FOSTER, FOR ACQUISITION OF PARCEL NO. 114, SAYFRONT OPEN SPACE PROJECT, NO. 291 -70-8; APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $26,132, OF WHICH AMOUNT $25,905 IS FOR ACQUISITION OF THE AFORESAID PARCEL OR TRACT OF LAND AND $227 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING COSTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY TIE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACQUIRE FROM NORMAN FOSTER AND WIFE, MURIEL L. FOSTER, THE HEREINAFTER DESCRIBED TRACT OR PARCEL OF LAND: PARCEL LOT A, SIDNEY P. CHANDLER SUBDIVISION OF THE CITY OF NO. 144: CORPUS CHRISTI, TEXAS, AS SHOWN BY THE MAP OR PLAT THEREOF RECORDED IN VOLUME 32, PAGE 1191 MAP RECORDS OF NUECES COUNTY, TEXAS, SAID TRACT OR PARCEL BEING NECESSARY FOR THE BAYFRONT OPEN SPACE PROJECT, No. 291 -70-8. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 291 PARK BOND FUND THE SUM OF $26,132,1, OF WHICH AMOUNT $25,905 IS FOR ACQUISITION OF THE AFORESAID PARCEL NO. 1I4 AND THE SUM OF $227 IS FOR INCIDENTAL AND CLOSING COSTS. SECTION 3. THE NECESSITY TO IMMEDIATELY AUTHORIZE THE EXECUTION OF THE REAL ESTATE SALES CONTRACT FOR THE ACQUISITION OF THE AFORESAID PARCEL AND TO APPROPRIATE THE NECESSARY FUNDS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /my DAY OF MAY, 1970.
