AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
A CONTRACT WITH MAVERICK CONSTRUCTION COMPANY FOR THE
CONSTRUCTION OF SANTA FE STREET STORM SEWER AND OVER-
LAY IMPROVEMENTS, INTERSECTION IMPROVEMENTS AND OUT -
FALL STRUCTURE AT EMERALD COVE; APPROPRIATING $113,000
OUT OF NO. 295 STORM SEWER BOND FUND, $67,000 OF WHICH
IS APPLICABLE TO PROJECT NO. 29955- 70 -69, SANTA FE,
MELROSE TO LOUISIANA ((,$62,135.04 FOR THE CONSTRUCTION
CONTRACT AND $4,864.9b FOR CONTINGENCIES) AND $46,000
OF WHICH IS APPLICABLE TO PROJECT NO. 295- 70 -72, MINOR
STORM SEWER IMPROVEMENTS ($42,966.71 FOR THE CONSTRUC-
TION CONTRACT AND $3,033.29 FOR CONTINGENCIES); APPRO-
PRIATING $67,000 OUT OF NO. 102 GENERAL FUND, ACTIVITY
4915, CODE 502 ($62,129.48 FOR THE CONSTRUCTION CONTRACT
AND $4,870.52 FOR CONTINGENCIES); AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A
CONTRACT WITH MAVERICK CONSTRUCTION FOR THE CONSTRUCTION OF SANTA FE STREET
STORM SEWER AND OVERLAY IMPROVEMENTS, INTERSECTION IMPROVEMENTS AND AN OUT -
FALL STRUCTURE AT EMERALD COVE, SAID CONSTRUCTION TO CONSIST OF (1) IMPROVE-
MENT OF STORM SEWER ALONG SANTA FE FROM MELROSE TO LOUISIANA, (2) MINOR
IMPROVEMENTS AS FOLLOWS: (A) MCARDLE ROAD AT JANET AND LENORA, (B) MCARDLE
AT KATHY, (C) BUFORD, FURMAN, HANCOCK, BETWEEN THIRD AND WATER STREETS, TO
ELIMINATE FLOODING, INCLUDING SHORELINE AT FURMAN, (0) KINNEY AT WATER TO
RELIEVE MID -TOWN TRAFFIC EXCHANGE, AND (E) ENLARGE OUTFALL STRUCTURE AT
MORGAN AND SHORELINE NEAR EMERALD COVE, AND (3) HOT -MIX OVERLAY ON SANTA FE
FROM LOUISIANA TO ROSSITER, ALL AS IS MORE FULLY SET FORTH IN THE PLANS
AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE
CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND
ACCORDING TO THE BID OF MAVERICK CONSTRUCTION COMPANY OPENED ON JUNE 24,
1970, THE SAID BID BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF
CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 295 STORM
SEWER BOND FUND $113,000, $67,000 OF WHICH IS APPLICABLE TO PROJECT
NO. 295 -70 -69 - SANTA FE, MELROSE TO LOUISIANA ($62,135.o4 BEING FOR THE
CONSTRUCTION CONTRACT AND $4,864.96 BEING FOR CONTINGENCIES) AND $46,000

OF WHICH IS APPLICABLE TO PROJECT N0. 295 -70 -72 - MINOR STORM SEWER
IMPROVEMENTS ($42,966.71 BEING FOR THE CONSTRUCTION CONTRACT AND $3,033.29
BEING FOR CONTINGENCIES); THERE IS ALSO HEREBY APPROPRIATED $67,000 OUT OF
N0. 102 GENERAL FUND, ACTIVITY 4915, CODE 502, ($62,129.148 BEING FOR THE
CONSTRUCTION CONTRACT AND $4,870.52 FOR CONTINGENCIES).
SECTION 3. THE NECESSITY TO PROVIDE STREET AND STORM SEWER
IMPROVEMENTS TO SANTA FE FROM MELROSE TO LOUISIANA,TO ENLARGE THE OUTFALL
STRUCTURE AT EMERALD COVE AND TO CORRECT OTHER MINOR STORM SEWER PROBLEMS
AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEET-
INGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE
AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION
AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY SO ORDAINED, THIS THE / dzL DAY OF JULY, 1970.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
