AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A CONTRACT WITH BURTEX CONSTRUCTORS, INC., FOR THE
CONSTRUCTION OF THE 48" TRANSMISSION MAIN FROM CALALLEN,
PROJECT NO. 202 -68 -29.1; APPROPRIATING OUT OF NO. 202
WATER SYSTEM BOND FUND, THE SUM OF $3,225,000, OF WHICH
AMOUNT $3,125,628.50 IS FOR THE CONSTRUCTION CONTRACT
AND $99,371.50 IS FOR CONTINGENCIES INCLUDING STAKING,
RADIOGRAPHIC TESTS, INSPECTION, LABORATORY TESTING, AND
OTHER INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
A CONTRACT WITH BURTEX CONSTRUCTORS, INC., FOR THE CONSTRUCTION OF A 48"
TRANSMISSION MAIN FROM CALALLEN, PROJECT ND. 202 -68 -29.1, SAID CONSTRUCTION
TO CONSIST OF THE FURNISHING AND LAYING OF ABOUT FOURTEEN (14) MILES OF
STEEL AND DUCTILE IRON PIPE, MOST OF WHICH WILL BE ALONG LEOPARD STREET.
THE PROJECT WILL INCLUDE APPROXIMATELY 3,000 FEET OF 21+" PIPE, 12,000 FEET
OF 36" PIPE, 9,000 FEET OF 42" PIPE, 50,000 FEET OF 48" PIPE AND 3,500 FEET
OF 54" PIPE; ALL AS IS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS
AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF
WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF
BURTEX CONSTRUCTORS, INC., OPENED ON THE 25TH DAY OF MARCH, 1970, THE SAID
BID OF BURTEX CONSTRUCTORS, INC., BEING THE LOWEST AND MOST ADVANTAGEOUS
TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 202 WATER
SYSTEM BOND FUND THE SUM OF $3,225,000, OF WHICH AMOUNT $3,125,62$.50 IS FOR
THE CONSTRUCTION CONTRACT AND $99,371,50 IS FOR CONTINGENCIES INCLUDING
STAKING, RADIOGRAPHIC TESTS, INSPECTION, LABORATORY TESTING, AND OTHER
INCIDENTAL EXPENSES.
SECTION 3. THE NECESSITY TO PROVIDE GREATER WATER TRANSMISSION
CAPABILITY TO AREAS OF OUR CITY WHICH STUDIES HAVE SHOWN ARE INCREASING IN
POPULATION AND THUS, HAVE INCREASING WATER CONSUMPTION, CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY

ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR
HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED
THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE
DAY OF APRIL, 1970.

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; is therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
