AN ORDINANCE
CANVASSING RETURNS AND DECLARING THE RESULTS OF AN
ELECTION HELD IN _THE CITY OF CORPUS CHRISTI, TEXAS,
ON FEBRUARY 14, 1970, ON THE QUESTION OF THE PRE-
FERENCE OF THE QUALIFIED VOTERS CONCERNING THE LOCA-
TION OF DAM AT EITHER THE R & M SITE OR THE CHOKE
CANYON SITE; AND DECLARING AN EMERGENCY.
WHEREAS, HERETOFORE ON THE 21ST DAY OF JANUARY, 1970, AT A REGULAR
MEETING, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED AN
ORDINANCE CALLING AN ELECTION TO BE HELD IN SAID CITY ON THE 14TH DAY OF
FEBRUARY, 1970, ON THE FOLLOWING PROPOSITION:
PROPOSITION "A"
THE CITY COUNCIL RECOMMENDS THAT ANOTHER DAM BE CONSTRUCTED
ON THE NUECES WATERSHED TO BE COMPLETED BETWEEN 1975 AND
1980. THE COUNCIL HAS CAREFULLY STUDIED ALTERNATIVE FINANC-
AND
ING AND CONSTRUCTION METHODS AND HAS CONCLUDED THAT THE
FEDERAL BUREAU OF RECLAMATION SHOULD BE ASKED TO CONSTRUCT
THE DAM AND TO ALLOW THE CITY TO REPAY THE COST OVER FIFTY
(50) YEARS. THE CITY HAS ASKED THE BUREAU TO STUDY ALL
FEASIBLE RESERVOIR SITES. THESE STUDIES CONCLUDE THAT THE
TWO BEST SITES ARE THE LOWER DR R & M SITE FIVE MILES NORTH
OF CALALLEN AND THE UPPER OR CHOKE CANYON SITE WEST OF THREE
RIVERS. THE BUREAU HAS ESTIMATED THE COST AT CHOKE CANYON
AT $37,460,000 FOR AN ANNUAL WATER YIELD OF 45 BILLION GALLONS
AND AT R & M AT $85,386,000 FOR AN ANNUAL WATER YIELD OF 54
BILLION GALLONS. IT IS, THEREFORE, SUBMITTED FOR THE CHOICE
OF THE VOTERS TO INDICATE THEIR PREFERENCE BY THEIR VOTE AS
TO WHETHER THE PROPOSED DAM SHALL BE LOCATED AT CHOKE CANYON
SITE OR THE R & M SITE.
WHEREAS, NOTICE OF SAID ELECTION WAS ACTUALLY GIVEN AS REQUIRED
BY LAW AND AS DIRECTED IN THE ORDINANCE CALLING THE ELECTION, AS IS SHOWN
BY AFFIDAVITS PROPERLY FILED IN THE OFFICE OF THE CITY SECRETARY; AND
WHEREAS, SAID ELECTION WAS DULY AND LEGALLY HELD ON THE 14TH DAY
OF FEBRUARY, 1J70, IN CONFORMITY WITH THE ELECTION ORDINANCE HERETOFORE
PASSED BY THIS CITY COUNCIL AND THE RESULT OF SAID ELECTION HAS BEEN CERTI-
FIED AND RETURNED TO THIS COUNCIL BY THE PROPER JUDGES AND CLERKS THEREOF
AND
WHEREAS, THIS COUNCIL HAS TODAY CONSIDERED THE RETURNS OF SAID
ELECTION ON THE PROPOSITION HEREINABOVE STATED, WHICH WAS HELD ON THE 14TH
DAY OF FEBRUARY, 1970; AND
WHEREAS, IT APPEARS TO THE COUNCIL, AND THE COUNCIL 30 FINDS, THAT
SAID ELECTION WAS IN ALL RESPECTS LAWFULLY HELD AND SAID RETURNS DULY AND
LEGALLY MADE AND THAT THERE WERE CAST AT SAID ELECTION THE FOLLOWING VOTES:

AND
WHEREAS, THE COUNCIL, HAVING FULLY CHECKED ALL OF THE PROCEDURE
RELATIVE TO SUCH ELECTION, AND IT APPEARING TO THE COUNCIL, AND THE COUNCIL
SO FINDS, THAT A MAJORITY OF THE LEGALLY QUALIFIED VOTERS OF AND WITHIN THE
CITY OF CORPUS CHRISTI VOTING AT SAID ELECTION EXPRESSED THEIR PREFERENCE FOR
THE R & M SITE:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE RETURNS OF THE ELECTION HELD ON THE 14TH DAY
OF FEBRUARY, 1970, AT THE VARIOUS PRECINCT VOTING PLACES AS PROVIDED IN THE
ORDINANCE ORDERING THE ELECTION, WHICH ORDINANCE WAS PASSED ON JANUARY 21,
1970, AT A REGULAR MEETING, AND ALL OF SAID VOTING PRECINCTS AND VOTING
PLACES BEING IN THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, AND
ALL BEING CONVENIENT PLACES WITHIN THE SAID CITY LIMITS, ARE HEREBY RECEIVED
AND HEREBY CANVASSED AND THE RESULTS THEREOF ARE HEREBY DECLARED AS FOLLOWS:

IT APPEARING FROM SAID CANVASS OF SAID VOTES THAT THE PROPOSITION SO SUB-
MITTED OF PREFERENCE OF THE R & M SITE IS CARRIED BY A MAJORITY OF 13,231E
TO 10,381.
SECTION 2. THE FACT THAT IT 13 OF PUBLIC IMPORTANCE TO THE RESI-
DENTS OF THE CITY OF CORPUS CHRISTI TO MAKE AN IMMEDIATE RECORD OF THE RESULTS
OF THE ELECTION HELD ON FEBRUARY 14, 1970, CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF
FEBRUARY, 1970.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
