HomeMy WebLinkAbout09822 ORD - 07/01/1970VMP:Vl /70 AN ORDINANCE CLOSING THE EASTERN 20 FEET OF BALDWIN BOULEVARD RIGHT OF WAY EXTENDING FROM DAVID STREET NORTHWEST- WARD TO SARITA STREET, AND 30 FEET EXTENDING FROM SARITA STREET TO CLEO STREET, WITH THE PROVISION THAT SAME REVERT TO THE ABUTTING PROPERTY OWNERS, SUBJECT TO THE PAYMENT OF THE APPRAISED VALUES, AS IS MORE FULLY HEREINAFTER SET OUT; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CONCERNING THE CLOSING OF A PORTION OF BALDWIN BOULEVARD RIGHT OF WAY WHICH IS DEEMED TO BE IN EXCESS OF THE CITY'S NEEDS, BEING THE EASTERN 20 FEET OF BALDWIN BOULEVARD RIGHT OF WAY EXTENDING FROM DAVID STREET NORTHWESTWARD TO SARITA STREET AND 30 FEET EXTENDING FROM SARITA STREET TO CLEO STREET, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID RIGHT OF WAY AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, APRIL 1, 1970, AT WHICH TIME A RECESS WAS DECLARED, SAID HEARING BEING CONTINUED AT REGULAR MEETING OF THE CITY COUNCIL ON WEDNESDAY, JUNE 2Y, 197O, IN ACCORDANCE WITH THE PRO- VISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEAR- ING THAT THE ABOVE DESCRIBED RIGHT OF WAY IS NOT NOW NEEDED FOR RIGHT OF WAY PURPOSES, NOR WILL IT, WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR RIGHT OF WAY PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE ABOVE DESCRIBED RIGHT OF WAY SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS, SUBJECT TO PAYMENT OF THE APPRAISED VALUE LESS THE CURRENT VALUE OF THE ASSESSMENTS PREVIOUSLY PAID: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF BALDWIN BOULEVARD RIGHT OF WAY WHICH IS DEEMED TO BE IN EXCESS OF THE CITY'S NEEDS, BEING THE EASTERN 20 FEET OF BALDWIN BOULEVARD RIGHT OF WAY EXTENDING FROM DAVID STREET NORTH- WESTWARD TO SARITA STREET AND 30 FEET EXTENDING FROM SARITA STREET TO CLEO STREET, IS HEREBY CLOSED FOR PUBLIC USE AND SAME WILL REVERT TO THE all ABUTTING PROPERTY OWNERS SUBJECT TO THE PAYMENT OF THE APPRAISED VALUE OF THE LAND, LESS THE ESTIMATED CURRENT VALUE OF THE ASSESSMENTS PRE- VIOUSLY PAID. THE PURCHASE PRICE OF THE LOTS AS DETERMINED BY APPRAISAL IS AS FOLLOWS: DESCRIPTION OF PROPERTY 11 PURCHASE PRICE 4 PORTION OF LOT 1, BLOCK , SOUTHWEST HEIGHTS $2,200.00 PORTION OF LOT 16, BLOCK 4, SOUTHWEST HEIGHTS 500.00 PORTION OF LOT 1, BLOCK 5, SOUTHWEST HEIGHTS 500.00 PORTION OF LOT 16, BLOCK 5, SOUTHWEST HEIGHTS 500.00 PORTION OF LOT 1, BLOCK A, PHILLIPS ADDITION 1,500.00 PORTION OF LOT 16, BLOCK A, PHILLIPS ADDITION 1,500.00 IT IS EXPRESSLY PROVIDED THAT THE CLOSING OF BALDWIN AVENUE AT THE ABUT- TING LOTS DESCRIBED ABOVE SHALL NOT BE EFFECTIVE UNTIL FULL PAYMENT IN THE AMOUNTS DESIGNATED ABOVE AS PURCHASE PRICE FOR SAID ABUTTING LOTS HAS BEEN FULLY PAID TO THE CITY OF CORPUS CHRISTI. UPON THE FULL PAYMENT OF PURCHASE PRICE FOR EACH ABUTTING LOT THE CLOSING OF THE STREET ALONG THE FRONTAGE OF SAID ABUTTING LOT SHALL THEN BECOME EFFECTIVE. SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE FOR AND IN BEHALF OF THE CITY OF CORPUS CHRISTI TEXASX ANY OR ALL SUCH FORMS OR INSTRUMENTS AS MAY BE NECESSARY TO EFFECTUATE THE PURCHASE AND SALE OF THE ABOVE DESCRIBED LOTS. ALL INSTRUMENTS OF CONVEYANCE AND FOR SECURITY OF PAYMENT FOR THE PURCHASE OF PROPERTY CONVEYED FOR THIS CLOSING OF BALDWIN AVENUE SHALL BE IN FORMS APPROVED BY THE CITY ATTORNEY. SECTION 3. THE NECESSITY TO ABANDON THE ABOVE DESCRIBED RIGHT OF WAY AND PROVIDE THE MEANS BY WHICH SAME MAY BE CONVEYED TO THE ADJOIN- ING PROPERTY OWNERS AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMER- GENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYOR HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE -2- PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 14-�t AY OF JULY, 1970, ATTEST: APPROVED: Y CITY ECRETAR R THE CITY OF CORPUS CHRISTI, TEXAS IDAY OF JULY, 1970: ACTING CITY JWT#RNEY Corpus Christi Tsxas day of 19_7 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
