HomeMy WebLinkAbout09768 ORD - 05/27/1970IMS:JKH :5 -26 -70 AN ORDINANCE REPEALING ORDINANCE NO. 975+, DETERMINING THE NECES- SITY FOR IMPROVEMENT OF ALAMEDA STREET FROM OCEAN DRIVE TO MONTCLAIR DRIVE, AND REPEALING ORDINANCE NO. 9755, APPROVING AND ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS AND PROVIDING FOR PUBLIC HEARING CONCERNING ASSESSMENTS ON ALAMEDA STREET FROM OCEAN DRIVE TO MONTCLAIR DRIVE, SAID ORDINANCES HAVING BEEN PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 20, 1970; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS s r. CHRISTI, TEXAS: I SECTION 1. THAT ORDINANCE NO. 9754, DETERMINING THE NECESSITY FOR IMPROVEMENT OF ALAMEDA STREET FROM OCEAN DRIVE TO MONTCLAIR DRIVE, AND ORDINANCE No. 9755, APPROVING AND ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS AND PROVIDING FOR PUBLIC HEARING CONCERNING ASSESSMENTS ON ALAMEDA STREET FROM OCEAN DRIVE TO MONTCLAIR DRIVE, PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 20, 1970, BE, AND THE SAME ARE HEREBY, REPEALED IN THEIR ENTIRETY. SECTION 2. THE NECESSITY TO IMMEDIATELY REPEAL THE AFORE- SAID ORDINANCES WHICH CONTAINED INCOMPLETE INFORMATION CONCERNING STREET IMPROVEMENTS TO BE MADE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER e RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF SUCH CHARTER RULE, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND'IAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO I ORDAINED, THIS THE 27TH DAY OF MAY, 1970. ATTE m C Y SEclk E Y MA APPROVED: /HE CITY OF CORPUS CHRISTI, TEXAS •2 7 DAY OF MAY, 1970: CITY ATTORNEY •• D Corpus Christi, Texas At"- .y of , 19 � TO THE MENDERS OF TILE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
