AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER
INTO AN AGREEMENT WITH THE TEXAS STATE LIBRARY FOR
PUBLIC LIBRARY DEVELOPMENT UNDER THE LIBRARY SERVICES
AND CONSTRUCTION ACT, A COPY OF WHICH AGREEMENT IS
ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER, R. MARVIN TOWNSEND, BE, AND
HE IS HEREBY,AUTHORIZED AND DIRECTED TO ENTER INTO AN AGREEMENT WITH THE
TEXAS STATE LIBRARY FOR PUBLIC LIBRARY DEVELOPMENT UNDER THE LIBRARY
SERVICES AND CONSTRUCTION ACT, A COPY OF WHICH AGREEMENT IS ATTACHED
HERETO AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO AUTHORIZE THE CITY MANAGER TO ENTER
INTO THE AFORESAID AGREEMENT AS SOON AS POSSIBLE CREATES A PUBLIC EMER-
GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE
CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE
SUSPENSIW OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT

AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND THE TEXAS STATE LIBRARY FOR
PUBLIC LIBRARY DEVELOPMENT UNDER THE LIBRARY SERVICES AND CONSTRUCTION ACT.
THIS AGREEMENT, made and entered into this the -day of , A.D. 197_,

WHEREAS, the

Congress of the United States has enacted the Library Services and
Public Law 89 -511, "to promote the further extension by the several
library service to areas without such services or with inadequate

plan for the development of library services program;
NOW THEREFORE, for and in consideration of the mutual covenants herein contained, the
parties hereto agree as follows:
THE TEXAS STATE LIBRARY AGREES:
1. To make a grant.of• money, 80% of which is 'to be used exclusively for the purchase of
books, the cost of microfilm and /or book binding costs and 20% as outlined in sub-
mitted application in answer to Requirement 8 of the application (a copy which is
attached to this sheet).
2. To forward grant money to the local fiscal officer upon receipt of Request for Funds
forms at the Texas State Library and to honor such requests on FY 1970 grants until
June 30, 1971.
3. To furnish such consultant services as are customarily given.
4. To furnish a Telex unit and telephone service as outlined in the Title III agreement
form enclosed.
THE CITY AGREES:
1. To submit an annual report of anticipated local library appropriations by December 1,
1970
2. To submit an annual report of local library expenditures by September 1, 1970.
3. To allow the figures indicated on the expenditure report to be listed by the Texas
State Library as matching funds under the Library Services and Construction Act.
4. To submit an official audit of the special fund set up for these Library Services and
Construction Act Title I funds (according to the Audit Manual sent annually to the
indicated local fiscal officer) by December 1, 1970.
5. To continue Telex machine and telephone service as outlined in the Title III
agreement form enclosed.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
