATTACHED HERE- TO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY OF CORPUS CHRISTI IS OBTAINING CERTAIN PARCELS OF LAND FOR THE PURPOSE OF THE OPEN SPACE PROGRAM DESIGNATED AS PROJECT ND. 291 -64 -11 AND OSC -36 (DL) OPEN SPACE LAND PROGRAM, ELGIN PARK: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE A NOTICE OF CERTAIN DEED RESTRICTIONS THAT ARE TO BE FILED FOR RECORD INDICATING THAT THE PARCELS INVOLVED IN THE ABOVE DESIGNATED PROJECT MAY NOT BE SOLD, LEASED OR OTHERWISE TRANSFERRED WITHOUT THE PRIOR WRITTEN APPROVAL OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT. A SUB- STANTIAL COPY OF SAID FORM OF NOTICE IS ATTACHED HERETO AND MADE A PART HERE- OF FOR ALL PERTINENT PURPOSES. SECTION 2. THE NECESSITY FOR AUTHORIZING THE CITY MANAGER TO EXE- CUTE THE NOTICE OF RESTRICTIONS AS HEREINABOVE PROVIDED IN ACCORDANCE WITH THE AGREEMENT WITH THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT IN CONNEC- TION WITH THE ACQUISITION OF ALL PARCELS CREATES A PUBLIC EMERGENCY AND IM- PERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUC- TION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE d°j� -IWAY OF JANUARY, 1970. / r � rJ CITY SECR A A APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS DAY OF JANUARY, 197 . APPROPRIATED OUT OF N0. 291 PARK BOND FUND THE SUM OF $ , OF WHICH AMOUNT IS FOR ACQUISITION OF PARCEL AND IS FOR INCIDENTAL EXPENSE AND RELATED COSTS APPLICABLE TO PROJECT NO. 291_64 -4 AND OSC -36 (DL) OPEN SPACE LAND PROGRAM, ELGIN PARKI SAID PAR- CEL BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT: SECTION 2. THAT THE CITY MANAGER,PURSUANT TO THE AUTHORITY GRANTED ON JANUARY 7p 1970, EXECUTED A REAL ESTATE SALES CONTRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI WITH THE OWNERS OF THE AFORESAID PARCEL, SECTION 3. THAT THIS PARCEL HAVING BEEN PURCHASED BY THE CITY OF CORPUS CHRISTI FOR THE EXPRESS PURPOSE OF THE FEDERAL OPEN SPACE PROGRAM, THIS SITE SHALL BE SUBJECT TO THE FOLLOWING RESTRICTIONS, TO -WIT: THE SITE OR ANY INTEREST THEREIN MAY NOT BE SOLD, LEASED OR OTHERWISE TRANSFERRED WITHOUT THE PRIOR WRITTEN APPROV- AL OF THE SECRETARY OF HOUSING AND URBAN DEVELOPMENT, HIS DESIGNEE, OR ANY SUCCESSOR THERETO. THEREFORE, THE CITY OF CORPUS CHRISTI HAS CAUSED THIS NOTICE TO BE APPROVED AND FILED BY R.
