HomeMy WebLinkAbout09718 ORD - 04/15/1970vMP:4 /15/70 AN ORDINANCE APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $1,706.00, OF WHICH AMOUNT $1,600.00 IS FOR ACQUISITION OF PARCEL NO. 17 AND $106.00 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT NO. 291 -64 -4, ELGIN PARK; AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACTS, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI WITH THE OWNER, MARY LOISA DAVILA OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THERE 13 HEREBY APPROPRIATED OUT OF NO. 291 PARK BOND FUND THE SUM OF $1,706.00, OF WHICH AMOUNT $1,600.08 IS FOR ACQUISITION OF PARCEL NO. 17 AND $106.00 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, APPLICABLE TO PROJECT NO. 291 -64 -4, ELGIN PARK, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS, TO -WIT: LOT 4, BLOCK 5, EL REY ADDITION, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS AND RECORDED IN VOLUME S, PAGE 52, MAP RECORDS OF NUECES COUNTY, TEXAS. SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACTS AND SUCH OTHER INSTRU- MENTS AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, THE AFORESAID PARCEL FROM THE OWNER, MARY LOISA DAVILA. SECTION 3. THE NECESSITY TO APPROPRIATE THE SUM HEREINABOVE DESCRIBED AND THE ACQUISITION OF THE PARCEL AFORESAID CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY EXIST AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF APRIL, 1970. i A- 4t; AY THE CITY OF CORPUS CHRISTI, TEXAS 9718 t CITY OF CORPUS CI3RISTI, TEXAS CERTIFICATION OF FUNDS (City Charter Article IV Section 21) April 10, 1970 I certify to the City Council that $ 1.706.00 , the amount required for the contract, agreement, obligation or expenditures contemplated in the alcove and foregoing ordinance is in the Treasury of the City of Corpus Christi to the credit of: Fund No. and Name 291 - park Bond Fund Project No. 291 -64 -4 Project Name Elgin Park - Parcel No 17 from which it is proposed to be drawn, and such money is not appropriated for any other purpose. Director o F Hance FIN 2 -55 Revised 7 -31 -69 Corpus Christi, Texas / day of 19W TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist- for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
