AN ORDINANCE
AMENDING ORDINANCE NO. 8211, GENERALLY REFERRED TO AS THE
MILK AND MILK PRODUCTS ORDINANCE OF THE CITY, PASSED AND
APPROVED BY THE CITY COUNCIL ON OCTOBER 19, 1966, BY ADD-
ING TO SECTION 3 A PROVISION FOR REINSPECTION FEE OF $25;
AMENDING SECTION 15 OF THE AFORESAID ORDINANCE TO HERE-
AFTER PROVIDE THAT CURRENTLY PAID LICENSE FEES AND REIN -
SPECTION FEES SHALL BE MANDATORY TO THE MAINTENANCE OF A
VALID PERMIT; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICA-
TION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT ORDINANCE N0. 8211, GENERALLY REFERRED TO AS
THE "MILK AND MILK PRODUCTS ORDINANCE" OF THE CITY OF CORPUS CHRISTI,
PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 19, 1966, BE AND THE
SAME IS HEREBY AMENDED BY ADDING TO SECTION 3 A PARAGRAPH BETWEEN THE
PRESENT THIRD AND FOURTH PARAGRAPHS, SAID NEW PARAGRAPH TO READ AS FOLLOWS:
"FOR EACH REINSPECTION MADE PURSUANT TO A WRITTEN NOTICE OF
INTENT TO SUSPEND PERMIT THE PERMIT HOLDER SHALL BE CHARGED A REINSPECTION
FEE IN THE AMOUNT OF TWENTY -FIVE ($25.00) DOLLARS. FAILURE OF PAYMENT OF
SAID FEE WITHIN THIRTY (30) DAYS AFTER THE DATE OF A GIVEN REINSPECTION
SHALL INVOKE THE PERMIT FORFEITURE PROVIDED BY SECTION 15 HEREOF."
SECTION 2. THAT ORDINANCE N0. 5211 BE AND THE SAME IS HEREBY
AMENDED BY ADDING TO SECTION 15 ANOTHER PARAGRAPH READING AS FOLLOWS:
11 CURRENTLY PAID LICENSE FEES AND REINSPECTION FEES AS HEREIN
SPECIFIED ARE HEREBY DECLARED TO BE MANDATORY TO THE MAINTENANCE OF A VALID
PERMIT HEREUNDER. UPON FAILURE OF AN APPLICANT OR PERMIT HOLDER TO FULLY
PAY THE SPECIFIED, APPLICABLE FEES WITHIN THE TIME LIMITS PRESCRIBED THERE-
FOR, SUCH APPLICANT OR PERMIT HOLDER SHALL BE SENT WRITTEN NOTICE OF INTEN-
TION TO REJECT OR CANCEL, AS THE CASE MAY BE, THE SUBJECT APPLICATION OR
PERMIT AT THE LAST KNOWN MAILING ADDRESS. IF, WITHIN TEN (10) DAYS, SUCH
DUE AND PAYABLE FEE OR FEES HAVE NOT BEEN FULLY PAID AS REQUIRED HEREIN,
THE HEALTH AUTHORITY SHALL FORTHWITH REJECT THE APPLICATION OR REVOKE THE
SUBJECT PERMIT, AS THE CASE MAY BE."
SECTION 3. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT WITH THIS ORDINANCE SHALL BE REPEALED IMMEDIATELY AFTER THE ADOPTION
OF THIS ORDINANCE.

SECTION 4. SHOULD ANY SECTION, PARAGRAPH, SENTENCE, CLAUSE OR
PHRASE OF THIS ORDINANCE BE DECLARED UNCONSTITUTIONAL OR INVALID FOR ANY
REASON, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDI-
NANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS
RELATE.
SECTION 5. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL
PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CONTAIN
THE CAPTION AND STATE IN SUBSTANCE THE PURPOSE OF THE ORDINANCE.
SECTION 6. THE NECESSITY TO IMMEDIATELY ADOPT THE PROVISIONS
CONTAINED IN THIS ORDINANCE IN ORDER TO MAINTAIN COMPREHENSIVE PROVISIONS
FOR THE REGULATION OF DAIRY FARMS AND MILK PLANTS TO PROTECT THE HEALTH,
SAFETY AND WELFARE OF THE PUBLIC CREATES A PUBLIC EMERGENCY AND AN IMPERA-
TIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT
NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH
EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF
THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; 1, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
