HomeMy WebLinkAbout09683 ORD - 03/18/1970AN ORDINANCE ABANDONING THE 2 -FOOT STREET LIGHT EASEMENT PRESENTLY EXISTING BETWEEN LOTS 6 AND 7, MEADOWLARK PARK, UNIT I, UPON DELIVERY TO THE CITY OF A 2 -FOOT STREET LIGHT EASEMENT TO BE SITUATED ALONG THE SOUTH SIDE OF LOT 7, ADJACENT TO LOT 6, BLOCK 28, EGYPTIAN PLACE, UNIT 1; AND DECLARING AN EMERGENCY. WHEREAS, A CERTAIN 2 -FOOT STREET LIGHT EASEMENT EXISTS BETWEEN LOTS 6 AND 7, BLOCK 28, MEADOWLARK PARK, UNIT 1, AS SHOWN BY MAP OR PLAT OF RECORD IN THE MAP RECORDS OF NUECES COUNTY, TEXAS; AND WHEREAS, THE OWNER OF THE PROPERTY HEREINABOVE MENTIONED HAS EXPRESSED A WILLINGNESS TO GRANT SUBSTITUTE EASEMENT, BEING TWO "I FEET IN WIDTH, SITUATED ALONG THE SOUTH SIDE OF LOT 7, ADJACENT TO LOT 6, BLOCK 28, EGYPTIAN PLACE, UNIT 11 IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND . WHEREAS, THE CITY OF CORPUS CHRISTI IS AGREEABLE TO THE RELOCA- TION OF THE HEREINABOVE DESCRIBED STREET LIGHT EASEMENT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 'I. THAT UPON THE OBTAINING OF APPROVAL OF THE PLANNING COMMISSION OF THE PLAT AND RECORDING OF THE PLAT IN THE COUNTY CLERK'S OFFICE, SHOWING THEREON A TWO -FOOT STREET LIGHT EASEMENT TO BE USED, AND BEING DESCRIBED AS BEING THAT 2 -FOOT EASEMENT ALONG THE SOUTH SIDE OF LOT 7, ADJACENT TO LOT 6, BLOCK 28, EGYPTIAN PLACE, UNIT I, A REPLAT OF MEADOWLARK PARK, UNIT 1, THERE IS HEREBY ABANDONED, RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI UNTO THE PRESENT OWNERS AS OF THE DATE OF THE FILING OF SAID APPROVED REPLAT PROVIDING FOR SAID SUBSTITUTE STREET LIGHT EASEMENT. THE EXISTING STREET LIGHT EASEMENT IS DESCRIBED AS A TWO -FOOT WIDE TRACT OR STRIP OF LAND LOCATED BETWEEN LOTS 6 AND 7, MEADOWLARK PARK, UNIT 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. 9683 SECTION 2. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE EASEMENT HEREfNABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE'PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE�DAY OF MARCH, 1970.
