HomeMy WebLinkAbout09668 ORD - 03/04/1970mvl :S -4 -/U AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF PHARAOH ENTERPRISES, LTD. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON 2IL212 -ACRE TRACT OUT OF LOTS 2 THROUGH 5, SECTION 29, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, "R -1B" ONE FAMILY DWELLING DISTRICT AND "f -1" NEIGHBORHOOD BUSINESS DISTRICT TO "A -1" APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDI- NANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Zoning and Planning Commission has forwarded to the City Council its reports and recommendations concerning the applica- tion of Pharaoh Enterprises, Ltd. for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on March 2, 1970, at Special Council Meeting of the City Council in„,the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 9668 SECTION 2. That the zoning of the following described tract or parcel of land be and the same is hereby changed from "R -1B" One Family. Dwelling District and "B -1" Neighborhood Business District to "A -1" Apartment Rouse District: A tract of land consisting of 24.212 acres, more or less, out of Lots 2, 3, 4, and 5, Section 29 of F.B. & E.G. & G. tracts in Nueces County, Texas; Beginning at a point in the northeast right -of -way line of McArdle Road for the most westerly or southwest corner and POINT OF BEGINNING of this tract, whence the most southerly corner of Block 1, Pharoah Valley, Carriage Park Towne Rouses, recorded in Volume 33, Page 8 of the Map records of said county, bears with said right -of -way line N. 60° 57' 20" W. 690'. THENCE with the west boundary line of this tract N. 29° 02' 40" E. 620', N. 11° 56' 53" W. 250.24', to a point in the south boundary line of Tract 1 of the Pharoah Country Club for the northwest corner of this tract; THENCE with said boundary line N. 78° 03' 07" E. 820.17', to the westerly right -of -way line of Ennis Joslin Road for the northeast corner of this tract; THENCE in a southerly direction with said right -of -way line, a circular curve to the right whose radius center bears S. 81 28' 57" W., said curve having a central angle • 100 43' 03" radius • 1869.86', tangent • 175.39', for an arc distance of 349.76', to the point of tangency; THENCE S. 2° 12' W. 320.35', to the point of curve of a circular curve to the left; THENCE with said curve having a central angle • 17° 42' 54 ", radius o 1949.86', tangent ■ 303.86' for an arc distance of 602.87' to the most easterly corner of this tract; THENCE leaving said right -of -way line S. 73° 57' W. 162.75'; S. 29° 02' 40" W. 162.64', to the northeast right - of-way line of McArdle Road for the most southerly or southeast corner of this tract; THENCE with said right - of-way line N. 60° 57' 20" W. 1021.20', to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. -2- SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 4th day of March, 1970. AP D: DAY OE MARCH, 1970: City Attorn THE CITY OF CORPUS CHRISTI, TEXAS Corpus Christi, xas f'day of J , 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
