HomeMy WebLinkAbout09737 ORD - 05/06/1970.IKH:5 -5 -70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF LOTS 1 AND 2, BLOCK 9, MEADOW PARK ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, OWNED BYNANNIE LOU CERTAIN, A WIDOW; APPROPRIATING AND REAPPROPRIATING OUT OF GENERAL FUND NO. 102, PARK CONSTRUCTION ACTIVITY 4122, THE SUM OF $2,916.31, OF WHICH AMOUNT $2500 IS FOR ACQUISITION AND $416.31 IS FOR INCIDENTAL EXPENSE RELATED TO CLOSING COSTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF LOTS 1 AND 2, BLOCK 9, MEADOW PARK ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM NANNIE LOU CERTAIN, A WIDOW, THE TRACT OR PARCEL OF LAND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: LOT 1 AND 2, BLOCK 9, MEADOW PARK, AN ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY MAP OR PLAT IN VOLUME 4, PAGE 52, MAP RECORDS OF NUECES COUNTY, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED AND REAPPROPRIATED OUT OF GENERAL FUND No. 102, PARK CONSTRUCTION ACTIVITY 4122, THE SUM OF $2,916.31, OF WHICH AMOUNT $2,500 IS FOR ACQUISITION OF THE AFORESAID PARCEL AND $416.31 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING COSTS. SECTION 3. THE NECESSITY TO APPROPRIATE THE HEREINABOVE DESCRIBED SUMS AND TO AUTHORIZE THE ACQUISITION OF THE TRACTS OR PARCELS DESCRIBED IN ORDER THAT THE CITY MAY TAKE POSSESSION AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND NECESSITY EXIST AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS 9737 ACCORDINGLY SO ORDAINED, THIS THE A L! ATTEST: I �� 1 iL CITY SERETARYJ APPROVED: e, DAY OF MAY, 1970: THE CITY OF CORPUS CHRISTI, TEXAS Corpus Christi, Texas day of TO THE MEMBERS OF TIE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
