AN ORDINANCE
CLOSING THE ALLEY RUNNING BETWEEN MORGAN AVENUE AND
CRAIG STREET AND PARALLEL TO FIFTEENTH AND SIXTEENTH
STREETS FOR A DISTANCE EXTENDING FROM THE OPENING OF
SAID ALLEY ONTO MORGAN AVENUE AND ALONG
THE REAR OF
LOTS 8, 9, 10, 11, 12 AND 13, IN BLOCK 4, BAY VIEW III
RESERVING A FULL ALLEY RIGHT OF WAY AND EASE_
MENT FOR ALL UTILITIES; CONDITIONING THE CLOSING ON
APPROVED CONSTRUCTION OF CURB AND SIDEWALK ALONG THE
MORGAN AVENUE RIGHT OF WAY FRONTING THE ALLEY A� BEING
CLOSED; PROVIDING FOR THE CONSTRUCTION OF A FENCE LOCATED
AT A LINE AT THE ALLEY ENTRANCE ON MORGAN AVENUE TO BE
DETERMINED BY THE DIRECTOR OF PUBLIC WORKS AND CONSTRUCTED
AT THE EXPENSE OF THE ABUTTING PROPERTY OWNERS; AND DECLARING
AN EMERGENCY.
WHEREAS, Notice of the time and place for holding a hearing
concerning the closing of an alley running North and South between Morgan
Avenue and Craig Street, and parallel with the 1200 blocks of 15th and 16th
Streets was given by publication and registered mail to the last known
addresses of the owners of property abutting said alley and within 450 feet
of the area to be closed and thereafter, pursuant to said notice, public
hearing was held at Regular Meeting of the City Council of the City of
Corpus Christi on Wednesday, June 3, 1970, at which time a recess was
declared, said hearing being continued at Regular Meeting of the City Council
on June 24, 1970, in accordance with the Rrovisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing
that it would best serve the public convenience and necessity to close only
that portion of the alley which runs to the rear of Lots 8, 9, 10, 11, 12
and 13 in Block 4, Bay View III Addition, as that portion of the alley is not
now needed for alley purposes (but will be needed for utility purposes), nor
will it, within the foreseeable future be needed as a public alley; and
WHEREAS, it has been determined that it is to the advantage of the
City to close the above described portion of said alley so that the same may
be used by the abutting property owners for other purposes; however, the
City Council has determined it is necessary to retain easements for all
utilities:
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That that portion of the alley running North and
South between Morgan Avenue and Craig Street and parallel with the 1200
Blocks of 15th and 16th Streets, which alley extends along the rear of
Lots 8, 9, 10, 11, 12 and 13 in Block 4 of Bay View III Addition (being
only that portion which runs for depth of three lots off the Morgan Avenue
end of the alley), in the City of Corpus Christi, is hereby closed for public
use and abandoned to the owners of the abutting property, subject to the
hereinafter provided conditions and restrictions.
SECTION 2. That said closing will not be effective until abutting
owners construct a curb and sidewalk approved by the Director of Public Works
in the right of way of Morgan Avenue in front of the area being closed and
construct at least one fence across the alley being closed to designate that
it is no longer open to the public. The aforesaid fence shall be constructed
of material and at location determined by the Director of Public Works.
SECTION 3. There is hereby reserved to the City of Corpus Christi
an easement for all utilities in the full width of the right of way of the
alley between Morgan Avenue and Craig Street.
SECTION 4. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid alley creates a
Public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
