HomeMy WebLinkAbout09697 RES - 04/01/1970RESOLUTION WHEREAS, CERTAIN AREAS WITHIN THE LIMITS OF THE CITY OF CORPUS CHRISTI HAVE BEEN SUBJECTED TO FLOOD DAMAGE DURING RECENT YEARS; AND WHEREAS, THE CITY OF CORPUS CHRISTI HAS BEEN AND IS INTERESTED IN REDUCING DAMAGE TO PROPERTY AND DANGER TO HUMAN LIFE FROM FLOODING; AND WHEREAS, THE CITY COUNCIL IN 1961, IN A HEARING BEFORE THE DISTRICT ENGINEER, REQUESTED THE CORPS OF ENGINEERS, U- S. ARMY, TO DEVELOP A COMPREHENSIVE FLOOD PROTECTION PLAN AS PROVIDED FOR IN PL54 -71 AND IT IS EXPECTED THAT FORMULATION OF THIS PLAN, BY ITS MAGNITUDE, WILL TAKE MANY YEARS FOR COMPLETION AND EXECUTION; AND WHEREAS, THE CITY COUNCIL HAS TAKEN, ON ITS OWN INITIATIVE, CERTAIN ACTION TO PROVIDE PROTECTION IN FLOOD PRONE AREAS UNDER ITS JURIS- DICTION BY ENACTING ORDINANCES SPECIFICALLY IMPLEMENTING FLOOD PLAIN MANAGEMENT PRACTICES; AND WHEREAS, THE LEGISLATURE HAS PROVIDED SPECIFIC AUTHORITY UNDER ARTICLE 5280 -B, V.A.T.S., AUGMENTING THE CHARTER AUTHORITY OF HOME RULE CITIES TO PROVIDE FLOOD PLAIN REGULATION; AND WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI IS INTERESTED AND DESIROUS OF ENABLING FLOOD INSURANCE TO BE MADE AVAILABLE TO ITS CITIZENS AT THE EARLIEST OPPORTUNITY: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT IT WILL RECOGNIZE ITS DUTY TO IDENTIFY AND EVALUATE FLOOD HAZARDS IN AREAS UNDER ITS JURISDICTION AND WILL DIRECT THE VARIOUS AFFECTED BOARDS AND COMMISSIONS AND STAFF TO CONSIDER SUCH MATTERS IN THEIR DECISIONS, RECOMMENDATIONS, AND ACTIONS. SECTION 2. THAT IT WILL ENACT AND MAINTAIN IN FORCE AS SOON AS POSSIBLE, AND NOT LATER THAN DECEMBER 31, 1971, SUCH ADDITIONAL FLOOD PLAIN MANAGEMENT CONTROL MEASURES AS DEEMED NECESSARY AND CONSISTENT WITH THE CRITERIA SET FORTH IN SUB -PART B, SECTION 1910 OF REGULATIONS CONCERNING THE NATIONAL FLOOD INSURANCE ACT OF 1965 (AMENDED 1969) (42 USC 4001 - 4127). SECTION 3. THAT, IF NECESSARY, IT WILL SEEK SUCH ADDITIONAL POWERS OR ASSISTANCE AS NECESSARY TO IMPLEMENT ANY ADOPTED FLOOD PLAIN MANAGEMENT PROGRAM. 9697 �I SECTION 4. THAT IT WILL ASSIST THE FLOOD INSURANCE ADMINISTRATOR AND DIRECT THE CITY STAFF TO ASSIST AT HIS REQUEST IN ANY MATTER PERTAINING TO SPECIFIC PROBLEMS OF FLOOD HAZARDS IN AREAS UNDER THE CITY'S JURISDIC- TION. SECTION 5. THAT IT WILL COOPERATE WITH THE APPROPRIATE AGENCIES IN FURNISHING INFORMATION CONCERNING NEW OR IMPROVED STRUCTURES IN THE FLOOD HAZARD AREA. SECTION 6. THAT IT WILL COOPERATE WITH APPROPRIATE AGENCIES IN SURVEYS AND MAPPING OF FLOOD PRONE AREAS, AND WILL COOPERATE WITH ADJOINING OR OVERLAPPING JURISDICTIONS IN FLOOD PLAIN PROTECTION PLANNING AND IMPLE- MENTATION. SECTION 7. THAT THE CITY MANAGER, R. MARVIN TOWNSEND, OR HIS SUCCESSOR, IS HEREBY DESIGNATED AS THE OFFICIAL WITH THE RESPONSIBILITY AND AUTHORITY TO IMPLEMENT THE COMMITMENT MADE HEREIN AND IS DIRECTED TO ASSIGN APPROPRIATE STAFF FOR THIS PURPOSE.
