HomeMy WebLinkAbout09674 ORD - 03/11/1970vMr - 3/11/70 AN ORDINANCE AMENDING ORDINANCE NO. 8634, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 25, 1967, REGULATING AUTO WRECKERS IN THE CITY OF CORPUS CHRISTI, BY AMENDING SECTION 21 OF SAID ORDINANCE SO AS TO HEREAFTER PRO- VIDE FOR A TOWING CHARGE OF $7.50 FOR TRANSPORTING AN IMPOUNDED VEHICLE TO THE CITY POUND; AMENDING SECTION 21 -151 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, SO AS TO PROVIDE FOR A CHARGE OF $7.50 FOR REDEMPTION OF AN IMPOUNDED VEHICLE AND A STORAGE AND IMPOUNDING CHARGE OF $1.00 FOR EACH DAY, OR PORTION THEREOF; PRO- VIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE No. 8634, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 25, 1967, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SECTION 21 THEREOF TO HEREAFTER READ AS FOLLOWS: "SECTION 21. EACH AUTO WRECKER PERMIT HOLDER MAY CHARGE A FEE NOT TO EXCEED $7.50 TO TRANSPORT AN IMPOUNDED VEHICLE TO THE CITY POUND. EACH AUTO WRECKER PERMIT HOLDER MAY CHARGE A FEE NOT TO EXCEED $10.00 TO TRANS- PORT A DISABLED VEHICLE TO SAID AUTO WRECKER PERMIT HOLDER'S PLACE OF BUSINESS OR TO SUCH OTHER LOCATION WITHIN THE CITY LIMITS AS MAY BE REQUESTED BY THE DRIVER OR OWNER OF A DISABLED VEHICLE AT THE LOCATION OF SAID DISABLED VEHICLE. IN ADDITION TO THE FOREGOING FEE FOR TRANSPORTING A DISABLED VEHICLE, AN ADDITIONAL CHARGE MAY BE MADE FOR ADDITIONAL LABOR THAT IS NOT REQUIRED IN A NORMAL TOW, INCLUDING, BUT NOT LIMITED TO, THE DISENGAGING OR REMOVAL OF DRIVE SHAFTS, AND THE REMOVAL AND REPLACEMENT OF TIRES AND WHEELS; PROVIDED, HOWEVER, SUCH ADDITIONAL LABOR SHALL BE REASONABLY ITEMIZED AND IN NO CASE SHALL SUCH ADDITIONAL CHARGE EXCEED $10.00. EACH HOLDER OF AN AUTO WRECKER PERMIT MAY CHARGE A TRANSFER FEE NOT TO EXCEED $7.50 FOR TRANS- PORTING A DISABLED VEHICLE FROM THE PERMIT HOLDERS STORAGE AREA TO SUCH LOCATION WITHIN THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI AS MAY BE DIRECTED BY THE OWNER OR DRIVER OF A DISABLED VEHICLE. PERMIT HOLDERS MAY CHARGE A STORAGE FEE FOR DISABLED VEHICLES NOT TO EXCEED $1.00 PER DAY OR ANY PORTION THEREOF." 0 SECTION 2. THAT SECTION 21 -151 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME 15 HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: °SECTION 21 -151. SAME -- REDEMPTION OF VEHICLES; FEES FOR IMPOUND- ING AND STORAGE. ANY VEHICLE WHICH HAS BEEN IMPOUNDEO AS PROVIDED IN THE PRECEDING SECTION MAY BE RECLAIMED BY THE OWNER OR PERSON ENTITLED TO THE POSSESSION OF SUCH VEHICLE UPON THE FOLLOWING CONDITIONS: (1) UPON SATISFACTORY PROOF THAT HE IS ENTITLED TO THE POSSESSION OF SUCH VEHICLE. (2) UPON THE PAYMENT OF THE SUM OF $7.50, WHICH SUM IS HEREBY DECLARED TO BE A REASONABLE SERVICE CHARGE FOR THE IMPOUNDING OF SUCH VEHICLES. (3) UPON THE PAYMENT OF A STORAGE FEE OF $1.00 FOR THE FIRST PERIOD OF 24 HOURS OR PORTION THEREOF, OF IMPOUNDMENT, AND A STORAGE FEE OF $1.00 FOR EACH SUBSEQUENT PERIOD OF 24 HOURS OR PORTION THEREOF, WHICH SUCH VEHICLE IS IMPOUNDED, WHICH STORAGE FEE IS HEREBY DECLARED TO BE REASONABLE. (4) PROVIDED, HOWEVER, THE CHIEF OF POLICE MAY RELEASE VEHICLES ILLEGALLY OR UNLAWFULLY TOWED IN AND RECOVERED STOLEN VEHICLES WITHOUT PAY- ' MENT OF IMPOUNDMENT CHARGES AND WITHOUT STORAGE CHARGES EXCEPT OF WHERE RELEASE OF VEHICLE TO OWNER IS AFTER REASONABLE OPPORTUNITY FOLLOWING NOTICE OF VEHICLE BEING IN CITY POUND." SECTION 3. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 4. THE NECESSITY TO IMMEDIATELY AMEND THE ORDINANCE REGULATING AUTO WRECKERS IN THE CITY OF CORPUS CHRISTI AS HEREINABOVE SET FORTH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIR- ING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, -2- AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT FROM AND`AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE //Y OF MARCH, 1970.
