HomeMy WebLinkAbout09799 ORD - 06/17/1970B,,W :6 /lo /7o AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6o16, AS AMENDED, UPON APPLICATION OF BUFORD NICHOLSON BY AMENDING THE ZONING MAP BY CHANG- ING THE ZONING ON 11.573 -ACRE TRACT OF LAND MORE OR LESS OUT OF LOTS 28 AND 29, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM " R -1B" ONE- FAMILY DWELLING DISTRICT TO "A -1" APART- MENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; RE- PEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF BUFORD NICHOLSON FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON JUNE 9, 1970, AT SPECIAL COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS,PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 61o6, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. 9799 SECTION 2. THAT THE ZONING OF AN 11.573 -ACRE TRACT OF LAND MORE OR LESS OUT OF LOTS 28 AND 29, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS MORE PARTICULARLY DESCRIBED HEREINAFTER BE AND THE SAME IS HEREBY CHANGED FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "A -1" APARTMENT HOUSE DISTRICT: FIELDNOTES FOR 11.573 ACRES, MORE OR LESS, OUT OF LOTS 28 & 29, SECTION 13, FLOUR BLUFF & ENCINAL FARM AND GARDEN TRACTS IN NUECES COUNTY TEXAS. BEGINNING AT A POINT IN THE SOUTHEAST BOUNDARY LINE OF LOT 28, SECTION 13 FOR THE MOST SOUTHERLY CORNER AND POINT OF BEGINNING OF THIS TRACT WHENCE THE MOST SOUTHERLY CORNER OF LOT 28 BEARS S 29° 03' 30" W 80 FEET; THENCE WITH SAID SOUTHEAST BOUNDARY LINE N 29° 03' 30" E 77+.04 FEET TO THE SOUTHEAST CORNER OF GULFWAY- AIRLINE PARK SHOWN BY MAP FILED IN VOLUME 34, PAGE 51, OF THE MAP RECORDS OF SAID COUNTY FOR THE MOST EASTERLY CORNER OF THIS TRACT; THENCE WITH THE SOUTHERLY OR SOUTHWEST BOUNDARY LINE OF SAID GULFWAY- AIRLINE PARK N 61° 02' 30" w 625 FEET TO THE MOST NORTHERLY CORNER OF THIS TRACT; THENCE WITH THE WESTERLY BOUNDARY LINE OF THIS TRACT S 29° 03' 30' w 3+5.37 FEET TO THE POINT OF CURVE OF A CIRCULAR CURVE TO THE RIGHT HAVING A CENTRAL ANGLE - 29° 59' 20 ", RADIUS = 291.49 FEET, TANGENT = 78.07 FEET, FOR AN ARC DISTANCE OF 152.57 FEET TO THE POINT OF REVERSE CURVE OF A CIRCULAR CURVE TO THE LEFT; THENCE WITH SAID CURVE HAVING A CENTRAL ANGLE = 30 °, RADIUS = 231.21E FEETy TANGENT = 61.96 FEET, FOR AN ARC DISTANCE OF 121.07 FEET TO THE POINT OF TANGENCY; THENCE S 290 02' 50" w 166.97 FEET TO THE NORTHEAST RIGHT - OF -WAY LINE OF HOLLY ROAD FOR THE MOST WESTERLY CORNER OF THIS TRACT; '♦ THENCE WITH SAID RIGHT -OF -WAY LINE PARALLEL WITH AND 40 FEET NORMAL TO THE ORIGINAL CENTERLINE OF HOLLY ROAD S 61° 00' 40" E 694.94 FEET TO THE POINT OF BEGINNING. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI TEXAS, APPROVED ON THE 27TH DAY OF AUGUSTS 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. -2- SECTION E. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE -/7-&A DAY OF JUNE, 1970.
