HomeMy WebLinkAbout09755 ORD - 05/20/1970vMP :5/20/70 AN ORDINANCE APPROVING AND ADOPTING THE DIRECTOR OF PUBLIC WORKS WRITTEN STATEMENT AND REPORT OF THE ESTIMATES OF THE VARIOUS COSTS FOR STREET IMPROVEMENTS ON THE FOLLOW- ING STREETS IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS: SOUTH ALAMEDA STREET, FROM OCEAN DRIVE TO MONTCLAIR DRIVE; DETERMINING AND FIXING THE PORTION OF SAID COSTS TO BE PAID BY AND ASSESSED AGAINST ABUT- TING PROPERTY, THE PORTION THEREOF TO BE PAID BY THE CITY OF CORPUS CHRISTI, TEXAS; DETERMINING THE NECES- SITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING PR ERTY; ORDERING AND SETTING A HEARING TO BE HELD �� , 1970, AT v':oa M,, TO GI NOTICE OF SAID HEARING AS REQUI ED BY THE LAWS OF THE STATE OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, HERETOFORE ON THE 20TH DAY OF MAY, 1970, THE CITY COUNCIL BY THEE ENACTMENT OF ORDINANCE NO. DETERMINED THAT IT WAS _ NECESSARY TO IMPROVE THE FOLLOWING BY PAVING: SOUTH ALAMEDA STREET, FROM OCEAN DRIVE TO MONTCLAIR DRIVE; AND WHEREAS, BY THE TERMS OF SAID ORDINANCE, SPECIFICATIONS WERE ORDERED TO BE MADE BY THE DIRECTOR OF PUBLIC WORKS, FOR THE IMPROVEMENT OF SAID SOUTH ALAMEDA STREET, AS PROVIDED BY SAID ORDINANCE; AND WHEREAS, THE SAID SPECIFICATIONS HAVE BEEN PREPARED AND ARE NOW SUBMITTED TO THE CITY COUNCIL FOR APPROVAL AND ADOPTION; AND WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI IS OF THE OPINION THAT IT IS NECESSARY TO LEVY AN ASSESSMENT AGAINST THE PROPERTY AND THE OWNERS THEREOF ABUTTING UPON THE FOLLOWING: SOUTH ALAMEDA STREET, FROM OCEAN DRIVE TO MONTCLAIR DRIVE, It AND AGAINST STREET AND RAILWAY COMPANIES WHOSE TRACKS OCCUPY SAID STREETS, IF ANY, FOR A PART OF THE COST OF IMPROVING SAID STREETS, FIXING A TIME FOR THE HEARING OF THE OWNERS OF SAID PROPERTY, AND THE SAID RAILWAY COM- PANIES, CONCERNING THE SAME, AND DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SAID HEARING, AS REQUIRED BY LAW; AND WHEREAS, THE CITY COUNCIL HAS HERETOFORE, BY ORDINANCE, ORDERED THE IMPROVEMENT OF THE STREETS AND PORTIONS ENUMERATED ABOVE. ANY EXIST- ING CURBS OR GUTTERS IN PLACE, MEETING THE SPECIFICATIONS SET BY THE CITY Z COUNCIL, OR WHICH CAN BE UTILIED, SHALL BE LEFT IN PLACE, IF ANY, AND 9,75i5 CORRESPONDING CREDITS TO THE PROPERTY OWNERS SHALL BE ALLOWED ON THE ASSESS- MENTS; AND WHEREAS, THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF CORPUS CHRISTI HAS, IN ACCORDANCE WITH THE LAW, FILED HIS REPORT WITH THE CITY COUNCIL, SETTING FORTH THE PARTICIPATION BY THE RAILWAY COMPANIES AND STREET RAILWAY COMPANIES, IF ANY, AND THE PROPERTY OWNERS, IN THE COST THEREOF, TOGETHER WITH THE NAMES OF THE OWNERS AND THE DESCRIPTION OF SAID PROPERTY, AND THE WORK TO BE DONE ADJACENT THERETO, AND THE AMOUNT TO BE ASSESSED AGAINST EACH LOT OR PARCEL AND ITS OWNER AND ALL OTHER MATTERS REQUIRED BY THE APPLICABLE LAW: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE SPECIFICATIONS SO PRESENTED TO THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI BY THE DIRECTOR OF PUBLIC WORKS AND PREPARED BY HIM FOR THE IMPROVEMENT OF SAID SOUTH ALAMEDA STREET ENUMERATED ABOVE, AS HERCIHBEFORE DEFINED, HAVING BEEN CAREFULLY CONSIDERED BY THE CITY COUNCIL, BE, AND THE SAME ARE