HomeMy WebLinkAbout09634 ORD - 02/04/1970AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING CHAPTER 9, ARTICLE IV, BY ADDING THERETO A NEW SECTION, TO BE NLBERED 9 -142A, FORBIDDING THE DEPOSITING OF REFUSE OR DEBRIS IN BAY AREAS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING CHAPTER 9, ARTICLE IV, BY ADDING THERETO A NEW SECTION, TO BE NUMBERED 9 -42A, READING AS FOLLOWS: "SECTION 9- 42A. FORBIDDING THE DEPOSITING OF REFUSE OR DEBRIS IN BAY AREAS. NO PERSON SHALL SWEEP, THROW OR DEPOSIT IN ANY WATERS OF CORPUS CHRISTI BAY, NUECES BAY, DSO BAY, OR ANY OF THE PUBLIC WATERS OF THE CITY, f' ANY GARBAGE, TRASH, RUBBISH OR WASTE MATERIAL IN ANY MANNER. SUCH ARTICLES FORBIDDEN TO BE PLACED OR PERMITTED TO GET INTO THE SAID WATER AREAS INCLUDE: WASTE FOODS, FISH, BRUSH, GARBAGE, WOOD, BOXES, CRATES, CARTONS, PIECES OF PAPER, WASTE PAPER, NEWSPAPERS OR ANY PAPER MATERIAL, OR ANY DISCARDED ANIMAL OR VEGETABLE MATERIAL. IT SHALL ALSO BE AN OFFENSE TO DEPOSIT OR LEAVE ON THE LAND AREA ANY OF THE ARTICLES MENTIONED IN THE PRECEDING POR- TION OF THIS SECTION, IN SUCH A WAY AS TO BE CARRIED INTO THE WATERS OF SAID WATER AREAS OF THE CITY BY TIDES, DRAINAGE WATERS OR OTHER ELEMENT." SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE,OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 3. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CON- TAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 4. THE NECESSITY TO ADOPT THE PROVISIONS HEREINABOVE SET FORTH IN ORDER TO PROTECT THE PUBLIC HEALTH, SAFETY, AND WELFARE OF THE CITIZENS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE 9631 CITY COUNCIL, AND THE MAYOR HAYING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE 4& DAY OF FEBRUARY, 1970- ATTEST: Cl Y SECR APPROVED: aiANURAy Z/ TA ` C /I �✓ 1 Cx c��9n .1 / THE CITY OF CORPUS CHRISTI, TEXAS , DAY OF 4ZRQWff , 1970: n D. CITY ATTORNEY Corpus Christi, Texas IlViU day of TO THE tJEbIBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend laid Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
