HomeMy WebLinkAbout09655 ORD - 02/25/1970vMP:2/23/70 AN ORDINANCE APPROPRIATING OUT OF N0. 291 PARK BOND FUND THE SUM OF $4,106, OF WHICH AMOUNT $4,000 IS FOR ACQUISITION OF PARCEL NO. 13 AND $106 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT NO.291- 64 -11, ELGIN PARK; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS FOR AND ON BE- HALF OF THE CITY OF CORPUS CHRISTI WITH THE OWNERS, JOE OLIVARES AND WIFE, MARY OLIVARES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF No. 291 PARK BOND FUND THE SUM OF $4,106, OF WHICH AMOUNT $4,000 IS FOR ACQUISITION OF PARCEL No. 13 AND $106 IS FOR INCIDENTAL EXPENSE ANO RELATED COSTS, APPLICABLE TO PROJECT No. 291 - 64-4, ELGIN PARK, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS, TD -WIT: LOT 28, BLOCK 2, EL REY ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS AND RECORDED IN VOLUME 8, PAGE 52 MAP RECORDS, NUECES COUNTY, TEXAS. SECTION 2. THAT THE CITY MANAGER BE, AND HE 1S HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACTS AND SUCH OTHER INSTRU- MENTS AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, THE AFORESAID PARCEL FROM THE OWNERS, JOE OLIVARES AND WIFE, MARY OLIVARES. SECTION 3. THE NECESSITY TO APPROPRIATE THE SUM HEREINABOVE DESCRIBED AND THE ACQUISITION OF THE PARCEL AFORESAID CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE .d'1 DAY OF FEBRUARY, 1970. D FIN 2 -55 Revised 7 -31 -69 nance J-c) Corpus Christi, Texas clfiday o£ , 1970 c 7 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
