HomeMy WebLinkAbout09640 ORD - 02/04/1970AN ORDINANCE ABANDONING THE UTILITY EASEMENT PRESENTLY EXISTING IN LOTS 4, 5, 6, 7, 8, 9, 10, and 11, OF BLOCK 3, PARK - DALE AUTOTOWN, A SUBDIVISION OF THE CITY OF CORPUS CHRISTI, TEXAS, AS SHOWN BY PLAT RECORDED IN VOL- UME 30, PAGE 33, MAP RECORDS OF NUECES COUNTY, TEXAS; AND DECLAR- ING AN EMERGENCY. WHEREAS, a certain utility easement exists in Lots 4, 5, 6, 7, 8, 9, 10 and 11 of Block 3, PARKDA LE AUTOTOWN, a subdivision of the City of Corpus Christi, Texas, as shown by plat recorded in Volume 30, Page 33, Map Records of Nueces County, Texas; and WHEREAS, the owner of the property hereinabove men- tioned has granted a substitute easement, such substitute easement being shown on a replat of Lots 4 -12, Block 3, PARKDALE AUTO- TOWN, which has been submitted for the approval of the City; and WHEREAS, the City of Corpus Christi is agreeable to the relocation of the hereinabove referred to utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That upon the obtaining of approval of the Planning Commission of the plat and recording of the plat in the County Clerk's office, showing thereon a utility easement to be used in lieu of the utility easements heretofore existing in Lots 4, 5, 6, 7, 8, 9, 10, and 11, Block 3, Parkdale Autotown, and the actual relocation of all utility lines now in said existing utility easements in said lots at the expense of the owner of said lots in Parkdale Autotown concerned with said reloca- tion be and the same is hereby abandoned, released and relinquished by the City of Corpus Christi unto the present owners as of the date of the filing of said approved replat providing for said substitute utility easements and the actual relocation of existing utility lines as aforesaid. Said existing utility easements presently existing in said Lots 4, 5, 6, 7, 8, 9, 10, 11, Block 33 Parkdale Autotown, is more fully described as follows: 9640 1. A 10 foot wide easement for utilities to be closed, and contiguous with a portion of the common boundary line of Lots 4 and 5, Block 3, PARKDALE AUTOTOWN, shown by map of record filed in Volume 30, Page 33, of the Map Records of Nueces County, Texas. BEGINNING at the northwest corner of Lot 4, the northeast corner of Lot 5, a point in the southwest boundary line of Lot 9 for a point in the northerly or northeast boundary line of this tract and the POINT OF BEGINNING; THENCE with the common boundary line of Lots 5 and 9, N 600 52' 45" W 5 feet to the most northerly or northwest corner of this tract; THENCE crossing a portion of Lot 5 parallel with and 5 feet normal to the common boundary line of Lots 4 and 5, S 290 07' 15" W 50 feet to the most westerly or southwest corner of this tract; THENCE S 600 52' 45" E at 5 feet pass the common boundary line of Lots 4 and 5 and 5 feet unto Lot 4 for a total distance of 10 feet to the most southerly or southeast corner of this tract; THENCE parallel with and 5 feet normal to said boundary line of Lots 4 and 5, N 290 07' 15" E 50 feet to a point in the southwest boundary line of said Lot 9 for the most easterly or northeast corner of this tract; THENCE with said boundary line N 600 52' 45" W 5 feet to the POINT OF BEGINNING. 2. A 10 foot wide easement for utilities to be closed and contiguous with the southwesterly boundary line of Lots 6 through 10 and a portion of Lot 11, Block 3, PAREDALE AUTOTOWN, shown by map of record filed in Volume 30, Page 33 of the Map Records of Nueces County, Texas. BEGINNING at the most southerly or southeast corner of said Lot 6, Block 3, for a point in the east boundary line of this tract and the POINT OF BEGINNING; THENCE with the easterly or southeast boundary line of Lot 6, N 290 07' 15" E 5 feet to the northeast corner of this tract; -2- THENCE crossing Lots 6 through 10 and a portion of Lot 11 parallel with and 5 feet normal to the southwest boundary line of said Lots N 600 52' 45" W 310 feet to the northwest corner of this tract; THENCE S 290 07' 15" W at 5 feet pass the southerly boundary line of Lot 11 and 5 feet into Lot 5 for a total distance of 10 feet to the southwest corner of this tract; THENCE crossing Lots 5 and 4, respectively, paral- lel with and 5 feet normal to the southwesterly boundary line of the hereinbefore described lots S 600 52' 45" E at 120 feet pass the common boundary line of said Lots 4 and 5 and 190 feet for a total distance of 310 feet to the southeast corner of this tract; THENCE N 290 07' 15" E 5 feet to the POINT OF BEGINNING. SECTION 2. The necessity for recognizing the abandonment of the easement hereinabove described creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested that such Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �Y of 1970. >� o ATT T: THE ITY OF CORPUS CHRISTI, TEXAS City Secr ry APPROVED: _ day of _ 1970.
