HomeMy WebLinkAbout09667 ORD - 03/04/1970JKH:3 -4 -70 AN ORDINANCE APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS' WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE VARIOUS COSTS FOR STREET IMPROVEMENTS ON THAT PORTION OF WEBER ROAD, FROM PADRE ISLAND DRIVE TO SARATOGA BOULEVARD, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; DETERMINING AND FIXING THE PORTION OF SAID COSTS TO BE PAID BY AND ASSESSED AGAINST ABUTTING PROPERTY, THE PORTION THEREOF TO BE PAID BY THE CITY OF CORPUS CHRISTI, TEXAS; DETERMINING THE NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PROPERTY; ORDERING AND SETTING A HEARING TO BE HELD MONDAY, MARCH 30, 1970, AT S:00 P.M., TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, HERETOFORE ON THE 4TH DAY OF MARCH, 1970, THE CITY COUNCIL BY THE ENACTMENT OF ORDINANCE N0. r G DETERMINED THAT IT WAS NECESSARY TO IMPROVE THE FOLLOWING BY PAVING: WEBER ROAD, FROM PADRE ISLAND DRIVE TO SARATOGA BOULEVARD; AND WHEREAS, BY THE TERMS OF SAID ORDINANCE, SPECIFICATIONS WERE ORDERED TO BE MADE BY THE DIRECTOR OF PUBLIC WORKS FOR THE IMPROVEMENT OF THE AFORESAID STREET, AS PROVIDED BY SAID ORDINANCE; AND WHEREAS, THE SAID SPECIFICATIONS HAVE BEEN PREPARED AND ARE NOW SUBMITTED TO THE CITY COUNCIL FOR APPROVAL AND ADOPTION; AND WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI IS OF THE OPINION THAT IT 15 NECESSARY TO LEVY AN ASSESSMENT AGAINST THE PROPERTY AND THE OWNERS THEREOF ABUTTING UPON THE AFORESAID STREETS, AND AGAINST STREET AND RAILWAY COMPANIES WHOSE TRACKS OCCUPY SAID STREETS, IF ANY, FOR A PART OF THE COST OF IMPROVING SAID STREET, WITHIN THE LIMITS DESCRIBED, FIXING A TIME FOR THE HEARING OF THE OWNERS OF SAID PROPERTY, AND THE SAID RAILWAY COMPANIES, CONCERNING THE SAME, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SAID HEARING, AS REQUIRED BY LAW; AND WHEREAS, THE CITY COUNCIL HAS HERETOFORE, BY ORDINANCE, ORDERED THE IMPROVEMENT OF THE STREET AND PORTIONS ENUMERATED ABOVE. ANY EXIST- ING CURBS OR GUTTERS IN PLACE, MEETINGTHE SPECIFICATIONS SET BY THE CITY COUNCIL, OR WHICH CAN BE UTILIZED, SHALL BE LEFT IN PLACE, IF ANY AND CORRESPONDING CREDITS TO THE PROPERTY OWNERS SHALL BE ALLOWED ON THE ASSESSMENTS; AND 9667 WHEREAS, THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI HAS, IN ACCORDANCE WITH THE LAW, FILED HIS REPORT WITH THE CITY COUNCIL, SETTING FORTH THE PARTICIPATION BY THE RAILWAY COMPANIES AND STREET RAILWAY COMPANIES, IF ANY, AND THE PROPERTY OWNERS, IN THE COST THEREOF, TOGETHER WITH THE NAMES OF THE OWNERS AND THE DESCRIPTION OF SAID PROPERTY, AND THE WORK TO BE DONE ADJACENT THERETO, AND THE AMOUNT TO BE ASSESSED AGAINST EACH LOT OR PARCEL AND ITS OWNER AND ALL OTHER MATTERS REQUIRED BY THE APPLJCABLE LAW: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE SPECIFICATIONS SO PRESENTED TO THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI BY THE DIRECTOR OF PUBLIC WORKS HAVING BEEN CAREFULLY CONSIDERED BY THE CITY COUNCIL, BE, AND THE SAME ARE HEREBY APPROVED AND ADOPTED AS THE SPECIFICATIONS FOR THE IMPROVEMENTS TO THE AFORESAID STREET, WITHIN THE LIMITS DEFINED. SECTION 2. THE CITY COUNCIL, IN INITIATING THIS PROCEEDING, IS ACTING UNDER THE TERMS AND PROVISIONS OF THE ACT PASSED AT THE FIRST CALLED SESStON OF THE FORTIETH LEGISLATURE OF THE STATE OF TEXAS, AND KNOWN AS CHAPTER 106 OF THE ACTS OF SAID SESSION, TOGETHER WITH ANY AMENDMENTS THERETO, NOW SHOWN AS ARTICLE 1105B OF VERNON'S CIVIL STATUTES, AS AN ALTERNATIVE METHOD FOR THE CONSTRUCTION OF STREET IMPROVEMENTS IN THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 3. THAT THE REPORT OR STATEMENT FILED BY THE DIRECTOR OF PUBLIC WORKS, HAVING BEEN DULY EXAMINED, IS HEREBY APPROVED. SECTION 4. THAT IT IS HEREBY FOUND AND DETERMINED THAT THE COST OF IMPROVEMENTS ON THE HEREINAFTER DESCRIBED STREET, WITHIN THE LIMITS DEFINED, WITH THE AMOUNT OR AMOUNTS PER FRONT FOOT PROPOSED TO BE ASSESSED FOR SUCH IMPROVEMENTS AGAINST ABUTTING PROPERTY AND THE OWNERS THEREOF, AND AGAINST STREET AND RAILWAY COMPANIES WHOSE TRACKS OCCUPY SAID STREET, IF ANY, ARE AS FOLLOWS, TO -WIT: -2- WEBER ROAD IMPROVEMENTS This project is titled as the Weber Road Street Improvements Project from Padre Island Drive to Saratoga Boulevard and is designated as Farm to Market Road 43. This construction will consist of excavation to permit the construction of pave- ment as per Highway Department plans, and also the installation of 6" curb and gutter, 4' wide reinforced concrete sidewalks, and 6" thick reinforced concrete •driveways as well as header curbs. The pavement portion of the project will be the responsibility of the State of Texas; the drainage, right -of -way, utilities and concrete work will be that of the City. The assessment rates have been determined in accordance with the present policy of the City and by applying the unit prices obtained by the low bid to the calcu- lated quantities for the improvements abutting the properties. The assessments have been made only to the portions of the contract which are to be paid by City funds. The rates are as follows: Curb and Gutter $2.40 L.F. Sidewalks .45 S.F. Driveways .95 S.F.
