HomeMy WebLinkAbout09815 ORD - 06/24/1970mvl :6 -23 -70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE AN AGREEMENT WITH MCNAUGHTON BOOK SERVICE, WHEREBY MCNAUGHTON BOOK SERVICE, AGREES TO SET UP WITHIN THE LA RETAMA LIBRARY A COLLECTION OF CURRENT FICTION AND POPULAR NON- FICTION BOOKS ON A RENTAL LIBRARY BASIS, AS SET OUT IN A COPY OF THE AGREEMENT ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That the City Manager of the City of Corpus Christi be, and he is hereby authorized and directed, for and on behalf of the said City, to execute an agreement with McNaughton Book Service, whereby McNaughton Book Service agrees to set up within the La Retama Library a collection of 400 current fiction and popular non- fiction books on a rental library basis at a monthly cost of $172.00, as set out in the copy of agreement attached hereto and made a part hereof. SECTION 2. If it is approved, please sign and return for our files the copy attached. (1) We propose to install in the library a collection of _000 books hereinafter called the Permanent Inventory. These books shall be chosen by the librarian, but shall be confined strictly to the fields of current fiction and popular non - fiction published within one year of the date of this agreement. (2) Sustaining shipments, to average 0 books per month* over the year, shall be sent so as to reach the library in continental U. S. A. ) on or before publication date. It is understood between the contracting parties that these shipments will be subject to some variation in monthly quantity because of fluctuations in book publishing, and that the yearly rather than the monthly average shall govern. (3) All books shipped shall be protected by Plasti -Kleer book jacket covers, numbered, dated, indexed, identified by jacket inserts as coming from the library, and shipped by book post prepaid. Indexing shall be done by copy number, author, and title on BRO -DART book card No, 23 -1 2 and on BRO -DART pocket No. _23_p6p Cards shall be inserted in pockets, and pockets attached by us to - fi flyleaf of each book. For all titles appearing on the monthly lists pre- sot pared by McNaughton Book Service, headed catalog card sets are pro- vided, if desired. * Except for the months of July and December when new books will total 50`90 of the usual quantity. Inserts identifying the books as coming from the library shall read: This Book Is From The CORPUS CHRISTI PUBLIC LIBRARIES 505 N. MESQUITE CORPUS CHRISTI, TEXAS 78401 (4) The librarian shall have the privilege of refusing to circulate any book sent, or of requesting books which he thinks would do well in the library, provided only that these requests do not grossly exceed the contractual obligations given in Sections 1 and 2 above, and that the titles requested be within our field of current fiction and popular non- fiction. The librarian's requests will be honored, and, if in excess of quota, will be deducted from the next month's supply. (5) After the library has received a total number of volumes equal to the quantity shown in paragraph (1) one, plus 107o, there shall be withdrawn EACH MONTH a sufficient quantity to maintain withdrawals for a certain definite time each month and see that the schedule is maintained. Books withdrawn may either be returned to us by UNINSURED BOOK POST ONLY or purchased by the library at a discount of 757b from list price. Refunds by us for postage charges incurred in the return of books will be made promptly on receipt of notification of amount due the library. Postal charges may not be deducted from the regular checks. Since the strict observance of the provisions of this Section is of prime importance, exceptional activity of the books shall not be used as a reason for altering the time or varying the number of withdrawals; but such exceptional activity may be the basis, by mutual consent, for altering the numbers of volumes covered by this agreement. (6) Payment for this service shall be at the rate of $.172000.... * per month - check in this amount to be mailed by the fifteenth of each month, starting with the month following receipt of initial shipment. ....40..... (7) McNaughton Books shall be treated as if they were the property of the library. McNaughton agrees to abide by the library's policies in reference to books lost in the course of normal circulation. Any charges made for lost or damaged books shall be remitted to McNaughton to the extent of 257b of the list price of the book and it will be removed from inventory. If however, a replacement copy is needed by the library, then 6001b of the list price will be remitted and the book will remain in inventory. (8) The collection shall be kept by the library for a minimum period of one year from date of installation. Thereafter, this agreement shall continue indefinitely, with the provision that it may be terminated at any time by either party giving the other party sixty days written notice of its intent, and the further provision that changes in inventory and rate of turnover may be made by the librarian at any time by giving thirty days written notice in advance to McNaughton Book Service. (9) If this agreement be terminated for any reason the library agrees to return to McNaughton Book Service all books covered by this agree- ment which have not been transferred to the library by purchase.
