AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE A CONTRACT WITH R. S. BLACK FOR CONSTRUCTION
OF THE FLOUR BLUFF SANITARY SEWER LIFT STATIONS,
FORCE MAIN, AND TREATMENT PLANT, PROJECT NO. 250-67-53,
WPC —TEX -569, SUBJECT TO FINAL APPROVAL FROM THE FEDERAL
WATER QUALITY ADMINISTRATION; APPROPRIATING FROM NO. 250
SANITARY SEWER BOND FUND THE SUM OF $510,857, OF WHICH
$488,757.72 IS FOR THE CONSTRUCTION CONTRACT AND
$22,099.28 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
A CONTRACT WITH R. S. BLACK FOR CONSTRUCTION OF THE FLOUR BLUFF SANITARY
SEWER LIFT STATIONS, FORCE MAIN AND TREATMENT PLANT, PROJECT N0. 250- 67 •53,
WPC —TEx -569, SAID CONSTRUCTION TO CONSIST OF 4,035 FEET OF 10" CAST IRON
FORCE MAIN, TWO LIFT STATIONS AND THE 350,000 GPD TREATMENT PLANT, THE
TREATMENT PLANT AND LIFT STATION N0. 6 TO BE SITUATED ON LOTS 13, 14 AND 15,
SECTION 56 OF FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, NUECES COUNTY,
TEXAS, AND THE FORCE MAIN TO BE CONSTRUCTED ALONG JESTER STREET TO MILITARY
DRIVE WHERE LIFT STATION No. 5 IS TO BE LOCATED, SUBJECT TO PRIOR FINAL
APPROVAL BY THE FEDERAL WATER QUALITY ADMINISTRATION, ALL AS MORE FULLY
SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE
IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF
BY REFERENCE, AND ACCORDING TO THE BID OF R. S. BLACK OPENED ON THE 8TH
DAY OF APRIL, 1970, THE SAID BID OF R. S. BLACK BEING THE LOWEST AND MOST
ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 250 SANITARY
SEWER BOND FUND THE SUM OF $510,857, OF WHICH $1188,757.72 IS FOR THE
CONSTRUCTION CONTRACT AND $22,099.28 IS FOR CONTINGENCIES AND INCIDENTAL
EXPENSES.
SECTION 3. THE NECESSITY TO PROVIDE THE FUNDS HEREBY APPROPRIATED
AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE AFORESAID CONTRACT, SUBJECT
TO FINAL APPROVAY BY THE FEDERAL WATER QUALITY ADMINISTRATION, IN ORDER

TO PROVIDE SANITARY SEWER TREATMENT PLANT, FORCE MAIN AND LIFT STATIONS IN
A PORTION OF THE CITY WHICH HERETOFORE HAS HAD LIMITED SERVICE, CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT
SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND

for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
