HomeMy WebLinkAbout09827 ORD - 07/01/19707/1/70 :E AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE UNITED STATES OF AMERICA TO PARTICIPATE IN A GRANT FOR THE ESTABLISHMENT OF A MANPOWER PLANNING OFFICE, A COPY OF SAID CONTRACT BEING ATTACHED HERETO; AND DECLARING AN EMERGENCY. WHEREAS, UNDER THE MANPOWER DEVELOPMENT TRAINING ACT OF 1962, AS AMENDED, THE UNITED STATES OF AMERICA (HEREINAFTER CALLED THE "GOVERNMENT") HAS TENDERED TO THE CITY OF CORPUS CHRISTI (HEREINAFTER CALLED THE "PUBLIC BODY") A PROPOSED CONTRACT FOR GRANT TO ESTABLISH A MANPOWER PLANNING OFFICE UNDER WHICH THE GOVERNMENT AGREES TO MAKE A GRANT TO THE PUBLIC BODY TO AID IN FINANCING THE ESTABLISHMENT OF SAID OFFICE; AND WHEREAS, THE PUBLIC BODY HAS GIVEN DUE CONSIDERATION TO SAID PROPOSED CONTRACT; AND WHEREAS, THE PUBLIC BODY IS DULY AUTHORIZED UNDER AND PURSUANT TO THE CONSTITUTION AND LAWS OF THE STATE OF TEXAS TO UNDERTAKE AND CARRY OUT SUCH PROJECT AND TO EXECUTE SUCH PROPOSED CONTRACT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE PROPOSED CONTRACT DESIGNATED "GRANT FOR CAMPS MANPOWER PLANNING STAFF'S WITH ALL CONDITIONS GOVERNING GRANTS FOR THE CAMPS SECRETARIAL PROGRAM, IS HEREBY IN ALL RESPECTS APPROVED. A TRUE COPY OF SAID CONTRACT AND SUPPORTING DOCUMENTS IS ANNEXED HERETO AND BY THIS REFERENCE INCORPORATED HEREIN. SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE SAID CONTRACT IN THREE COUNTERPARTS, AND THE CITY SECRETARY IS HEREBY AUTHORIZED AND DIRECTED TO IMPRESS AND ATTEST THE OFFICIAL SEAL OF THE PUBLIC BODY ON EACH OF SUCH COUNTERPARTS AND TO FORWARD SUCH COUNTERPARTS TO THE DEPART- MENT OF LABOR, TOGETHER WITH SUCH OTHER DOCUMENTS RELATIVE TO THE APPROVAL AND EXECUTION THEREOF AS MAY BE REQUIRED BY THE GOVERNMENT. SECTION 3. THE DIRECTOR OF FINANCE OF THIS PUBLIC BODY IS HEREBY AUTHORIZED TO FILE REQUISITIONS, TOGETHER WITH NECESSARY SUPPORTING DOCUMENTS WITH THE GOVERNMENT FROM TIME TO TIME AS GRANT FUNDS ARE REQUIRED, REQUEST- ING PAYMENTS TO BE MADE TO IT ON ACCOUNT OF THE GRANT PROVIDED FOR IN THE ✓J CONTRACT, AND TO DO AND PERFORM ALL OTHER THINGS AND ACTS REQUIRED TO BE DONE OR PERFORMED TO OBTAIN SUCH PAYMENTS. SECTION 4. THE PUBLIC BODY AGREES TO ABIDE BY ALL THE PROVISIONS, TERMS AND CONDITIONS OF SAID CONTRACT. SECTION 5. THE NECESSITY TO COMPLY WITH THE REQUIREMENTS OF THE GOVERNMENT WITHIN THE TIME LIMITS PRESCRIBED FOR THE CONTRACTING AND THE OBTAINING OF ASSISTANCE CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 14-t DAY OF JULY, 1970.
