HomeMy WebLinkAbout09863 ORD - 07/29/1970JKH:7 -20 -70 • s AN ORDINANCE AMENDING SECTION 38-49 OF THE CORPUS CHRISTI CITY CODE, 1958, BY AMENDING THE SCHEDULE OF SEWER RATES TO PROVIDE FOR AN INCREASE IN RATES; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 38 -49 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AMENDED BY AMENDING THE SCHEDULE OF SEWER RATES TO PROVIDE AN INCREASE IN RATES, AND TO HEREAFTER READ AS FOLLOWS: "SECTION 38-49. SCHEDULE. THE MONTHLY CHARGE TO BE PAID BY USERS OF SEWER SERVICE FURNISHED BY THE CITYtS MUNICIPAL SEWER SYSTEM, EXCEPT AS PROVIDED IN SECTIONS 38 -5 AND 38 -50 OF THE CODE, SHALL BE BASED ON THE AMOUNT OF WATER USED BY SUCH USERS INSIDE THE CITY LIMITS AND OUTSIDE THE CITY LIMITS ACCORDING TO THE FOLLOWING SCHEDULE OF RATES BASED ON WATER CONSUMPTION: SCHEDULE OF RATES BASED ON WATER CONSUMPTION CLASS INSIDE CITY LIMITS OUTSIDE CITY LIMITS MINIMUM $1.20 $2.40 ONE- FAMILY MAXIMUM 3.00 6.00 TWO - FAMILY MAXIMUM 4.50 9.00 THE ACTUAL CHARGES WITHIN THE ABOVE MINIMUMS AND MAXIMUMS, AS WELL AS THE CHARGE FOR ALL OTHER SEWER USERS, WILL BE COMPUTED AS CENTS PER ONE THOUSAND GALLONS OF WATER USED AS FOLLOWS: INSIDE CITY LIMITS CENTS PER 1,000 GALLONS OF WATER USED FIRST 10 THOUSAND GALLONS OF WATER $.30 NEXT 190 THOUSAND GALLONS OF WATER .20 OVER 200 THOUSAND GALLONS OF WATER .10 OUTSIDE CITY LIMITS FIRST 10 THOUSAND GALLONS OF WATER NEXT 190 THOUSAND GALLONS OF WATER OVER 200 THOUSAND GALLONS OF WATER .6o .4o .20" SECTION 2. THAT THIS ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY AFTER THE METER READINGS OF CYCLE ONE ON OR ABOUT AUGUST 1, 1970, AND SHALL BE USED TO COMPUTE THE BILLING FOR CYCLE ONE BASED ON METER READINGS ON OR ABOUT SEPTEMBER 1, 1970 AND ON ALL BILLINGS OF ALL CYCLES THEREAFTER. • SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVI- SION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 4. THE NECESSITY TO REVISE THE RATES FOR SEWER SERVICE IN THE CITY OF CORPUS CHRISTI AND OUTSIDE THE CITY LIMITS, AS ABOVE SET FORTH IN SECTION 1 HEREOF, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THEDATE OF ITS INTRO- DUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AS HEREINABOVE PROVIDED AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY OF JULY, 1970. ATTEST: THE CITY OF CORPUS CHRISTI, TEXAS • Corpus Christi exas 2 9 day of • TO THE p1EMJ3ERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
