AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
REAL ESTATE SALES CONTRACT, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, WITH ROGER CHAVANA AND WIFE,
HERMINIA CHAVANA, FOR ACQUISITION OF LOTS 5 AND 6,
BLOCK 3, CRAVEN HEIGHTS ADDITION, IN CONNECTION WITH
RELOCATION NECESSITATED BY THE CONSTRUCTION OF A CITY
SWIMI NG POOL TO BE CONSTRUCTED ON A TRACT OF LAND AT
BROWNLEE AND WINNEBAGO STREETS IN THE CITY OF CORPUS
CHRISTI; APPROPRIATING OUT OF NO. 102 GENERAL FUND THE
SUM OF $11,410, OF WHICH $11,250 IS FOR ACQUISITION OF
THE AFORESAID TRACT OR PARCEL AND THE SUM OF $160 IS
FOR CLOSING COSTS AND RELATED EXPENSES IN CONNECTION
WITH THE ACQUISITION OF THE ABOVE PARCEL OR TRACT, IN
CONNECTION WITH PROJECT NO. 291 -70 -7, SAID GENERAL
FUND NO. 102 TO BE REIMBURSED OUT OF NO. 291 PARK BOND
FUND IF AND WHEN SUCH FUNDS ARE PROVIDED; AND DECLAR-
ING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE ITY MANAGER BE, AND HE 1S HEREBY, AUTHORIZED
TO EXECUTE, FOR AND ON BEHAL F THE CITY OF CORPUS CHRISTI, REAL ESTATE
SALES CONTRACT WITH THE OWNERS, ROGER CHAVANA AND WIFE, HERMINIA CHAVAN,
FOR ACQUISITION OF THE FOLLOWING DESCRIBED PARCEL OR TRACT OF LAND, NECESSI-
TATED BY THE CONSTRUCTION OF A CITY SWIMMING POOL TO BE CONSTRUCTED ON A
TRACT OF LAND AT BROWNLEE AND WINNEBAGO STREETS IN THE CITY OF CORPUS CHRISTI,
SAID PARCEL BEING DESCRIBED AS FOLLOWS:
LOTS 5 AND 6, BLOCK 3, CRAVEN HEIGHTS ADDITION, A SUB-
DIVISION LOCATED IN NUECES COUNTY, CORPUS CHRISTI,
TEXAS, AND FURTHER IDENTIFIED BY PLAT OF RECORD IN
VOLUME A, PAGE 7, MAP RECORDS OF NUECES COUNTY, TEXAS.
SECTION 2. THAT THERE IS HEREBY APPROPRIATED OUT OF N0. 102
GENERAL FUND THE SUM OF $11,410, OF WHICH $11,250 IS FOR ACQUISITION OF THE
AFORESAID TRACTS OR PARCELS OF LAND AND THE SUM OF $160 IS FOR CLOSING
COSTS AND RELATED EXPENSES IN CONNECTION WITH THE ACQUISITION OF THE AFORE-
SAID PARCELS, IN CONNECTION WITH PROJECT N0. 291 -70 -7, SAID GENERAL FUND
NO. 102 TO BE SUBJECT TO REIMBURSEMENT OUT OF NO. 291 PARK BOND FUND IF AND
WHEN SUCH FUNDS ARE PROVIDED, SUBJECT TO THE CONSUMMATION OF THE SALES AGREE-
MENT PRESENTLY PENDING BETWEEN THE CITY AND DUDLEY JONES, ET AL, FOR LOTS
5 AND 6, AND FRACTIONAL LOTS NOS. 7 AND 8, BEING ALL THAT PORTION OF LOTS 7
AND H, BLOCK 2, CRAVENS HEIGHTS, DESCRIBED IN VOLUME 263, PAGE 554, DEED
RECORDS, NUECES COUNTY, TEXAS, AND IN VOLUME A, PAGE 7, MAP RECORDS, NUECES
COUNTY, TEXAS.

SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE
NECESSARY DOCUMENTS AND TO AUTHORIZE PAYMENT OF FUNDS TO ACQUIRE THE SAID
PARCELS OR TRACTS IN ORDER TO PROCEED WITH PLANS FOR THE BUILDING OF A
SWIMMING POOL AT BROWNLEE AND WINNEBAGO STREETS CREATES A PUBLIC EMERGENCY
AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED
SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION
OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE L4- DAY
OF JUNE, 1970.

For the reasons set fort:: in the emergency clause of the foregoing
ordinance, a public emergency and i:perative necessity exist for the suspen-
sion of the Charter rule or requli, �!nt that no ordinance or resolution shall
be passed finally on the date it ;ntroduced, and that such ordinance or
resolution shall be read at three ,tings of the City Council; I, therefore,
request that you suspend said Cha! .•r rule or requirement and pass this ordi-
nance finally on the date it is in- oduced, or at the present meeting of the
City Council.
