HomeMy WebLinkAbout09654 ORD - 02/25/1970v11':2/19/70 AN ORDINANCE AMENDING SECTION 3 -2 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, TO THE EFFECT THAT PERMITS MAY BE ISSUED BY THE CITY SECRETARY, LICENSING AND PERMITTING PERSONS TO PAINT STREET NUMBER SIGNS ON CURBS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 3-2 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME 1S HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: BISECTION 3 -2. PAINTING ON OR DEFACING CITY PROPERTY. IT SHALL BE UNLAWFUL FOR ANY PERSON TO PAINT OR WRITE PICTURES, CHARACTERS, SIGNS, OR ADVERTISEMENTS OR USE ANY OTHER PAINT OR MATERIAL OF ANY KIND UPON ANY OF THE SIDEWALKS, STREETS, CURBS, OR PAVEMENTS OF THE CITY OR UPON ANY ORNAMENTAL BALLUSTRADE, FOUNTAIN, STAIRWAY, OR OTHER IMPROVEMENTS BELONGING TO THE CITY; AND IT SHALL ALSO BE UNLAWFUL TO PAINT OR TO WRITE IN ANY MANNER THEREON, OR TO CARVE THEREON, OR IN ANY WAY TO MUTILATE, DEFACE, OR DESTROY THE SAME. "PROVIDED, HOWEVER, THE CITY SECRETARY IS HEREBY AUTHORIZED TO ISSUE A PERMIT FOR LIMITED PERIODS OF TIME (NOT EXCEEDING 90 DAYS) LISTED IN THE PERMIT AUTHORIZING THE PERMITTEE TO PAINT OR PRINT STREET NUMBERS ON THE CURB SHOWING THE CORRECT STREET NUMBER OF ABUTTING PROPERTY, BUT SUCH PERMIT SHALL BE EXPRESSLY CONDITIONED UPON THE PERMITTEE OBTAINING THE CONSENT OF THE ABUTTING PROPERTY OWNER BEFORE PAINTING HOUSE NUMBER APPLICABLE TO SUCH ABUTTING PROPERTY, AND BE REVOCABLE BY THE CITY SECRETARY UPON VIOLATION OF THIS SECTION." SECTION 2. THE NECESSITY TO AMEND THE CORPUS CHRISTI CITY CODE AS HEREINABOVE PROVIDED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND 9654 NECESSITY TO EXIST, HAYING REQUESTED THE SUSPENSION OF SAIO CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF FEBRUARY, 1970. ' 'ISTI, TEXAS Corpus Christi, Texas c day of TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
