R. (BOB) MARSHALL AND WIFE, DOROTHY MARSHALL, HAYDEN WING AND WIFE, MARTHA ANN WING; APPROPRIATING OUT OF NO. 202 WATER SYSTEM BOND FUND THE SUM OF $11,166, OF WHICH AMOUNT $11,000 IS FOR ACQUISITION AND $166 IS FOR INCIDENTAL EXPENSE RELATED TO CLOSING COST APPLICABLE TO PROJECT N0. 202 -65 -29.1 118" WATER LINE GREENWAY RIGHT OF WAY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACTS, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACQUIRE FROM J. R. (BOB) MARSHALL AND WIFE, DOROTHY MARSHALL, HAYDEN WING AND WIFE, MARTHA ANN WING, THE HEREINAFTER DESCRIBED TRACTS OR PARCELS OF LAND: BEING A RECTANGULAR TRACT OF LAND OUT OF THE GREGORIO FARIAS GRANT, ABSTRACT N0. 572 AND OUT OF THAT CERTAIN 30 -ACRE TRACT OF LAND CONVEYED TO TOM C. BICKHAM BY DEED RECORDED IN VOLUME 273, PAGE 369, DEED RECORDS, NUECES COUNTY, TEXAS AND BEING THAT TRACT OF LAND CONVEYED BY TOM C. CONTAINING 1.00 ACRE OF LAND MORE OR LESS. 97,17 SAID TRACTS OR PARCELS ARE NECESSARY FOR THE 48" WATER LINE - GREENWAY RIGHT OF WAY, PROJECT NO. 202 -68 -29.1. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF ND. 202 WATER SYSTEM BOND FUND THE SUM OF $11,166, OF WHICH AMOUNT $11,000 IS FOR ACQUISI- TION AND $166 IS FOR INCIDENTAL EXPENSE RELATED TO CLOSING COSTS. SECTION 3. THE NECESSITY TO IMMEDIATELY AUTHORIZE THE EXECUTION OF REAL ESTATE SALES CONTRACTS FOR THE ACQUISITION OF THE AFORESAID PARCELS OR TRACTS OF LAND AND TO APPROPRIATE THE NECESSARY FUNDS FOR USE IN CONNEC- TION WITH THE 48" WATER LINE - GREENWAY RIGHT OF WAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS 130 DAY OF MAY, 1970. FIN 2 -55 Revised 7 -31 -69 197e) — Di..ec ,or nance Corpus Christi, Texas day of , 1976, TO THE MEMBERS OF THE CITY COUNCIL ' Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