HEREBY APPROVED AND ADOPTED AS THE SPECIFICATIONS FOR THE IMPROVEMENT OF SAID SOUTH ALAMEDA STREET, OCEAN DRIVE TO MONTCLAIR DRIVE. SECTION 2. THAT THE CITY SECRETARY BE, AND HE IS HEREBY, INSTRUCTED TO ADVERTISE FOR SEALED BIDS FOR THE CONSTRUCTION OF THE IMPROVE- MENTS CALLED FOR BY THIS ORDINANCE, SUCH ADVERTISEMENT FOR BIDS TO BE PUBLISHED IN THE CORPUS CHRISTI TIMES, THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH IS A NEWSPAPER OF GENERAL CIRCULATION IN THE CITY <•� OF CORPUS CHRISTI. THE ADVERTISEMENT SHALL BE PUBLISHED AT LEAST ONCE IN EACH WEEK FOR TWO (2) CONSECUTIVE WEEKS. ALL BIDS SHALL BE RECEIVED SUB- JECT TO THE TERMS AND PROVISIONS OF THE CHARTER OF THE CITY OF CORPUS CHRISTI, AND SHALL BE FILED WITH THE CITY SECRETARY ON THE DATE AND HOURS SPECIFIED AND SHALL BE OPENED AND READ IN THE PRESENCE OF THE COUNCIL IN A PUBLIC MEETING OF THE CITY COUNCIL. SECTION 3. THE CITY COUNCIL, IN INITIATING THIS PROCEEDING, IS ACTING UNDER THE TERMS AND PROVISIONS OF THE ACT PASSED AT THE FIRST CALLED SESSION OF THE FORTIETH LEGISLATURE OF THE STATE OF TEXAS, AND KNOWN AS CHAPTER 106 OF THE ACTS OF SAID SESSION, TOGETHER WITH ANY AMENDMENTS THERETO, NOW SHOWN AS ARTICLE 11058 OF VERNON'S TEXAS CIVIL STATUTES, AS -2- AN ALTERNATIVE METHOD FOR THE CONSTRUCTION OF STREET IMPROVEMENTS IN THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 4. THAT THE REPORT OR STATEMENT FILED BY THE DIRECTOR OF PUBLIC WORKS HAVING BEEN DULY EXAMINED IS HEREBY APPROVED. SECTION 5. THAT IT IS HEREBY FOUND AND DETERMINED THAT THE COST OF IMPROVEMENTS ON THE HEREINAFTER DESCRIBED STREETS WITH THE AMOUNT OR AMOUNTS PER FRONT FOOT PROPOSED TO BE ASSESSED FOR SUCH IMPROVEMENTS AGAINST ABUTTING PROPERTY AND THE OWNERS THEREOF, AND AGAINST STREET AND RAILWAY COMPANIES WHOSE TRACKS OCCUPY SAID STREETS, IF ANY, ARE AS FOLLOWS, TO -WIT: -3- ALAMEDA STREET IMPROVEMENTS This project is titled Alameda Street Improvements from Montclair to ocean D=ive, Project 220-67-87. The project is to be constructed by excavating the streets to a width and depth to permit the laying of 6" standard curb and €^fitter section and the installation of pavement consisting of: 1) 11" Lime Stabilized Base 2) 31" Type "B" Asphaltic Concrete lg" Type "D" Asphaltic Concrete Surface In addition, reinforced concrete sidewalks are also to be constructed on this rroject, varying in width from 4' to 5' depending on whether they are located next to the property line or next to the curb. The sidewalks are to be re- inforced and 4" thick. The concrete driveways, where needed and where requested ty property owners, are proposed as well as storm sewers for the purpose of d- raining the street. The plans also incorporate, together with the drainage system on Alameda, the drainage for Phase I of the Edgewater Terrace storm sewer system. In addition, the replacement of a 12" water line with a new 12" b-ster line the entire length of the project is also proposed. The assessment rate has been determined by using the unit prices taken from the low bid submitted by South Texas Construction Company and applying those unit prices to the rront footage of the abutting property in accordance with the assessment policy of the City of Corpus Christi.
